City Council, September 15, 2026
Hayward Police Department Year-End Report
2 On August 12, 2026, citing significant community outcry related to the approval of The Stack Data Center and concerns about the potential health and environmental risks, rising utility costs and overconsumption of natural resources, three members of the City Council prepared a referral:
• Directing staff to begin the process of prohibiting future data centers in Hayward with action before the end of the calendar year, and • Directing the Council Sustainability Committee to develop a report on economic & environmental impacts of existing data centers in Hayward.

3 Data Centers in Hayward
What are data centers?
• Data centers are buildings designed & equipped to meet the needs of high-density computing equipment, such as server racks, used for data storage and processing. Facilities require uninterrupted power supplies & cooling systems.
• Functions may include traditional enterprise services, on-demand services, cloud and high-performance computing, internet facilities, and hosting facilities. • Rely on the electric grid for power & have on-site electricity generation for back-up power.
Data Centers in Hayward
• 2010 - Amazon Data Center SF09 (24 MW) on Corporate Avenue • 2015 – Amazon Data Center SF011 (35 MW) on Corporate Avenue • 2021 – Hayward Exchange (49 MW) on Clawiter Road
• 2025 – The Stack Data Center (76.6 MW) on Eden Landing Road Hayward Police Department Year-End Report
4 Environmental Review
CEQA review & oversight authority
depends on size of data center:
• Under 50 MW: City is lead agency & prepares
CEQA documents.
• Between 50-100 MW: project is eligible for
exemption from California Energy
Commission’s (CEC) permitting authority. CEC
acts as lead agency & prepares CEQA with City
as responsible agency.
• Over 100 MW: project is subject to CEC’s
certified regulatory licensing process. CEC
prepares CEQA documents & provides
ongoing monitoring.

5 Business Related Zoning Amendments
On April 21, 2026 – City Council adopted amendments to the Zoning Ordinance to:
• Define Data Centers in the Municipal Code
• Establish Major Conditional Use Permit (MCUP) process requiring City Council approval • Allow Data Centers in the Industrial Park and General Industrial zoning districts • Require that Data Centers be subject to approval of the new MCUP process, submit a Sustainability Plan and a Community Benefits Plan regardless of building height. • The City does not have any new or pending applications for a data center under the updated regulations.
