https://hayward.zoom.us/j/84066967720?pwd=STfQFdYVPhjGEntuoifMSJdHr17GQJ.1 Tuesday, September 15, 2026, 7:00 p.m.

Development Services Director Buizer introduced Planning Manager Schmidt, who provided a synopsis of the staff report, which included that Hayward has four data centers – two built in the mid-2000s and two larger facilities, one recently operational and one under construction.

Planning Manager Schmidt presented options for further regulating data center development in Hayward in response to a City Council referral and outlined three options for City Council consideration: 1) maintain status quo and strengthen existing regulations; 2) adopt a temporary urgency moratorium while staff studies impacts and draft rules; or 3) pursue a permanent ban on new data centers.

The following speakers spoke in favor of a ban or a ban with strong regulations of existing facilities. Concerns included: water and electricity use and ratepayer costs; air pollution; diesel generator emissions and noise, including noise not studied under California Environmental Quality Act (CEQA); proximity to schools and residences; proximity to marginalized communities; electronic waste; the approval process; AI-related concerns, including surveillance and effects on jobs; and public involvement. Several speakers also asked the City Council to reconsider or reverse the STACK approval. Specific requests for monitoring and oversight included: independent baseline and enforceable low-frequency (dBC) noise limits with public reporting; public reporting of water, energy and generator run hours; a combined health risk assessment; a decommissioning bond; publication of fiscal studies; a City Council letter supporting seven pending State data center bills before the September 30, 2026, deadline; and a vote at the next meeting rather than after the November election. A petition with approximately 2,300 signatures, a proposed oversight ordinance, and a technical letter were submitted by Marla Sather.

Mayor Salinas called for a recess at 9:24 p.m. and returned at 9:35 p.m.

Mayor Salinas acknowledged the community’s calls for a ban and identified transparency (reporting and wider notification), accountability (clear rules, labor standards, threshold standards), and community benefits as key themes raised during public comment; and supported directing staff to return with a moratorium on data center development while the City evaluates and strengthens its existing policies, including notification requirements and standards related to transparency, accountability, and community benefits.

In response to Council Member Zermeño’s inquiry on whether communities near the roughly 7,900 U.S. data centers had experienced shortages or power cutoffs, City Manager Ott replied staff had focused on California and local impacts and had not reviewed every community but could review more.

Council Member Zermeño supported a moratorium to allow staff additional time to study the potential impacts of data centers, including effects on electricity and water availability, the environment, and surrounding communities; and emphasized reviewing experiences in other jurisdictions and considering both the benefits and drawbacks before determining how the City should regulate future data center development.

Council Member Roche recommended that staff bring back findings for an immediate moratorium on further data center applications; supported stronger notification and community engagement, including potential citywide notification and town halls; and supported referring the matter to the Council Sustainability Committee for further analysis 16 | S e p t e m b e r 1 5 , 202 6
including water use and quality, generator emissions, energy use, noise from generator testing and HVAC equipment, and ratepayer impacts.

Council Member Andrews indicated the referral was meant to create an in-person forum; supported reviewing an oversight ordinance and aspects of a moratorium while further identifying community concerns regarding future data center development; noted the City Council had already adopted strong requirements but should do more on community benefits, notice, ratepayer protections, oversight and labor standards, and clear expectations for both residents and developers; expressed appreciation for the Planning Commissioners and the role they play; and encouraged Hayward to establish a model for responsible data center development.

Council Member Bonilla Jr. supported a moratorium on new data centers until the City develops a comprehensive, community-driven policy addressing environmental and public health impacts, water and energy use, ratepayer impacts, noise, fuel use, community engagement, and regulatory oversight; called for stronger monitoring and public accountability for existing facilities, including scorecards; and emphasized using town halls and broad community input to develop standards for future data center development In response to Council Member Syrop’s inquiries, City staff indicated that a moratorium requires 6 of 7 votes, staff are not aware of any non-disclosure agreements signed by commissioners or City Council members, and other developers have expressed interest in Hayward.

Council Member Syrop supported an urgency moratorium on new data centers returning before the election while the City further evaluates their potential impacts and develops additional protections, while keeping a permanent ban under consideration; called for stronger monitoring, reporting, enforcement processes and developed concurrently in Council Sustainability Committee meetings; raised the idea of involving the Community Services Commission in reviewing community benefits packages; and proposed a policy barring officials from signing development-related nondisclosure agreements.

In response to Council Member Goldstein’s inquiry, staff reported that STACK's anticipated water use is about 172,000–173,000 gallons per 24-hour period, the total use covers all site uses, low-frequency noise is not analyzed under CEQA, and the project must use 100% renewable energy (about 77% solar and 23% wind).

Council Member Goldstein supported a moratorium to allow additional time to verify information, identify potential impacts, and provide greater transparency and community engagement before the City considers additional data center development; supported enhanced monitoring and reporting, including a potential public dashboard, and further study of issues such as ratepayer protections, low-frequency noise, and the broader human impacts of data centers and AI; and emphasized the importance of providing the community with accurate information when evaluating future policy.
