SUBJECT: Adopt a Resolution Amending the Professional Services Agreement with Kittelson & Associates, Inc., from a Maximum Compensation Amount Not-toExceed $1,200,000 to a Maximum Compensation Amount Not-to-Exceed $1,300,000 for Consulting Services and Approving the Appropriation of $400,000 in Fund 213 - Measure BB (Ped & Bike)for Phase 2 of the High Injury Network Safety Plan, Project No. 06942
RECOMMENDATION
That City Council adopts a resolution (Attachment II) authorizing the City Manager to amend the professional service agreement with Kittelson & Associates, Inc., (Kittelson) from a maximum compensation amount not-to-exceed $1,200,000 to a maximum compensation amount not-to-exceed $1,300,000 and approving the appropriation of $400,000 in Fund 213 - Measure BB (Ped & Bike) for the High Injury Network Safety Plan, Project No. 06942.
SUMMARY
On January 27, 20261, City Council adopted a resolution to authorize the City Manager to execute a professional service agreement with Kittelson with a maximum compensation amount not-to-exceed $1,200,000 for the High Injury Network Safety Plan, Project No. 06942.
The project is currently underway, with Phase 2 of the plan anticipated to be completed in November 2027. As part of Phase 2, staff have identified the need for additional traffic demand modeling for all project corridors. These additional tasks are estimated not-to-exceed $100,000. Staff are recommending an amendment to the agreement, increasing the maximum compensation amount to an amount not-to-exceed $1,300,000 to accommodate the additional modeling work. This would not affect overall funding of the High Injury Network Safety Plan, rather would allow City staff to reallocate unused funds from other parts of the project to better meet the needs of Phase 2 of the project.
FISCAL IMPACT
This item has no impact to the General Fund or Measure C. 1 https://hayward.legistar.com/LegislationDetail.aspx?ID=7828160&GUID=038453E9-9189-412A-84E7-16DE74EE8FCB
On October 27, 2023, the City was awarded $3,252,000 in funding from the U.S Department of Transportation Safe Streets (USDOT) and Roads for All (SS4A) federal grant, with a requirement of $814,000 in City matching funds to fully develop a Speed Management Plan and High Injury Network Safety Plan. These grant funds are applied across three Capital Improvement Program projects: 06942 – High Injury Network, 06943 – Speed Management Plan, and 06945 – Evaluate Alternatives to Downtown Loop. The remaining matching funds of $814,000 are currently budgeted in Fund 213 (Measure BB Pedestrian & Bicycle), Fund 215 (Measure B Local Transportation, and Fund 410 (Route 238 Corridor Improvement).
Unlike Fund 213 and Fund 215, Fund 410 (Route 238 Corridor Improvement) does not have an annual revenue source. For this reason, staff recommends replacing the Fund 410 contribution of $400,000 for this Project with an appropriation from Fund 213, Measure BB (Pedestrian & Bicycle). Fund 213 Measure BB (Pedestrian & Bicycle) has sufficient fund balance to cover the expense. The current and proposed budgets for High Injury Network Safety Plan Project no. 06942 is as follows:
Grant Matching
Current Proposed
Fund 213 – Measure BB (Ped & Bike) $0 $239,000 $639,000 Fund 215 – Measure B (Local Transportation) $0 $126,000 $126,000 Fund 410 – Route 238 Corridor Improvement $0 $400,000 $0 Fund 460 – Transportation System Improvement $2,565,000 $0 $0 TOTAL $2,565,000 $765,000 $765,000
This action modifies the agreement so that funds already allocated for the grant can be used through this consultant contract.
BACKGROUND
On January 27, 20262, City Council adopted a resolution to authorize the City Manager to execute a professional service agreement with Kittelson with a maximum compensation amount not-to-exceed $1,200,000 for the High Injury Network Safety Plan, Project No. 06942.
The project is underway and anticipated completion of Phase 2 of the plan is November 2027.
DISCUSSION
The High Injury Network Safety Plan project is currently underway, with Phase 2 of the plan anticipated to be completed in November 2027. As part of Phase 2, staff have identified the need for additional traffic demand modeling for all project corridors. The additional tasks require an increase of $100,000 to the Kittelson agreement to cover the expanded scope of work. Staff are now recommending amending the agreement with Kittelson using existing grant funds to cover costs associated with additional data analysis and other project-related 2 https://hayward.legistar.com/LegislationDetail.aspx?ID=7828160&GUID=038453E9-9189-412A-84E7-16DE74EE8FCB
tasks. Kittelson will complete the modeling included in their original scope and provide additional support on the modeling of other corridors to ensure that the models are consistent and aligned across the overall Safety Plan.
This action would authorize an amendment to the agreement to increase the maximum compensation from an amount not-to-exceed $1,200,000 to a maximum compensation not-toexceed $1,300,000. This increase to the maximum compensation would not affect overall funding of the High Injury Network Safety Plan, rather unused funds from Phase 1 of the project would be reallocated to better meet the needs of Phase 2, such as providing traffic demand modeling for all project corridors and other related tasks.
ECONOMIC IMPACT
The High Injury Network Safety Plan will develop comprehensive design concepts for Hesperian Boulevard, Jackson Street, and Mission Boulevard, which when implemented, will help reduce the likelihood of serious injuries and fatalities. Vehicle crashes have a significant economic cost, both to those directly impacted and to other users of the transportation system. By helping to avoid these impacts, the High Injury Network Plan will have a significant economic benefit for Hayward residents and visitors.
