Subject: City Response to Bid Protest
Dear Mr. Dunham:
The City has reviewed St. Francis Electric’s bid protest as to the Tennyson Park Streetlight Project.
City staff, along with the City Attorney’s Office, has determined that low bidder Columbia Electric’s failure to acknowledge Addendum No. 3 in its original bid, which was subsequently corrected, was an inconsequential discrepancy. This inconsequential oversight did not affect the amount of Columbia Electric’s bid, give Columbia Electric an advantage over other bidders, constitute favoritism or bias towards Columbia Electric, influence potential bidders to refrain from bidding, or affect the ability to make bid comparisons. As such, the City has determined that the bid protest should be rejected.
The Tennyson Park Streetlight Project will be presented at the City Council meeting on October 6, 2026 (7PM at Hayward City Hall), to award the contract to Columbia Electric. Pursuant to Bid Protest Procedures Section 3-1.04A of the Project’s Specifications, the Council will consider the merits of the protest and the City’s recommendation that the protest be rejected.
Sincerely,
Acting Deputy Director of Public Works
CC: Yama Farouqi
