Here, the City does not recommend issuance of a lesser penalty due to the business’s continued pattern of non-compliance, including the sale of prohibited �lavored tobacco products, electronic smoking devices, and �lavored cigarettes. During a joint inspection on January 28, 2026, conducted with the California Department of Tax and Fee Administration (CDTFA), Hayward Police Department and Hayward Code Enforcement, psilocybin mushrooms and cannabis products were discovered hidden from public view and subsequently con�iscated by the Hayward Police Department. These �indings, in addition to multiple prior enforcement cases, failed inspections, and repeated educational outreach by the City, demonstrate an ongoing pattern of non-compliance and intent to continue unlawful sales activity.

Tobacco inspections are conducted at least annually and may also occur at any time throughout the year. To avoid administrative penalty fees and potential revocation of the business license, please ensure compliance with Section 10-1.2780, Tobacco Retail Sales Establishments.
Please review the State of California DOJ Unflavored Tobacco List to identify all state-approved tobacco products. Keep in mind that the City of Hayward may enforce stricter tobacco regulations, and HMC Section 10-1.2780 will be enforced.

I arrived at Of The Bay Smoke Shop and was provided access behind the counter to conduct the inspection.
During the inspection, I observed flavored wraps, flavored rolling paper. Business license that was posted was out dated and could not find TRL.

The CDTFA inspection had already begun, as I was completing another inspection prior to arriving at this location for the Code Enforcement inspection.
Upon entering the business, CDTFA and Hayward Police had already separated prohibited items, which I documented with photographs for this case. Items observed included, but were not limited to, cannabis products, mushrooms, flavored tobacco products, vape products, and vape accessories.
Additionally, all required licenses were posted; however, they were not current.
