During a joint inspection conducted by the California Department of Tax and Fee Administration (CDTFA), Hayward Police Department, and Hayward Code Enforcement, inspectors observed a concealed hidden compartment in a false wall and behind a false bookcase located within the rear storage area of the business containing prohibited tobacco and nicotine-related products. A firearm, not registered to the clerk present or the business owner, was also observed and confiscated by Hayward Police during the inspection. The presence of concealed storage areas used to obscure prohibited merchandise demonstrates an apparent intent to conceal unlawful products and continue prohibited sales activity despite prior enforcement actions and repeated inspections.

Across multiple prior inspections, the business remained out of compliance with licensing requirements, including expired or unposted licenses and continued violations involving flavored tobacco products and prohibited cigarillo packaging, including packaging containing fewer than the minimum required quantity of five cigarillos per pack. These ongoing violations demonstrate a sustained disregard for applicable local regulations and repeated failure to correct cited issues despite prior enforcement actions and educational outreach conducted by the City.

Inspection 02/06/23 performed inspection in response to attorney letter recieved by the CoH. At time of inspection, met with store clerk Moe who allowed me behind the counter to observe products present in the store. I identified blunt wrap propducts packaged in quantities less than 5, flavored tobacco products to flavored hookah tobacco and swisher sweets red, electronic vaping devices and equipment, hemp/CBD drinks, colorful marajuana related advertizing and tobacco on sale advertizing. I advised to the store clerk to remove the unapproved products we discussed from the store immediatly and in the future if they are unsure about a product to refer to muni code SEC. 10-1.2780 or conctact me to verify.

Citation Issued Please email your inspector if you have any questions. Thank you! Jesse Prins 03/09/2026 Inspection On January 29, 2026 I conducted an initial 2026 tobacco retailer license inspection of the business. This inspection was in conjunction with Hayward police department and CDTFA.

Upon arriving at the property, I made contact with the store clerk, Saif. I gave him my business card and asked him to pass it along to the business owner and I asked him to email me for any further information. I explained that a notice would be sent out regarding any violations that are found. Saif acknowledged his
understanding and gave me express consent to enter behind the counter.

I began the inspection along with CDTFA. There were multiple violations observed. I documented these violations through photographs, which are attached to this case. Violation is included, but are not limited to: an unregistered firearm behind the counter which was confiscated by Hayward Police, packaging issues of cigarillos being under the minimum, cannabis products, a concealed back room that contained flavored vapes, flavored vape juice, and flavored nicotine products.

On March 26, 2026, I conducted a reinspection of the property for the 2026 Tobacco Retail License (TRL). I entered the business and spoke with the clerk, Saif, who was also present during the initial inspection. I explained that the purpose of my visit was to complete a reinspection and provided him with the Department of Justice document regarding the unflavored tobacco product list.

During the inspection, I observed three prohibited products. The clerk immediately removed these items from sale upon notification.

He stated that the business is transitioning toward operating more as a grocery store rather than a smoke shop and expressed a desire to remain in compliance. After removal of the items, no additional prohibited products were observed.

In the rear storage area, I observed that all of the "slat walling" was removed and the previous hidden storage area was removed and only being used for storage.

All required licensing was posted in a conspicuous location and was current.

Based on these findings, the inspection is considered passed.
