CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Declaring SCADA Network Radios as Surplus
PREPARED BY: Patrick Fuss, Water/Wastewater Engineer
STRATEGIC INITIATIVE(S):

Pursue Initiatives that Promote Environmental Stewardship Maintain and Improve Infrastructure and Facilities
RECOMMENDED ACTION(S):

Adopt a Resolution declaring eighteen SCADA network radios as surplus.

COMMUNITY ENGAGEMENT/OUTREACH:

Not applicable.

BACKGROUND:

The City’s water and wastewater utilities use a network of radios to communicate with the main control system at the Water Reclamation Facility. The radios operate on unlicensed 900 Mhz and communicate data, such as level in wet wells, operation condition of pumps and so on. The radios are essential to the successful operation of the water and wastewater systems.

DISCUSSION/ANALYSIS:

In 2021, staff were advised that the radios that were in place were being discontinued by the manufacturer. The manufacturer further advised that the older radio would not function with the newer evolution of radios and the older radio equipment would no longer be supported with spare parts.

As a fully functioning radio network is essential to facility operations, the radios could not remain in service until failure and then be replaced. As the new radios do not function with the old radios, once one radio is replaced, all must be replaced. Staff proactively replaced the discontinued, unsupported radios with the new evolution of radios so that the transfer of equipment would be under a controlled process rather than an emergency process.

The approximate value of the radios is $540. Pursuant to Healdsburg Municipal Code Section

3.24.130, supplies and equipment valued at more than $500 require a City Council resolution

6.A
Packet Pg. 8
declaring them surplus. After the Council has declared the asset as surplus, the City Manager is authorized to dispose of said supplies and equipment in whatever manner best serves the interests of the City.

ENVIRONMENTAL STEWARDSHIP:

The action requested of City Council will divert these radios from landfill, which is beneficial to the environment and consistent with the City’s solid waste minimization goals.

ALTERNATIVES:

City Council may elect to not declare these radios as surplus. If the Council does not declare these radios as surplus, the radios should be considered construction debris and disposed of as electronic waste (e-waste), which would be at some cost.

FISCAL IMPACT:

The radios are MDS iNet 900 (14 units) and iNet II 900 (4 units) and are listed on E-Bay at $100 to $200 per unit. At government auction, a sale price of $30 per unit has been observed, for a total of $540, which would be split between the water and wastewater enterprise funds.

ENVIRONMENTAL ANALYSIS:

Pursuant to Title 14, the California Code of Regulations, Section 15302(c) of the California Environmental Quality Act (“CEQA”) guidelines, approval of this resolution is an administrative activity of the City that will not result in direct or indirect physical changes to the environment.

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Accept a Recycled Water Public Utility Easement at 581 Foreman Lane PREPARED BY: Patrick Fuss, Water/Wastewater Engineer
STRATEGIC INITIATIVE(S):

Pursue Initiatives that Promote Environmental Stewardship Maintain and Improve Infrastructure and Facilities
RECOMMENDED ACTION(S):

Adopt a Resolution accepting a Recycled Water Public Utility Easement from Frank Johnson Vineyards, Inc. at 581 Foreman Lane (APN 110-130-033).

COMMUNITY ENGAGEMENT/OUTREACH:

Not applicable.

BACKGROUND:

The City of Healdsburg owns and operates a wastewater treatment facility that is permitted by the State of California under a National Pollution Discharge Elimination System NPDES) permit. One of the requirements of the NPDES permit for the facility is that no discharges to the Russian River are allowed from May 15 to September 30. To achieve compliance with this NPDES requirement in the most cost-effective manner, City staff have coordinated with agricultural operators in the vicinity to receive the tertiary treated water (recycled water) for agricultural irrigation.

In discussion with the agricultural operators, the property owners would grant easements for the construction, operation, and maintenance of the recycled water pipeline facilities in exchange for access to the recycled water for their agricultural operation.

DISCUSSION/ANALYSIS:

Frank Johnson Vineyards, Inc. is the “Owner” of record of real property located at 581 Foreman Lane (portion APN 110-130-033). This location will have a turnout used to convey and measure recycled water to this location and pipeline facilities for conveyance passed this location. The property owner of APN 110-130-033 has dedicated an easement.

6.C
Packet Pg. 18
The recommended resolution authorizes the City Manager to accept the dedication of recycled water public utility easement over a portion of APN 110-130-033 and directs staff to file the easement for recordation with the Sonoma County Recorder’s Office. The resolution has been approved as to form by the City Attorney.

ENVIRONMENTAL STEWARDSHIP:

Recycled water for irrigation helps the environment by allowing natural groundwater to remain in the ground, rather than be removed and potentially be depleted.

ALTERNATIVES:

Council could choose not to accept the easement. The recycled water pipeline facility was constructed under a right of entry agreement that indicated that the easement would be defined and dedicated to the City following construction of the pipeline, construction of which is completed. If the easement is not accepted and recorded the facilities and easements rights may not be identified on title searches or parcel maps. Staff recommends accepting the easement such that the land use and rights are properly recorded and noticed.

FISCAL IMPACT:

Accepting the dedication of easement for recycled water will not create additional fiscal responsibility on the City.

ENVIRONMENTAL ANALYSIS:

The proposed action is categorically exempt per Section 15268, Ministerial Projects, of the California Environmental Quality Act.

CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Amendment to Fitch Mountain Park and Open Space Preserve Public Access Improvements Phase B Design Agreement with Prunuske Chatham Inc for Design and Construction Drawings
PREPARED BY: Jaime Licea, Parks Superintendent
STRATEGIC INITIATIVE(S):

Maintain and Improve Infrastructure and Facilities
RECOMMENDED ACTION(S):

Adopt a Resolution amending the Professional Services Agreement with Prunuske Chatham Inc. and increasing the not-to-exceed amount by $25,808 for a total of $121,057 and authorizing the City Manager to execute the contract amendment on the City's behalf.

COMMUNITY ENGAGEMENT/OUTREACH:

In 2016 City staff conducted several public meetings with community members and local stakeholder groups to help identify key topics to be addressed in the Fitch Mountain Park and Open Space Preserve Management Plan (“Management Plan”). One of the outcomes from the community meetings was for the City to develop a formal entrance to (“public access improvements”) Fitch Mountain Park and Open Space Preserve (“Preserve”), and the requested action will help fulfill this work.

BACKGROUND:

At the November 20, 2017 City Council meeting, Council approved the completed Management Plan for Fitch Mountain Park and Open Space Preserve. A component of the Management Plan identified public access improvements to access the Preserve from the Villa Chanticleer lower parking lot. At the December 18, 2017 Council meeting, Council approved a resolution to move forward with regulatory compliance, design, and construction drawings for the public access improvements.

6.H
Packet Pg. 49
Since the timing to build the public access improvements would be contingent on securing funding, the project was proposed as a two-phase approach:
a) Phase A included the work to develop the trail head and connecting trails from the parking lot to the main Preserve trail (the fire road) that would be constructed once design and construction drawings were completed and funding was finalized through the upcoming budget process.
b) Phase B included additional site improvements to support both the Preserve and the Dog Park including restrooms, ADA corrections for the Dog Park, and other site improvements. This work would be implemented later when additional funding had been identified.

In late 2019, Phase A of the design and construction drawings were completed; however, the COVID-19 pandemic and associated fiscal impacts put the project on hold.

In February of this year, State Senator Mike McGuire informed City staff that he was pursuing additional funding to be allocated for the public access improvement project and encouraged staff to move forward with design and construction drawings for Phase B so the entire project could be completed in one phase. At the March 21, 2022 Council meeting, Council approved a Professional Services Agreement with Prunuske Chatham Inc. (PCI) to prepare and finalize design and construction drawings for Phase B. The State’s recently adopted budget includes an additional $1.5 million in funding for the project appropriated under the Coastal Conservancy.

DISCUSSION/ANALYSIS:

Based on the new funding support and the construction window described in the Streambed Alteration Agreement (SAA), additional unanticipated design work is needed. Staff is requesting that the original agreement be amended by an additional $25,808 to cover costs necessary to finalize design with the new funding. The additional budget request will bring the total design costs to $121,057.

ENVIRONMENTAL STEWARDSHIP:

Not applicable.

ALTERNATIVES:

City Council may choose not to approve the contract amendment and provide direction to staff.

This alternative is not recommended since developing public access improvements is a condition of the City Council approved Fitch Mountain Park and Open Space Preserve Management Plan.

FISCAL IMPACT:

The additional $25,808 in funding request to modify the design and construction drawings for the public access improvement project will come from the FY 2022-23 Community Services Capital Improvement Budget for this project.

ENVIRONMENTAL ANALYSIS:

Phase A of the public access improvement work was part of the Final Mitigated Negative Declaration for the Fitch Mountain Park and Open Space Preserve issued in November 2017.

6.H
Packet Pg. 50
And activities associated with the Villa Dog Park improvements are exempt from the provisions of California Environmental Quality Act under section §15301, Existing Facilities, as this exemption consists of maintenance and minor alteration to existing public structures or facilities, and the proposed construction does not expand capacity or change existing use.

Re: Proposal for additional funding for Fitch Mountain Park and Open Space Preserve Design and Construction Drawings for Public Access Improvements, Phases A1, A2, and B Dear Mr. Themig and Mr. Licea:

Per your request, Prunuske Chatham, Inc. (PCI) has prepared this proposal for additional work required to complete Phases A1, A2, and Phase B construction documents for the public access improvements at the Fitch Mountain Park and Open Space Preserve (Preserve) in preparation for a public bidding process and implementation starting in summer/fall 2022.

Project Description
This scope is for the completion of construction drawings and technical specifications for public bidding of Phase A1, Phase A2, and Phase B. Completion of the Phase B design will be based on recent feedback from the City and the dog park committee. Work in this proposal also includes modifying Phase A construction documents: splitting the project into Phase A1 and Phase A2.

Completion of the Phase A1 plans, including work in the riparian area covered by the CDFW Lake and Streambed Alteration Agreement, is required to expedite bidding and construction within the construction window described in the permit. Phase A2, including all other aspects of the public access project, is intended to be bid and constructed concurrently with Phase B. Additionally, because Phase A was designed as a stand-alone project that could be built separately from Phase B, some minor modifications to the interface between Phase A and Phase B will be required; for example, the temporary restroom shown in Phase A plans is not necessary because the permanent restroom shown in Phase B will be constructed instead. Bidding-support services and construction oversight will be offered in a subsequent phase.

Project Components
 Phase A1 Construction Documents
o Center abutment design (by PCI) and detail by Structural Engineer  Phase A2 Construction Documents
 Phase B Construction Documents, including:
o Finalize dog park design
o Finalize butterfly garden area design
o Cost estimates for shade structures and restroom
 Phase A/B interface revisions.

CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Revision of the City’s Master Fee Schedule to include Senate Bill 9 implementation
PREPARED BY: Ellen McDowell, Senior Planner
STRATEGIC INITIATIVE(S):

Provide Effective Governance
RECOMMENDED ACTION(S):

Adopt a Resolution approving the addition of two fees to the City of Healdsburg Master Fee Schedule, to include a new SB9 Tentative Map fee and a new SB9 Final Parcel Map fee as a result of the implementation of Senate Bill 9 (SB9).

COMMUNITY ENGAGEMENT/OUTREACH:

Not Applicable.

BACKGROUND:

On September 16, 2021, Senate Bill 9 (SB9) was approved by the Governor of the State of California and filed with the Secretary of State, amending Section 66452.6 of the California Government Code and adding to the Government Code Sections 65852.21 and 66411.7, allowing additional housing units on properties within single-family zones and providing for parcel map approval of an Urban Lot Split.

On January 1, 2022, Senate Bill 9 went into effect. SB9 requires the City to ministerially (byright) review the application for a parcel map that subdivides an existing parcel in single-family zoning districts.

Staff recommends amendments to the City of Healdsburg Master Fee Schedule beginning with the 2022/2023 fiscal year to establish processing fees for ministerial SB9 project applications.

City staff recommends the following Planning and Public Works fee schedule changes:

A. Under the Public Works & Engineering Fee category, add a subcategory to the “Parcel/Final/Annexation Maps” to incorporate a $7,647.94 SB9 Final Map fee

6.I
Packet Pg. 58
B. Under the Planning Fees category add a subcategory to the “Subdivision per State Subdivision Map Act”, to incorporate a $3,775.07 SB9 Tentative Map fee DISCUSSION/ANALYSIS:

Under State law, fees charged for applications must not exceed the estimated reasonable cost of providing the service for which the fee is charged. The existing fees involve Planning Commission and City Council meetings, and therefore staff recommends new reduced fees to follow State guidance for ministerial action. Staff’s analysis determines that the proposed fees are reasonable in light of the expected City costs needed to process SB9 applications, such as staff time and consultant time. The fees are comparable to existing fees for permits of similar complexity and based on the time required to evaluate and process the applications.

The revision of these two fees will allow the City to recover the cost of the services provided for SB9 related applications. Estimated Public Works Staff time to complete review for an SB9 Final Parcel Map is approximately 37 hours at a rate of $125.62 per hour and includes an additional $3,000 for use of the City’s contract land surveyor which totals $7,647.94. Since the approvals cannot require discretionary review and will no longer require City Council meetings and associated staff reports, staff is recommending new fees be added to reflect the reduction in staff time needed to complete the projects.

Estimated Planning Staff time to complete an SB9 Tentative Map is approximately 20 hours at $186.22 per hour. Since the approvals cannot require discretionary review, they will no longer require Planning Commission or City Council meetings and associated staff reports and presentations. Staff is recommending new fees be added to reflect the reduction in staff time needed to complete the projects.

ENVIRONMENTAL STEWARDSHIP:

Fee reductions to incentivize SB9 lot splits are hoped to encourage the subdivision of properties within the City of Healdsburg. Lot splits that meet SB9 requirements would incentivize smaller units allowing Healdsburg workers a potential housing opportunity closer to work. Proximity of home and employment could reduce vehicle trips which in turn reduce greenhouse gas emissions.

ALTERNATIVES:

The City Council may reject the proposed action and provide direction to staff.

FISCAL IMPACT:

The analysis provided indicates that less staff time is needed to process the applications, and the fees collected will support associated staff and consultant costs. The recommended action will continue to align fees with staff and consultant costs, and therefore no impact to the general fund is expected.

ENVIRONMENTAL ANALYSIS:

The proposed amendments to the City’s Master Fee Schedule are statutorily exempt from CEQA Section 15273(a) which exempts the establishment, modification, structuring, restructuring or approval of rates, tolls, fares and other charges by public agencies.

WHEREAS, on January 1, 2022, Senate Bill 9 went into effect and requires jurisdictions to ministerially review applications for a parcel map that subdivides an existing parcel in singlefamily zoning districts; and WHEREAS, ministerial review incurs less staff time for review; and WHEREAS, these changes necessitate revisions to planning and public works fees to include Senate Bill 9 lot split applications, where applicable, and to ensure they are charged proportionately in relation to the amount of staff time; and WHEREAS, the City Council has considered the staff report, and any public comment and correspondence received regarding this matter; and

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HEALDSBURG DOES HEREBY RESOLVE AS FOLLOWS:

CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Adoption of Resolution Authorizing Remote Meetings PREPARED BY: Raina Allan, City Clerk
STRATEGIC INITIATIVE(S):

Provide Effective Governance
Maintain and Enhance Public Health and Safety
RECOMMENDED ACTION(S):

Adopt a Resolution authorizing remote meetings of the City Council and other legislative bodies.

COMMUNITY ENGAGEMENT/OUTREACH:

The City has made and continues to engage in extensive outreach to the community regarding the City’s response to COVID-19, including updates at public meetings.

BACKGROUND:

On or about March 4, 2020, as part of the State of California’s response to address the global COVID-19 outbreak, Governor Gavin Newsom declared a State of Emergency to make additional resources available, formalize emergency actions already underway across multiple state agencies and departments, and help the state prepare for broader spread of COVID-19 following one official COVID-19 death.

When the COVID-19 pandemic started, local agency boards struggled to conduct their meetings in compliance with the Brown Act’s public accessibility requirements while still abiding by stayat-home orders. As a result, Governor Newsom signed Orders N-25-20, N-29-20, and N-35-20 to grant local agencies the flexibility to meet remotely during the COVID-19 pandemic. These orders expired on September 30, 2021.

DISCUSSION/ANALYSIS:

On September 16, 2021, Governor Newsom signed into law AB 361 – Brown Act: Remote Meetings During Emergencies. AB 361, codified at Government Code Section 54953(e)(1)(B), amended the Brown Act to allow public agencies to allow local legislative bodies to continue meeting by teleconference during a gubernatorial proclaimed state of emergency if the local

6.J
Packet Pg. 64
legislative body determines, by majority vote, that as a result of the emergency, meeting entirely in person without restrictions would present imminent risks to the health or safety of attendees.

By adopting the proposed resolution, the Council would, on behalf of the City Council and all other legislative bodies formed by the Council, make the findings required by AB 361 to meet remotely. Because the Council is required to make these findings every thirty days, staff will place a version of this resolution on the consent calendar at all subsequent meetings, until the Council decides that meeting fully in person will no longer pose an imminent risk to the health or safety of attendees.

The resolution was amended at the February 22, 2022, City Council meeting and further amended at the March 21, 2022 City Council meeting, to amend public meeting protocol in response to the latest COVID-19 conditions, as directed by the City Council.

ENVIRONMENTAL STEWARDSHIP:

This section is not applicable.

ALTERNATIVES:

Because the Governor’s Order authorizing online meetings has expired, if the Council does not adopt the proposed resolution, the Council should immediately return to in-person meetings.

FISCAL IMPACT:

There is not a fiscal impact as a direct result of this action.

ENVIRONMENTAL ANALYSIS:

Pursuant to Title 14, the California Code of Regulations, Section 15378(b)(5) of the California Environmental Quality Act (“CEQA”) guidelines, the proposed action is an administrative activity of the City that will not result in direct or indirect physical changes to the environment.

The Legislative Bodies are hereby authorized to conduct meetings in a “hybrid” format, whereby members of the Body and members of the public may elect to be present in person, utilizing appropriate safety procedures, or participate by teleconferencing technology. Such meetings of the Legislative Bodies that occur using teleconferencing technology will provide an opportunity for any and all members of the public who wish to address Legislative Bodies to do so, and will otherwise occur in a manner that protects the statutory and constitutional rights of members of the public attending the meeting via teleconferencing. In-person meetings will be held consistent with the protocols described in Exhibit A to this Resolution.

1. Social Distancing and Occupancy Limits: The occupancy limit in the Council Chamber will be reduced by at least 50%.
a. Due to limited capacity, participants who indicate they are only interested in a specific item may be asked to wait outside the Council Chamber until their item is called on the agenda.
b. City staff will monitor occupancy within the Council Chamber to ensure proper social distancing is maintained. CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Amendment to Professional Services Agreement with Bureau Veritas PREPARED BY: David Willoughby, Building Official
STRATEGIC INITIATIVE(S):

Provide Effective Governance
Maintain and Enhance Public Health and Safety
RECOMMENDED ACTION(S):

Adopt a Resolution approving a Professional Services Agreement Amendment with Bureau Veritas extending the term to December 31, 2023; adding inspection services to the agreement; increasing the not-to-exceed amount by $70,000 totaling $120,000; and authorizing the City Manager to execute the Amendment on behalf of the City.

COMMUNITY ENGAGEMENT/OUTREACH:

Not Applicable.

BACKGROUND:

The City engaged the services of Bureau Veritas in a Professional Services Agreement (PSA), effective November 24, 2020, with a total beginning contract amount of $50,000 to provide Plan Review services for the building department. The original PSA was amended on January 1, 2022 to extend the expiration date from December 31, 2021 to December 31, 2022. Now the $50,000 not to exceed limit has been met and additional funds are needed to continue services.

The fees used to pay the consultant for Plan Review are obtained directly from the applicant when a building permit application is submitted to the city. Bureau Veritas charges the city 70% of the collected Plan Review Fees or an hourly fee based on the attached rate sheet depending on the project. Fees used to pay the consultant for Building Inspection services are obtained directly from the applicant when a building permit is issued. Bureau Veritas charges the city an hourly fee based on the attached rate sheet.

The city uses consultants for plan review and building inspections to supplement the department plan review and inspection services as needed.

6.K
Packet Pg. 70
DISCUSSION/ANALYSIS:

The scope of work for the original and amended Bureau Veritas PSA included only Plan Review.

Staff would like to expand the scope of services to include Building Inspection, giving the city additional breadth to cover inspections when city inspectors have time off and additional help is needed. All Plan Review and Building Inspection 3rd party consultants are extremely busy and do not always have the capacity to provide services on short notice, therefore having numerous consultants is expedient. Bureau Veritas has provided a new proposal for continued services through 2023.

ENVIRONMENTAL STEWARDSHIP:

N/A
ALTERNATIVES:

Council could choose not to approve the proposed amendment and provide further direction to staff on how to proceed.

FISCAL IMPACT:

The adopted FY 2022-2023 Biennial Budget included sufficient appropriations for the expanded plan review and inspection services in the Building Department. Contract expenses incurred are offset by permit revenues received.

ENVIRONMENTAL ANALYSIS:

Pursuant to California Environmental Quality Act and Title 14, the California Code of Regulations (“CEQA Guidelines”), Section 15378(b) (2), continued administrative actions do not qualify as a “Project”. Therefore, no further CEQA or environmental review is required.

INSPECTION SCOPE OF WORK

BUILDING DEPARTMENT INSPECTION
At Bureau Veritas, we are client-focused and customize
the work according to your specific needs. We can provide inspection services for a single project that presents unique complexities due to its construction or size, or we can provide enough staff to handle all inspection services for an entire jurisdiction. Our building inspection services can be adjusted to provide a high level of coordination specifically suited to the design-build concept. Our inspectors are ICC certified and have extensive experience in the construction trades. Fast-tracked projects may be built into small phases based on incremental design and fabrication steps. In
such cases, our inspection team keeps daily logs to track corrections and plan review changes.

BV’s inspection teams also provide on-call building
inspection services to cover staff vacation time, peak
workloads, specialized inspection activities, and any other situations that may arise. These activities may include nextday inspections and same-day response to important
or urgent requests.

Typical building inspection tasks include:
• Read and study project specifications, plans, and
drawings to become familiar with project prior to
inspection, ensuring that structural or architectural
changes have been stamped as approved by appropriate
authority and recognizing the need for/requiring of plan checks for electrical, plumbing, and mechanical code
requirements.
• Perform and document inspections on construction
projects to determine that all aspects of the project,
such as foundations, building, electrical, plumbing, and mechanical systems, conform to the applicable building
codes, zoning ordinances, energy conservation, and
accessibility requirements, including known local, city, state, and federal requirements.
• Review plans for building construction, plumbing,
electrical, and mechanical details prior to making
inspection.
• Bring to the attention of the jurisdiction for approval of certain changes in building, plumbing, mechanical
electrical, and related work consistent with code and
ordinance requirements.
• Participate in reviews with fire, health, and other
government agency inspectors, as well as owners.
• Maintain a record of non-complying items and follow up to resolution of such items.
• Inspect existing buildings for substandard, unsafe
conditions, upon request.

The Building Inspection Scope to Include:

A. Provide inspection services based on the approved
plans and documents to ensure all new construction is in conformance and compliance with the California Building Code (CBC) and all other volumes within Title 24 California Code of Regulations and all other State and local laws.

B. Prepare weekly and monthly summary reports of progress at the construction site based upon direct observation and reports by subordinate inspector and prepare these reports for review by the Healdsburg Building Department.

C. Review and appropriately respond to all special inspection reports and subsequently electronically file the reports into a user friendly electronic document management system.

D. Maintain an effective working relationship with
Contractor(s), the Design Professionals, the Construction Manager and the City Building Department as to safeguard the interests of the Owner and City.

E. Be tactful, firm and fair in insistence to adherence of the intent of the approved plans and documents.

F. Review and inspect work and materials in a timely manner so as to avoid as much as possible, disruption to the
schedule or work already in place.

G. Provide quality control of work, materials and equipment, and reject work that is substandard and/or which does
not meet the intent of governing codes, laws, rules and/or regulations.

PROJECT APPROACH
Architectural Review
BV blends the knowledge of local conditions with a large pool of California licensed or certified building safety experts equipped to handle all building department needs.

We are able to tailor our solutions specific to the City of Healdsburg as a result of having provided plan review,
inspection services, specialty reviews, and municipal
administrative support for over 35 years.

Structural Review

review and inspection. We have plan review and inspection personnel who have specialized experience with multi-family residential, hotels, resorts, retail, commercial, industrial, and high-tech facilities, among other industries. We have several experienced structural engineers on staff who are immediately available to tackle the City of Healdsburg’s most complex projects. We can provide a complete structural

Our vast experience includes written comments and verbal communication with applicants to better understand requirements and provide direction for compliance, as well as close communication with fire departments to clarify policies, code interpretations, plan review status, and procedures.

Green Building Review
We have plan review engineers, plans examiners, and
inspectors who are well versed and experienced with energy code compliance. Our staff has been involved at various levels of energy code development in California and is
certified to review and inspect for energy codes. Our staff has reviewed plans and completed inspections for projects that incorporate new technology and projects with complex energy code compliance. We have staff available to the City of Healdsburg who are CALGreen Certified.

PROJECT METHODOLOGY
Our proposed team familiarizes themselves with the
requirements of a public agency before beginning a
review. BV has extensive public sector experience, which assures that the public’s interests are fully protected. We believe that technical competence, while expected, is not enough. Experience and careful, thorough consideration
of issues and impacts are needed in addition to the purely technical considerations. We have devoted a great deal
of time and effort over the years to refining our approach and developing documentation to assist our clients and
train our staff in understanding plan review procedures.

BV works to ensure that submittals are properly
coordinated and tracked by following an established
internal plan check coordination process in which
each plan received for review is entered into our Deltek database, processed, and returned on time to the client.

Our plan tracking procedures are designed to track each submittal throughout the review process and maintain
accurate and comprehensive records for each submittal.

To accomplish this, we:
• Screen and log each application to assure that it is
routed to all plan reviewers in a timely manner.
• Review submittals for compliance with all relevant
state and City of Healdsburg requirements.
- The log serves as a tracking device to assure
review turnaround times and completeness.
• Complete plan reviews in accordance with local,
state, and federal regulations with which local
jurisdictions are mandated to enforce, as well as all
codes and ordinances in effect by adoption at the
time of plan review.
- Preliminary consultations will be provided to
the applicant upon request to assist and guide in the
design and plans preparation process.
• Verify information shown on each permit application.
- Construction valuation is based on information
provided by the City of Healdsburg and compared to
estimates provided by the applicant.
• Provide a thorough architectural and structural review of design drawings and details for compliance with the
California Building Code architectural provisions, including provisions for safety glazing, building security, and noise insulation performance standards.
• Provide plan review management.
• Assure that corrections are handled as quickly and as clearly as possible.
- Our goal is to help the applicant through the plan
review process. All corrections are identified based on compliance with specified codes and regulations.

Generally, corrections are identified in two ways. Notes are made on plans during electronic review or on hard copy plans if appropriate, and a correction sheet is generated that details what items need to be addressed before plans can be approved.

The City of Healdsburg shall approve the development of any customized correction sheets. Correction sheets for specific projects shall be forwarded to the City of Healdsburg along with a cover memo containing at least the following:
• The date(s) our firm received and reviewed the plans
• The date(s) the applicant was notified of completed plan reviews
• The name and telephone number of the applicant
During the plan review process, BV is prepared to meet with the applicant or architect/engineer, City of Healdsburg employees, or consultants at any time. Telephone discussions or meetings at project sites are welcomed to assure that any plan review issues are handled efficiently. We propose to meet at the offices of the building and safety division or at a particular project site.

Our goal is to issue approved plans as quickly as possible, in full compliance with laws, codes, ordinances, and regulations.

Upon completion of the plan review, the following information package is prepared and logged as a minimum:
• Completed plan review documents, which include sign offs • Transmittal letter documenting any conditions associated with issuance of a permit, if any
• Marked-up plan review documents
• Two sets of approved building plans

Healdsburg.

Upon completion of each plan review, we will forward a

resubmitted, the previous procedure will be followed,
or the applicant may schedule an office visit to go over any corrections in person. When plans are completed,

CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Automated License Plate Reader Program
PREPARED BY: Matt Jenkins, Police Chief
STRATEGIC INITIATIVE(S):

Provide Effective Governance
Maintain and Enhance Public Health and Safety
RECOMMENDED ACTION(S):

By motion, provide staff direction on an Automated License Plate Reader program.

COMMUNITY ENGAGEMENT/OUTREACH:

The City held a community meeting on automated license plate reader (ALPR) technology on July 18, 2022; the meeting was in both English and Spanish. The City announced the meeting on both Facebook and through the City Manager’s Friday Update. The Facebook post announcing the meeting reached 7,395 people and had 555 engagements. Three members of the community attended the meeting, and one member continued to engage with Police Department staff regarding the draft policy. Feedback provided is incorporated below.

BACKGROUND:

At the February 21, 2022, City Council requested that ALPR technology be agendized for additional information and discussion. This informational presentation occurred during the May 2, 2022 City Council meeting.

During the meeting, staff presented City Council with various options to consider when implementing an ALPR system. These options included mobile and/or fixed ALPR cameras and a perimeter or a perimeter and major intersection deployment of fixed ALPR cameras. Staff recommended utilizing a perimeter deployment, and under this strategy, a total of 5 locations would be required. Generalized locations of the cameras would be as follows and as shown on the attached map (Attachment 1):

1. Healdsburg Avenue and Old Redwood Highway (south City limits)

2. Healdsburg Avenue at Exchange Avenue

3. Westside Road at US 101

8.A
Packet Pg. 90

4. Dry Creek Road at US 101

5. Healdsburg Avenue at Passalacqua Road (north City limits) After the presentation and discussion, City Council directed staff to look more closely at a fixed ALPR system with a perimeter deployment. City Council also requested staff return to Council after conducting a community meeting to gather additional feedback from the public.

As previously mentioned, the Police Department hosted a community meeting on July 18, 2022 to discuss ALPR technology, its intended uses in Healdsburg, and to review the draft policy.

DISCUSSION/ANALYSIS:

During the previous discussion on ALPR technology, staff advised City Council that if direction was provided to move forward with an ALPR program beyond the current use for parking enforcement, changes to the Healdsburg Police Department policy would be necessary. Police Department staff has worked to incorporate best practices and feedback from the community in the refinement of the department’s ALPR policy.

Community Meeting Feedback
As mentioned, the Police Department hosted a community meeting which was attended by three community members. During the meeting, staff provided an overview of ALPR technology and reviewed the draft ALPR policy changes. Two community members expressed concern about privacy and safeguards for the misuse of the ALPR system. These items will be discussed in detail later in this report.

Draft Policy Manual updates:

A redline draft of the policy is attached as Attachment 2. A highlight of the changes and additions include the following:

ALPR DATA RECORD RETENTION
Staff has surveyed other agencies utilizing ALPR technology, and the retention period ranges from 30 days to 2-years. The current record retention policy for the City states that ALPR records be retained for one year, and the current policy coincides with this requirement.

City Council could direct staff to return with an item updating the record retention policy if the preference is to retain the data for a shorter or longer period. Staff would not recommend retaining records for any less than 30-days as the investigative value of the information becomes diminished. During complex investigations information related to suspect vehicle(s) may not be readily known and it could take days, weeks, or months to develop actionable information to search the ALPR system. Additionally, crimes may be late reported, especially if a victim is out of town when the crime occurred.

Additionally, if City Council were to request staff bring the record retention policy back to amend the retention period for ALPR data, staff would request that two record retention periods be set – one for fixed mounted ALPR cameras and one for the parking enforcement ALPR system. It is critical to maintain parking enforcement ALPR image

8.A
Packet Pg. 91
captures for one year to properly adjudicate parking enforcement citations.

PRIVACY
ALPR data would be owned by the Healdsburg Police Department and stored by the ALPR vendor. The policy further clarifies that the information that is gathered or collected will not be sold, accessed, or used for any purpose other than for a legitimate law enforcement or public safety purpose.

The release of ALPR data may only be shared with other law enforcement or prosecutorial agencies for official purposes and as otherwise provided by law. Release under the policy would require a written request from an authorized agency, which would then be reviewed by the Police Lieutenant or Chief of Police. ALRP data would not be released to the federal government for the purposes of federal immigration enforcement.

MISUSE
Additional language has been added to the policy to further emphasize the necessity of confirming license plates hits from the ALPR system. Under the policy, officers would be required to run a hit through the California Law Enforcement Telecommunications System (CLETS) to ensure that the vehicle is still listed as stolen or an otherwise wanted vehicle.

The policy also requires proper logging in and out of the system by user, ensuring accurate auditing of the system.

Language has been added to the policy to further define permitted and impermissible uses of the ALPR system, including defining what constitutes the invasion of privacy, use of the system to harass or intimidate, use of the system based on protected characteristics, use for personal reasons, and uses that would infringe on First Amendment Rights.

Violating the ALPR policy could subject an employee to criminal prosecution, civil liability, and/or internal discipline.

The draft policy required regular system audits, and after receiving feedback during outreach efforts, this language was further clarified to state that system audits would be conducted no less than annually, a frequency that is consistent with other audit requirements.

If City Council provides direction to move forward with the program, the draft policy changes will be incorporated into the Police Department Policy Manual. Direction to adjust the record retention schedule would require that item be brought back before City Council at a future meeting.

Staff is requesting direction from City Council by motion on:

1. Whether to proceed with a fixed ALPR program

2. If there is direction to proceed, whether to amend the City’s record retention schedule related to ALPR retention for data collected by a fixed ALPR camera.

ALTERNATIVES:

No alternatives are proposed.

FISCAL IMPACT:

At the request of City Council during the May 2, 2022 City Council meeting, funding for an ALPR system was incorporated into the FY 2022-2023 budget.

ENVIRONMENTAL ANALYSIS:

Pursuant to Title 14, the California Code of Regulations, Section 15378(b)(5) of the California Environmental Quality Act (“CEQA”) guidelines, receiving this report is an administrative activity of the City that will not result in direct or indirect physical changes to the environment.

465.1 PURPOSE AND SCOPE
The purpose of this policy is to provide guidance for the capture, storage and use of digital data obtained through the use of Automated License Plate Reader (ALPR) technology. 465.1.1 DEFINITIONS
Definitions related to this policy include:

Automated License Plate Reader (ALPR): A device that uses cameras and computer technology to compare digital images to lists of known information of interest.

ALPR Operator: Trained Department members who may utilize ALPR system/equipment. ALPR operators may be assigned to any position within the Department, and the ALPR Administrator may order the deployment of the ALPR systems for use in various efforts ALPR Administrator: The Operations Division Commander or the Chief's designee, serves as the ALPR Administrator for the Department.

Hot List: A list of license plates associated with vehicles of interest compiled from one or more databases including, but not limited to, NCIC, CA DMV, Local BOLO's, etc.

Vehicles of Interest: Including, but not limited to vehicles which are reported as stolen; display stolen license plates or tags; vehicles linked to missing and/or wanted persons and vehicles flagged by the Department of Motor Vehicle Administration or law enforcement agencies.

Detection: Data obtained by an ALPR of an image (such as a license plate) within public view that was read by the device, including potential images (such as the plate and description of vehicle on which it was displayed), and information regarding the location of the ALPR system at the time of the ALPR's read.

Hit: Alert from the ALPR system that a scanned license plate number may be in the National Crime Information Center (NCIC) or other law enforcement database for a specific reason including, but not limited to, being related to a stolen car, wanted person, missing person, domestic violation protective order or terrorist-related activity.
465.2 POLICY
The policy of the Healdsburg Police Department is to utilize ALPR technology to capture and store digital license plate data and images while recognizing the established privacy rights of the public.

All data and images gathered by the ALPR are for the official use of this department. Because such data may contain confidential information, it is not open to public review. 465.3 ADMINISTRATION
The ALPR technology, also known as License Plate Recognition (LPR), allows for the automated detection of license plates. It is used by the Healdsburg Police Department to convert data associated with vehicle license plates for official law enforcement purposes, including identifying

It may also be used to gather information related to active warrants, homeland security, electronic surveillance, suspect interdiction and stolen property recovery.

All installation and maintenance of ALPR equipment, as well as ALPR data retention and access, shall be managed by the Administration Division Commander. The Administration Division Commander will assign members under his/her command to administer the day-to-day operation of the ALPR equipment and data.
465.3.1 ALPR ADMINISTRATOR
The Administration Division Commander shall be responsible for developing guidelines and procedures to comply with the requirements of Civil Code § 1798.90.5 et seq. This includes, but is not limited to (Civil Code § 1798.90.51; Civil Code § 1798.90.53):
(a) A description of the job title or other designation of the members and independent contractors who are authorized to use or access the ALPR system or to collect ALPR information.
(b) Training requirements for authorized users.
(c) A description of how the ALPR system will be monitored to ensure the security of the information and compliance with applicable privacy laws. (d) Procedures for system operators to maintain records of access in compliance with Civil Code § 1798.90.52.
(e) The title and name of the current designee in overseeing the ALPR operation. (f) Working with the Custodian of Records on the retention and destruction of ALPR data. (g) Ensuring this policy and related procedures are conspicuously posted on the department’s website.
465.4 OPERATIONS
Use of an ALPR is restricted to the purposes outlined below. Department members shall not use, or allow others to use the equipment or database records for any unauthorized purpose (Civil Code § 1798.90.51; Civil Code § 1798.90.53).
(a) An ALPR shall only be used for official law enforcement business. (b) An ALPR may be used in conjunction with any routine patrol operation or criminal investigation. Reasonable suspicion or probable cause is not required before using an ALPR.
(c) While an ALPR may be used to canvass license plates around any crime scene, particular consideration should be given to using ALPR-equipped cars to canvass areas around homicides, shootings and other major incidents. Partial license plates reported during major crimes should be entered into the ALPR system in an attempt to identify suspect vehicles.
(d) No member of this department shall operate ALPR equipment or access ALPR data without first completing department-approved training.

Published with permission by Healdsburg Police Department ***DRAFT*** Automated License Plate Readers (ALPRs) - 3 (e) No ALPR operator may access department, state or federal data unless otherwise authorized to do so.
(f) If practicable, the officer should verify an ALPR response through the California Law Enforcement Telecommunications System (CLETS) before taking enforcement action that is based solely on an ALPR alert. Once an alert is received, the operator should confirm that the observed license plate from the system matches the license plate of the observed vehicle. Before any law enforcement action is taken because of an ALPR alert, the alert will be verified through a CLETS inquiry via MDC or through Dispatch.

Members will not take any police action that restricts the freedom of any individual based solely on an ALPR alert unless it has been validated. Because the ALPR alert may relate to a vehicle and may not relate to the person operating the vehicle, officers are reminded that they need to have reasonable suspicion and/or probable cause to make an enforcement stop of any vehicle. (For example, if a vehicle is entered into the system because of its association with a wanted individual, Officers should attempt to visually match the driver to the description of the wanted subject prior to making the stop or should have another legal basis for making the stop.) (g) Hot Lists. Designation of hot lists to be utilized by the ALPR system shall be made by the ALPR Administrator or his/her designee. Hot lists shall be obtained or compiled from sources as may be consistent with the purposes of the ALPR system set forth in this Policy. Hot lists utilized by the Department's LPR system may be updated by agency sources more frequently than the Department may be uploading them and thus the Department's LPR system will not have access to real time data. Occasionally, there may be errors in the LPR system's read of a license plate. Therefore, an alert alone shall not be a basis for police action (other than following the vehicle of interest). Prior to initiation of a stop of a vehicle or other intervention based on an alert, Department members shall undertake the following:

1. Verification of status on a Hot List. An officer must receive confirmation, from a Healdsburg Police Department Communications Dispatcher or other department computer device, that the license plate is still stolen, wanted, or otherwise of interest before proceeding (absent exigent circumstances).

2. Visual verification of license plate number. Officers shall visually verify that the license plate of interest matches identically with the image of the license plate number captured (read) by the LPR, including both the alphanumeric characters of the license plate, state of issue, and vehicle descriptors before proceeding.

Department members alerted to the fact that an observed motor vehicle's license plate is entered as a Hot Plate (hit) in a specific BOLO (be on the lookout) list are required to make a reasonable effort to confirm that a wanted person is actually in the vehicle and/or that a reasonable basis exists before a Department member would have a lawful basis to stop the vehicle.

3. Department members will clear all stops from hot list alerts by indicating the positive ALPR Hit, i.e., with an arrest or other enforcement action. If it is not obvious in the text of the call as to the correlation of the ALPR Hit and the arrest, then the Department member shall update with the Communications Dispatcher and original person and/or a crime analyst inputting the vehicle in the hot list (hit).

4. General Hot Lists (SVS, SFR, and SLR) will be automatically downloaded into the ALPR system a minimum of once a day with the most current data overwriting the old data.

5. All entries and updates of specific Hot Lists within the ALPR system will be documented by the requesting Department member within the appropriate general offense report. As such, specific Hot Lists shall be approved by the ALPR Administrator (or his/her designee) before initial entry within the ALPR system. The updating of such a list within the ALPR system shall thereafter be accomplished pursuant to the approval of the Department member's immediate supervisor. The hits from these data sources should be viewed as informational; created solely to bring the officers attention to specific vehicles that have been associated with criminal activity.

All Hot Plates and suspect information entered into the ALPR system will contain the following information as a minimum:
• Entering Department member's name
• Short synopsis describing the nature of the originating call • Related case number.
(h) Login/Log-Out Procedure. To ensure proper operation and facilitate oversight of the ALPR system, all users will be required to have individual credentials for access and use of the systems and/or data, which has the ability to be fully audited.

Permitted/Impermissible Uses. The ALPR system, and all data collected, is the property of the Healdsburg Police Department. Department personnel may only access and use the ALPR system for official and legitimate law enforcement purposes consistent with this Policy.

The following uses of the ALPR system are specifically prohibited:

1. Invasion of Privacy: Except when done pursuant to a court order such as a search warrant, is a violation of this Policy to utilize the ALPR to record license plates except those of vehicles that are exposed to public view (e.g., vehicles on a public road or street, or that are on private property but whose license plate(s) are visible from a public road, street, or a place to which members of the public have access, such as the parking lot of a shop or other business establishment).

2. Harassment or Intimidation: It is a violation of this Policy to use the ALPR system to harass and/or intimidate any individual or group.

3. Use Based on a Protected Characteristic. It is a violation of this policy to use the LPR system or associated scan files or hot lists solely because of a person's, or group's race, gender, religion, political affiliation, nationality, ethnicity, sexual orientation, disability, or other classification protected by law.

4. Personal Use: It is a violation of this Policy to use the ALPR system or associated scan files or hot lists for any personal purpose.

5. First Amendment Rights. It is a violation of this policy to use the LPR system or associated scan files or hot lists for the purpose or known effect of infringing upon First Amendment rights.

Anyone who engages in an impermissible use of the ALPR system or associated scan files or hot lists may be subject to
• Criminal prosecution,

CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Agreement with Sonic and Development Group, Inc. for City Dark Fiber Implementation
PREPARED BY: Adam McKenna, IT Manager
STRATEGIC INITIATIVE(S):

Maintain and Improve Infrastructure and Facilities
RECOMMENDED ACTION(S):

Adopt a Resolution approving and authorizing the City Manager to:

1. Execute a sole source service agreement, and other documents necessary, with Sonic to upgrade city internet and intranet connections, not to exceed $539,290 over five years.

2. Execute a service agreement, and other documents necessary with Development Group, Inc. for network hardware, configuration, and installation, not to exceed $102,100.51.

COMMUNITY ENGAGEMENT/OUTREACH:

Not Applicable.

BACKGROUND:

A primary component of the City’s technology backbone is the internet and intranet connectivity between city facilities. As the City increases its use of technology and investment in cloud services, it needs to maximize the bandwidth that exists from City facilities to the internet and between City facilities. The City’s current network connections do not allow staff at all sites to access needed resources effectively.

Currently, internet service is purchased with month-to-month contracts with AT&T (CalNet state purchasing contract) and Comcast. Sonic, a locally based service provider, has increased its commercial presence by investing in fiber installations within the City of Healdsburg, and can now offer the City significantly more robust, secure, and cost-effective fiber connectivity to the internet, along with dedicated dark fiber connections between City facilities for approximately the same cost as our current month to month contract. Dark fiber between our buildings means that there is no “middle man” non-City owned network hardware, or third party networks in

9.A
Packet Pg. 102
place between our equipment at either end of the connection, making connections faster, more efficient and more secure.

DISCUSSION/ANALYSIS:

For the past year, City staff have been in discussions with Sonic to better understand how they could improve internet and site-to-site network services for the City and allow the organization to take advantage of Sonic's ongoing fiber expansion in town. Sonic previously implemented a similar upgrade in the City of Petaluma and, at the City’s request, proposed a 5-year contract with the City of Healdsburg that would provide the following:
• A 5Gb/s internet connection at the Police Department and City Hall (an increase from 1Gb/s with current provider)
• Dedicated 10Gb/s dark fiber between City Hall, the Police Department, Fire Department, Corporation yard, Senior Center, Swim Center, Community Center, and Gauntlett Tower (no current connection exists)
• A new dedicated internet line to be located in Plaza Park to enable significantly improved public Wi-Fi in the plaza.
• Vastly improved internet speeds at all sites, including 100X improvement at Community Center and Corporation Yard
• Improved redundancy in the event of an outage
• Improved security from cyber threats
• Consistent, locked in pricing for the contract term

PLAZA WI-FI MODERNIZATION
The proposed agreement with Sonic includes a new internet connection at Plaza Park. This new

9.A
Packet Pg. 103
connection would result in an opportunity to replace the ineffective and inefficient public Wi-Fi the City currently offers with an updated and modern public Wi-Fi system in the Plaza. Along with this agreement, staff have explored options to install stealth Wi-Fi antennas within the Plaza. After several site visits and analysis of multiple options, staff have determined that the best location to install Wi-Fi antennas is to mount them in the cupola of the Gazebo. Staff have been working closely with the individuals and businesses involved in building the Gazebo to finalize a plan that would minimize the visual impacts to the structure. Staff further propose to include within the scope of work a paint refresh of this important structure.

Along with improved public Wi-Fi speeds, updating the Wi-Fi system in the Plaza would provide fast, reliable internet availability in Plaza Park for Park visitors and City events, opening new doors for community events, public engagement, and community interaction. Staff recommend adding the Plaza connection, and further request that Council provide direction to discontinue the existing, ineffective Wi-Fi service currently offered in Plaza Park.

Should Council agree with staff’s recommendation, staff would return at a future meeting to request Council adopt a resolution authorizing the appropriate contracts to effectuate the installation of the new stealth Wi-Fi system. The installation work would occur in conjunction with other deferred maintenance of the Plaza Gazebo.

Although the Wi-Fi modernization is limited to the Plaza at this time, it can also provide a framework for future public Wi-Fi expansions should the City Council wish to pursue them.

COST AND TIMELINE
The proposed contract includes a cost of approximately $8,500 a month along with a one-time cost of $29,290 to connect the Corporation Yard with dedicated fiber. The monthly cost is approximately $870 more a month than the City currently pays, but comes with vastly improved speed, redundancy, security and network capabilities, and new connections between City Hall, the Police Station, and the Gauntlett Tower.

In addition to the contract cost, there will be a one-time cost for network hardware to be installed in our data centers to accommodate the dark fiber implementation. The cost for this equipment will be $102,100.51 and includes the hardware, installation, and configuration services from Development Group, Inc,. This contract is available to the City through the State of California's Participating Addendum (Participating Addendum No. 3-17-70-2686N) through California Multiple Award Schedules (CMAS) Cooperative Purchasing Program Master Agreement, as permitted by Section 3.24.080.8 of the City of Healdsburg Municipal Code. Purchasing the equipment through the State's Participating Addendum meets all requirements set forth in the City of Healdsburg's Purchasing Policy and ordinance.

Installation of the new fiber connections with Sonic would take approximately 6-9 months with the goal of utilizing the new connections by early 2023. Staff would continue to use AT&T at all sites until the new connections were tested and accepted by the City. Staff recommends this upgrade because it is an opportunity to significantly improve our network communications capability at close to the same cost as our current month to month agreements. The contract with Sonic does require the City to enter into a 5-year agreement, but provides the benefit of long

9.A
Packet Pg. 104
term price security to the City during the term. Staff anticipate working with a local service provider will also improve customer service and support.

Staff recommends City Council approve a sole-source agreement with Sonic for internet and managed Dark Fiber construction, installation, and support services. Staff reviewed additional service providers for dark fiber options and found no other providers in the area. The closest service type available is what the City is currently using from ATT. As shown by the chart, for similar prices, Sonic provides significantly better speeds, functionality, availability, and services.

ENVIRONMENTAL STEWARDSHIP:

Not applicable.

ALTERNATIVES:

The City Council could choose not to authorize the City Manager to sign an agreement with Sonic and Development Group, Inc.; In this case, internet service would continue under the current contract with AT&T.

FISCAL IMPACT:

Staff is recommending the signing of this 5-year agreement for Sonic internet and dark fiber implementation, and service at $539,290 over 60 months and signing the agreement with Development Group, Inc. for network hardware, configuration, and installation, not to exceed $102,100.51. Sufficient funds are proposed in the 2022-24 Budget for internet and intranet communications. No additional impact or increase to the budget is expected.

ENVIRONMENTAL ANALYSIS:

Pursuant to Section 15378(b)(5) of the State CEQA Guidelines, the proposed action is an administrative activity of the City that will not result in direct or indirect physical changes to the environment; and is, therefore, not a project for purposes of CEQA.

(4) Any claims, liabilities or damages arising out of the use, resale, sharing or modification of the Sonic Network and/or Internet Access Service by Customer.

6.3 Notwithstanding the foregoing or any other provision to the contrary, Sonic shall not be required to provide a defense to Customer for claims arising out of Sonic’s obligations under this Agreement as defined in Sonic’s professional liability policy EXCEPT THAT this shall not affect Sonic’s obligation to reimburse reasonable attorneys’ fees and reasonable defense costs as part of Sonic’s actual indemnity obligation to Customer, if any, nor shall it affect Sonic’s duty to defend Customer if such a defense is available under any of Sonic’s other insurance policies.

6.4 Notwithstanding the foregoing, to the extent this Agreement is a "construction contract" as defined by California Civil Code § 2783, as may be amended from time to time, such duties of Sonic to indemnify shall not apply when to do so would be prohibited by California Civil Code § 2782, as may be amended from time to time.

6.5 Notwithstanding the foregoing, to the extent that the Services include design professional services subject to Cal. Civil Code § 2782.8, as amended from time to time, Sonic's duty to indemnify shall only be to the maximum extent permitted by Civil Code § 2782.8.

Concurrently with the execution of this Agreement by Sonic, and prior to the commencement of any services, Sonic shall furnish written proof of insurance (certificates and endorsements), in a form acceptable to the City. Sonic shall provide substitute written proof of insurance no later than 30 days prior to the expiration date of any insurance policy required by this Agreement.

8.0 Disclaimer of Warranties and Limitation of Liability.

CITY OF HEALDSBURG

CITY COUNCIL AGENDA STAFF REPORT
MEETING DATE: August 15, 2022
SUBJECT: Adopt the General Fund Surplus Policy
PREPARED BY: Katie Edgar, Finance Manager
STRATEGIC INITIATIVE(S):

Provide Effective Governance
RECOMMENDED ACTION(S):

Adopt a Resolution approving the General Fund Surplus Policy establishing a framework for allocating unanticipated annual surplus in the General Fund.

COMMUNITY ENGAGEMENT/OUTREACH:

Not applicable.

BACKGROUND:

The Government Finance Officers Association best practices emphasize the importance of formally adopting financial policies to provide the foundation for long-term fiscal health. In 2016 Council updated the General Fund Reserve Policy to require a minimum reserve equal to 30 percent of the annual operating expenditures to protect the City’s essential service programs. In accordance with California Government Code, Council adopts an Investment Policy annually to guide all investment activities. In 2019 the Council adopted a Pension Liability Funding Policy establishing a methodology for funding pension liabilities and completed the first biennial review in February 2022. In June of 2021 Council engaged Management Partners Inc. to develop a longterm financial forecast for the City to better understand the fiscal drivers shaping the City’s financial condition. The forecast functions as a guiding tool that allows the Council the opportunity to set the fiscal trajectory of the City by planning for long term needs.

At the May 16th council meeting staff presented the third quarter financial update and estimates to close for FY 2021-2022. Due to staff vacancies, operating savings, and higher than projected sales tax receipts the City anticipated a one-time year end surplus. Council directed staff to allocate these one-time resources to support the cities long-term needs by making additional contributions to the City’s unfunded pension obligations, designating funds for future long-term planning projects, and reducing the streets fund deficit.

9.B
Packet Pg. 121
The purpose of the General Fund Surplus Policy is to institutionalize prudent financial management by promoting long-term strategic thinking and defining categories for use of onetime funds derived from year end surplus.

DISCUSSION/ANALYSIS:

City finance staff complete an analysis of the City’s financial condition on a quarterly basis to ensure proactive financial management. Staff update council on current trends and request adjustments to revenue and expenditures based on City needs, economic conditions, and overall fiscal health.

The proposed policy, attached as Exhibit A, seeks to memorialize the process and financial priorities to guide staff in recommending additional, prudent expenditures when an unanticipated surplus exists. During the third quarter review staff provide estimates for remaining revenues and expenditures through the end of the fiscal year and prepare a projected ending fund balance. The policy defines a surplus as any anticipated fund balance exceeding $250,0000 of the required reserve. At the time of the third quarter fiscal review, staff would recommend allocating any available surplus funds based on the funding priorities outlined in the proposed policy.

Identified surplus funds will be proposed for use on non-recurring expenditures and will not increase long-term operation costs or result in an expansion of the scope of City operations. The policy presents surplus funding options that reduce City debt, result in investment returns or support long-range planning, and support the replacement of capital assets. Allocating surplus to reduce City debt or liabilities provides for potential interest savings, better bond ratings, and increases flexibility for future spending. Investing surplus funds into the Pension Trust Fund or contributing to the Long-Range Planning fund provides the opportunity for long term gains in both interest earnings and future revenue potential. Allocating money for future replacements of assets and other infrastructure alleviates one-time burdens placed on the City budget and provides more flexibility to address needs proactively.

By strategically investing our short-term surplus, we can better position the City to address long term goals.

ENVIRONMENTAL STEWARDSHIP:

Not applicable.

ALTERNATIVES:

Council could choose not to adopt the General Fund Surplus Policy. Should that be the case, staff will continue to prepare financial updates and adjust appropriations on an as needed basis allocating excess funds per council direction.

Council could also make specific changes to the proposed policy. If this direction is provided, staff would request time to update the policy and bring it back at a future meeting.

FISCAL IMPACT:

The proposed action would have no immediate impact on the adopted FY 22-24 biennial budget.

Staff will return to Council in May of 2023 to present the third quarter review of the FY 22-23

9.B
Packet Pg. 122
budget and make proposals consistent with the policy to allocate any available surplus anticipated in the General Fund. The adoption of the General Fund Surplus Policy will improve the long-term fiscal health of the City and encourage maintenance of a structurally balanced budget.

ENVIRONMENTAL ANALYSIS:

Pursuant to Title 14, the California Code of Regulations, Section 15302(c) of the California Environmental Quality Act (“CEQA”) guidelines, the proposed action is an administrative activity of the City that will not result in direct or indirect physical changes to the environment.

General Fund Surplus Policy

1. PURPOSE
The purpose of this policy is to establish a framework for allocating unanticipated annual surplus in the General Fund. This policy establishes a framework for identifying a surplus and the categories of expenditures in which staff will recommend surplus funds be allocated. The policy institutionalizes prudent financial management practices by promoting long-term strategic thinking and defining boundaries for use of one-time funds.

2. BACKGROUND
The City adopts a biennial budget with the goal of balancing the cost of providing services with the amount of revenues received. These planned expenditures and revenues can be further classified as recurring or non-recurring. Recurring expenditures are those that are included in the budget each year to maintain current service levels. Recurring revenues are those that can be reasonably expected to continue every year with some degree of predictability (property taxes, for example). A structurally balanced budget supports financial sustainability for multiple years into the future by balancing recurring revenues with recurring expenses.

The amount of money available after subtracting the total amount of expenditures made from the total amount of revenues received is the fund balance. The City has adopted a general fund reserve policy that requires maintenance of an unrestricted fund balance equal to at least 30% of the annual operating expenditures. The purpose of the reserve policy is to mitigate risks that could disrupt City services. If unforeseen economic conditions result in a reduction of expected revenues or catastrophic events require exorbitant one-time expenses the reserve is available to continue supporting essential recurring expenditures.

In addition to the budget process, the City prepares a long-term forecasting model that provides the opportunity to plan for longer term needs outside of the typical two-year budget cycle. The forecast provides a mechanism to understand the impacts of volatility on recurring revenues like Transient Occupancy Tax and Sales Taxes as well as growth trends associated with pension costs and other recurring expenditures. The forecast model is an important tool for identifying funding shortfalls and understanding the impacts of additional contributions.

3. POLICY

3.1 Definition of Surplus
For this policy, any anticipated remaining fund balance in the general fund that exceeds the reserve by $250,000 is defined as surplus. The $250,000 excess allows for reasonable variances within the estimated closing figures.

3.2 Financial Analysis and Review
A budget is a financial plan. Prudent fiscal management practices require ongoing analysis and updating of the City budget. Staff analyze the Cities financial condition and bring updates to Council for review on a quarterly basis. During these reviews staff recommend adjustments to revenues and expenditures to align budgeted expectations with current trends and reduce or

9.B.b
Packet Pg. 125 Attachment: Exhibit A: General Fund Surplus Policy (3721 : General Fund Surplus Policy) increase expenditures based on City needs and the overall fiscal health of the organization. During the third quarter budget review staff have a good understanding of the remaining revenues to be received and expenditures that will be incurred. During this review staff will provide closing estimates and determine if unanticipated revenues or budgetary savings will result in a surplus in the general fund. If a surplus is present staff will propose additional budgetary appropriations to allocate the surplus consistent with this policy.

3.3 Allocation of Surplus
Identified surplus funds will only be allocated for use on non-recurring expenditures to maintain a structurally balanced budget. Allocations of surplus funds are meant to improve the long-term fiscal health and prosperity of the City. Surplus funds will not increase long-term operational costs or expand the scope of operations. City staff will present surplus funding options consistent with the following categories.
• Actions that reduce City debt or liabilities, including but not limited to reducing fund deficits, paying off internal or external loans, early repayment of bonds, and additional contributions to the City’s unfunded pension obligations (CalPERS UAL). • Contributions that result in investment returns or expand future revenue potential, including but not limited to contributions to the Pension Trust Fund, and Long-Range Planning Fund.
• Investments to repair, replace, or expand existing capital assets including but not limited to deferred building maintenance, vehicle replacements, streets and drainage infrastructure, water and sewer infrastructure.

The ultimate responsibility for determining the allocation of surplus funds, consistent with this policy, rests with the City Council. The third quarter fiscal review will include appropriation adjustments to accommodate the approved allocations, but no expenditures will be incurred until the closing of the fiscal year. Staff will report back to council at the next quarterly financial update if for any reason approved surplus expenditures are not completed.

3.6 Review of Surplus Policy
Maintaining a structurally balanced budget that promotes sustainability of essential services requires a long-term plan. The City will review this policy at a minimum biennially, concurrent with preparation of the budget, to determine if changes to this policy are necessary to ensure resources are being allocated to priorities pertinent in the current financial landscape.

9.C.a
Packet Pg. 129 Attachment: Sonoma County Library Commission Application (3725 : Sonoma County Library Commission) Please state briefly your reasons for applying and why you feel you are qualified for appointment to this body.

Since 2018 I have served as the Sonoma County Library Commissioner appointed by the City of Healdsburg.  I  am  seeking  reappointment  to  provide  the  Library  with  continuity  of  leadership during a period when we are facing some significant challenges.

As you may know, our Director, Ann Hammond, recently retired. Ann provided strong leadership during a difficult period. But she left while the Library is facing several critical issues.

In order to sustain and expand the services that are so essential to the entire Sonoma community, the  Library  must  undertake  a  focused  effort  to  renew/extend  the  supplemental  sales  tax (Measure Y) which currently provides about a third of our total  funding. Although the current measure is in effect until 2026, there’s a strong consensus that our best opportunity will be during the 2024 general election that is only two years away.

The  Library  is  also  launching  a  capital  campaign  to  raise  the  funds  needed  to  finally  build  a permanent library for the Roseland area of Santa Rosa and to create a foundation for the major fundraising we will need to do on an ongoing basis to fulfill the vision of our recently completed Facilities Master Plan.

And, at  the same  time, we are also working hard  to address  the strategic priorities  that were outlined in the 2021 Reimagining Plan.

I believe that all of these initiatives will benefit from a continuity of strong leadership – from both Library staff and from the Commission.

For  the past  two years, I have  served as  the Chair of  the Finance Committee, assuring  strong financial oversight during a period when the Library did not have a Chief Financial Officer. I also assisted Library staff in recruiting and hiring our current CFO, Myrna Lopez. And I continue to work closely with Myrna to help her provide the capable leadership we need to assure the entire community  that  Library  resources  are  being  responsibly  utilized  to  support  our  key  strategic priorities. If  you  choose  to  reappoint me, I will  continue  to  serve as  the  Chair  of  the Finance Committee.

Current and Past Membership in Organizations & Offices Held:

I served 6 years on the Board of Directors – including 2 years as President of the Board – of JVS (formerly Jewish Vocational Services), a non‐sectarian agency located in San Francisco that helps people  overcome  barriers  to  work,  provides  them  with  relevant  training  and  job  preparation skills, and connects them with employers.

I also served 4 years on the Board of Directors of Congregation Beth Sholom in San Francisco.

Packet Pg. 130 Attachment: Sonoma County Library Commission Application (3725 : Sonoma County Library Commission) Additional Information & Comments:

Originally, I was hoping to end my term and give you an opportunity to appoint a younger person who could bring a more diverse perspective to the Commission. But despite continued and well‐ intentioned efforts by the Commission and the staff, we have not yet succeeded in developing a cadre of younger people who are seriously interested in the work of the Library and could bring fresh perspectives and meaningful experience to the role of Library Commissioner. These efforts are ongoing, and our local Branch Manager  Jon Haupt and I are continuing  to work with local organizations like Corazón Healdsburg to recruit new members  for the Library Advisory Board and the Friends of the Healdsburg Library. But we have not been as successful as we need to be.

So as much as I would like to be able to propose the names of one or more viable candidates to replace me as Commissioner, at the moment I am not able to do so.
