TITLE:
A Resolution of the City Council of the City of Hemet, California, Authorizing Each Eligible City Employee to Receive up to $5,000 in “Essential Worker” Premium Pay for a Total Cost of $1,190,000 and Authorizing the Finance Director to Establish a Suppleme ntal Appropriation in Support of this Payment
RECOMMENDED ACTION:
It is respectfully recommended that the City Council:
Adopt a Resolution of the City Council of the City of Hemet, California, authorizing each eligible City employee to receive up to $5,000 in “Essential Worker” Premium Pay for a total cost of $1,190,000 and authorizing the Finance Director to establish a supplemental appropriation in support of this payment.
BACKGROUND:
On March 11, 2021, the American Rescue Plan Act was signed into law and established the Coronavirus State Local Recovery Fund and Coronavirus Local Fiscal Recovery Funds (“SLFRF”) program. This program is designed to deliver $350 billion to support State, territorial, local, and Tribal governments in responding to the economic and public health impacts of COVID-19 and in their efforts to contain impacts to their communities, residents, and businesses.
The City of Hemet was allocated $21,674,344 in ARPA funds and has received the first half of these funds with the second payment due by May 2022.
In addition to using the funds to respond to the economic and public health impacts of COVID-19, funds may be used to provide premium pay to eligible City of Hemet employees who performed essential work during the public health emergency.
Subsection (c) of Section 803 concerns the requirements regarding the use of funds by qualified cities and counties and provides for four permissible uses of such funds, including:
To respond to workers performing essential work during the COVID –19 public health emergency by providing premium pay to eligible workers of the metropolitan city, non -entitlement unit of local
6.A
government, or county that are performing such essential work, or by providing grants to eligible employers that have eligible workers who perform essential work;
(Sec. 803(c)(1)(B), emphasis added.)
Since the purpose of such premium pay is “to respond to workers performing essential work during the COVID-19 public health emergency,” the ARPA limits eligibility for the receipt of such p remium pay to employees who actually performed essential work during the public health emergency.
Subsection (g) defines “eligible workers” to mean “those workers needed to maintain continuity of operations of essential critical infrastructure sectors an d additional sectors as each chief executive officer of a metropolitan city, non -entitlement unit of local government, or county may designate as critical to protect the health and well -being of the residents of their metropolitan city, non -entitlement unit of local government, or county.”
The Interim Final Rule requires that jurisdictions justify the provision of premium pay to high -income employees:
If premium pay would increase a worker’s total pay above 150 percent of their residing state’s average annual wage for all occupations, as defined by the Bureau of Labor Statistics’ Occupational Employment and Wage Statistics, or their residing county’s average annual wage, as defined by the Bureau of Labor Statistics’ Occupational Employment and Wage Statistics, whichever is higher, on an annual basis, the State, local, or Tribal government must provide Treasury and make publicly available, whether for themselves or on behalf of a grantee, a written justification of how the premium pay or grant is responsive to workers performing essential worker during the public health emergency.
It has been determined that 50 City employees currently eligible for this premium pay have an annual wage above 150% of the state average. This includes all Department Heads, se veral Division Managers and most Management Positions within the City’s Public Safety Departments. Management is an essential component of City functions and ensures employees are working within the City’s Municipal Code to deliver services to the residents of the Community and ensure the Health and Safety of employees, residents, and visitors within City limits. All employees within this category have been deemed eligible since they also performed essential work during the public health emergency.
ANALYSIS:
It is the Council’s desire to provide each employee who performed essential duties through the Covid- 19 Pandemic to receive a payment of $5,000 per employee if the employee worked at least 1,000 hours during the one -year period between March 16, 2020, and March 15, 2021. Employees who worked less than 1,000 hours during this period are entitled to a payment of up to $2,500.
Payments will be issued by the second full pay period after Council approval.
For employees who telecommuted during this period, pay ment will be made from non -ARPA funds including the General Fund. A total of 36 employees telecommuted during the above-mentioned time period while 208 employees reported for duty at their designated worksite (City Hall, Police Station, Fire Stations, Library, Covell Building, Corporation Yard).
STRATEGIC PLAN INTEGRATION:
