City of Hemet
City Council Meeting

STAFF REPORT

Meeting: City Council Meeting - May 10 2022
Department: Public Works
Submitted by: Christopher Lopez, City Manager
Steve Loriso, City Engineer;

☐ Receive and File ☒ Consent Calendar ☐ Business Item ☐ Public Hearing

TITLE:

A Resolution of the City Council of the City of Hemet, California, Authorizing the City Manager to Execute an Assignment and Assumption Agreement with Contech Engineered Solutions, LLC and Leonida Builders, Inc. and Take Other Related Actions

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Adopt a Resolution of the City Council of the City of Hemet, California, Authorizing the City Manager to Execute an Assignment and Assumption Agreement with Contech Engineered Solutions, LLC and Leonida Builders, Inc. and Take Other Related Actions.

BACKGROUND:

In October 2019, the City Council awarded a construction agreement to Leonida Builders, Inc. for the construction of the State Street crossing of Cactus Valley Wash, related to McSw eeny Farms development (McSweeny Phase III). The project was to construct a bridge over the Cactus Valley wash along State Street to reduce flooding possibilities within the McSweeny Farms area. Another bridge crossing Cactus Valley wash (on McSweeny Par kway) was separately awarded to Leonida Builders Inc. (McSweeny Phase II) and is nearing completion.

ANALYSIS:

As a result of disruption to both labor and supply markets since the McSweeny Phase III Project was initially bid and awarded, the City Engineer and representatives for Leonida Builders, Inc. have been in discussions regarding the feasibility of continuing with the awarded contract. After significant discussions, including exploring the possibility of addressing the issues through a change order , the mutual recommendation of Leonida Builders Inc. and City staff is to terminate the McSweeny Phase III agreement with Leonida Builder's Inc. and rebid the public project.

Page 1 of 15 ends

15.G

Page 399 of 480 ends

As part of Leonida Builder's Inc. preparation for performance under the existing agreement with the City, Leonida Builder's Inc. had entered into a purchase agreement with Contech Engineered Solutions for the purchase of concrete arch culvert structures. S taff recommends the City assume that contract, and utilize the purchased supplies in the performance under the rebid agreement. The price of these items is rapidly rising due to supply chain disruption and inflation. By locking in the price now, the City can expect to realize significant savings.

The resolution would authorize the City Manager to execute the Assignment and Assumption Agreement by and between the City, Contech Engineered Solutions, and Leonida Builders Inc. as well as terminate the existing public works contract with Leonida Builders Inc.

STRATEGIC PLAN INTEGRATION:

GOAL ONE: QUALITY OF LIFE:

To ensure that Hemet is safe, clean, attractive and comfortable for all who live, work, and visit.

Objective 1: Enhance the visual appearance of the community to make it attractive and reduce blight.

GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS
To identify the work needed inside the City organization to effectively provide services to the community and ensure financial stability.

Objective 1: Operate in a financially sustainable manner.

Objective 3: Provide Council with policies that are consistent while lessening liabilities.

FISCAL IMPACT:

The Resolution approving the Assignment and Assumption Agreement would authorize th e City to expend $876,834 to purchase supplies for the McSweeny Phase III project. This expenditure will be covered by proceeds from the bond sale by the California Statewide Communities Development Authority (CSCDA) and the pre-purchase of these items will likely result in significant savings when the McSweeny Phase III project is rebid in the near future.

TITLE:

A Resolution of the City Council of the City of Hemet, California, Approving the Third Amendment for Services between the City of Hemet and CSG Consultants, Inc. for a Contract Amount not to Exceed a Total of $390,968.75 for the Entire Contract Term and the Replacement of Exhibit "B" Compensation

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Adopt a Resolution of the City Council of the City of Hemet, California, Approving the Third Amendment for Services between the City of Hemet and CSG Consultants, Inc. for a Contract Amount not to Exceed a Total of $390,968.75 for the Entire Contract Term and the Replacement of Exhibit "B" Compensation.

BACKGROUND:

The City of Hemet contracts with two companies to provide contract plan check, inspection, and permit technician services. The initial contract term began August 11, 2020, for a three -year term and a not to exceed $55,000.

On April 13, 2021, the First Amendment to the contract was approved to increase the contract amount by $45,000 for expected increases in plan check submittals for a not to exceed $100,000 contract amount.

On August 20, 2021, the Second amendment to the contract was approved to increase the contract amount by $118,968.75 for expected increase in pla n check submittals for a not to exceed a total contract amount of $218,968.75.

FY21/22
Proposed 3rd Amendment
FY21/22 $172,000.00 $390,968.75

ANALYSIS:

During the adoption of the 2021/2022 budget process, an additional budget amount of $105,000 was approved, which was reflected in the contract amendment that totaled $218,968.75. S avings from unfilled vacancies is sufficient to cover the additional expend iture of $13,968.75 required for professional services and therefore, no additional funding is required.

The Community Development Department continues to see increases in development activities and needs to provide the services necessary to maintain the level of service demanded by the development community. Additionally, the City has the need to increase contract services due to the "build to rent" format some builders are moving toward in the current housing market. This will dramatically increase the workload based on multiple phases being constructed concurrently without having a buyer in place.

With this anticipation and growth, staff is requesting an additional $172,000 for a new not -to-exceed contract amount of $390,968.75 for the entire contract term. This increase will allow the City to continue providing the services of plan review, inspections, and permit technician services and allow scalability (up or down) based on the needs of the development community volume.

The consultant Fee Schedule (Exhibit B) will remain the same as in the Second Amendment.

The Consultant has provided the City with plan checks for residential, commercial and industrial developments in the City. The continuation of contract plan check services allows the Build ing and Safety Division to respond more quickly to plan submittals and ensure that plans comply with all applicable building and safety codes.

PREVIOUS COUNCIL ACTION:

On January 25, 2022, Council approved appropriations of $172,000 in account 120-3300-2610 for Community Development's Building Program contract services.

STRATEGIC PLAN INTEGRATION:

GOAL TWO: ECONOMIC OPPORTUNITY
To ensure that Hemet is a hub, with access to quality jobs, shopping options, and a varied and sustained tax base.

Objective 2: Provide resources for new businesses to enhance the customer service experience.

The proposed action aligns with Council adopted objective: develop business practices that welcome new development by streamlining processes by incorporating plan check process that shortens the plan check time.

GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS
To identify the work needed inside the City organization to effectively provide services to the community and ensure financial stability.

The proposed action aligns with Council adopted objective: operate in a financially sustainable manner by identifying the work needed inside the City organization to effectively provide services to the community and ensure financial stability, and to operate in a financiall y sustainable manner.

Page 2 of 11 ends

15.H

Page 416 of 480 ends

FISCAL IMPACT:

There is no impact to the General Fund. Based on already collected plan check fees and the anticipated building permit and plan checks fees for the major builders, the City can collect the additional amount requested of $172,000 through plan check fees. Th e $172,000 was already appropriated and funded through mid-year budget. The cost of contract plan check services is recovered through the building plan check fees paid by contractors and developers for their specific projects. Funding will only be expended for those projects that have been submitted for plan check and where the revenue has already been received.

BACKGROUND:

The Coronavirus State and Local Fiscal Recovery Funds (SLFRF) program, a part of the American Rescue Plan, delivers $350 billion to state, local, and Tribal governments across the country to support their response to and recovery from the COVID-19 public health emergency.

Page 1 of 21 ends

15.I

Page 427 of 480 ends

• Respond to the far-reaching public health and negative economic impacts of the pandemic, by supporting the health of communities, and helping households, small businesses, impacted industries, nonprofits, and the public sector recover from economic impacts • Provide premium pay for essential workers, offering additional support to those who have and will bear the greatest health risks because of their service in critical sectors • Invest in water, sewer, and broadband infrastructure, making necessary investments to improve access to clean drinking water, support vital wastewater and stormwater infrastructure, and expand affordable access to broadband internet
The Coronavirus State and Local Fiscal Recovery Funds provide substa ntial flexibility for each jurisdiction to meet local needs to develop projects that meet its local jurisdiction's needs.

DISCUSSION:

The Apprentice program will assist the three Public Works Divisions – Streets, Water, and Parks to provide part-time employees and at the same time assist residents who have either lost their job, had hours reduced due to the pandemic, and/or are looking to learn a trade/skill through an apprenticeship program. For the City, the Apprentice program will provide a viable applicant pool and provide a division of labor for current employees to prevent burnout.

For the apprentice, the program will provide experience to learn a trade. The program will provide educational and career support such as: how to fill out a job applicat ion online, how to prepare for an interview, interview techniques, requirements and qualifications needed for specific City job classifications, and how to attain the skills needed to apply for a City position, etc. The apprentice will learn how the City government operates.

The Apprentice program is open to anyone who lost their job or had reduced hours during the COVID- 19 pandemic and open to anyone who would like to learn a skill/trade through employment.

The overarching goal is to have apprentices who complete their apprenticeship and want full -time employment with the City the opportunity to apply for a full-time position with the City of Hemet.

The purpose of the Public Works Apprentice Program is to p rovide economic opportunity to residents adversely affected by COVID -19 either through loss of employment, reduced hours, extenuating circumstances such as loss of job due to no childcare, lack of transportation, and COVID-19 illness.

Also, to assist the City of Hemet by providing the needed staff with improving quality of life and reducing blight within the City.

A minimum of 15 temporary part-time (TPT) Maintenance Aide classifications will be hired for the Public Works Apprentice Program. Each TPT Maintenance Aide will work up to 1,000 hours per year in the Public Works Department – Street, Parks, or Water Division. The apprenticeship program length is one year. The details of the Apprentice Program are included in Attachment 1.

The estimated cost of the program is $223,170.00 and will be funded by ARPA SLFRF funding as approved by Council at the March 4, 2022, special Council meeting. The cost of the program was based on the minimum hourly wage of $14/hour which has recently chang ed to $15/hour. Staff hired under this program will be paid at a new minimum wage rate.

The approval of the TPT Maintenance Aides for the Public Works Apprentice program will further the department's ability to enhance the quality of life, economic devel opment for residents seeking

Page 449 of 480 ends

• Respond to the far-reaching public health and negative economic impacts of the pandemic, by supporting the health of communities, and helping households, small businesses, impacted industries, nonprofits, and the public sector recover from economic impacts • Provide premium pay for essential workers, offering additional support to those who have and will bear the greatest health risks because of their service in critical sectors • Invest in water, sewer, and broadband infrastructure, making necessary investments to improve access to clean drinking water, to support vital wastewater and stormwater infrastructure, and to expand affordable access to broadband internet
The Coronavirus State and Local Fiscal Recovery Funds provide substantial flexibility for each jurisdiction to meet local needs to develop projects that meet its local jurisdiction's needs.

DISCUSSION:

The City of Hemet’s goal is to support and coordinate efforts and resources to contain the economic and public he alth impacts of COVID -19 to the communities, residents, and businesses using Coronavirus Local Fiscal Recovery Funds (SLFRF) program funding in the American Rescue Plan Act.

The City of Hemet Student Worker Program is created to support the American Rescue Plan Act State and Local Fiscal Recovery Fund – statutory eligible use #1: to respond to the COVID -19 public health emergency or its negative economic impacts.

The Student Worker Program is designed to provide educational and career support to students belonging to racial/ethnic minorities or who have other challenges applying for or entering employment.

Participants can learn how to fill out a job application online, techniques on how to prepare for an interview, information about the requirements and qualifications needed for specific City job classifications, how to attain the skills necessary to apply for a City position, etc.

The goal is to teach students how to work in a professional office and learn skills related to their educational or career path through working with the City of Hemet.

The purpose of the Student Worker Program is to provide economic opportunities that will provide work skills that the student can use to explore career options in municipal government. The student workers will also assist the City of Hemet of staff by providing additional assistance with the execution of services for the community. There are three program options available as described below.

Program Options:

Summer Employment Program
• Students can work during the summer a maximum of 40 hours per week to learn about a career field of interest (i.e. Accounting, Utility Billing, Engineering, Planning, etc.).

Student Worker Part-time Employment Program
• This option allows the student to work during the school year at a maximum of 20 hours per week to gain work experience in a career field of interest.

Mayor Mentee Program
• This option allows a group of high school students through an application process to shadow the Mayor and learn about municipal government.

There is a difference in the program requirements for the Mayor Mentee Program in that the students will need to apply for the program, students will need to provide recommendations for consideration, maintain a minimum 2.7 GPA, and be able to attend all scheduled meetings and events. The Mayor Mentee Program is not a paid Student Intern position.

Page 2 of 22 ends

Page 450 of 480 ends

A minimum of 10 temporary part-time (TPT) Student Intern classifications will be hired for the Student Worker Program. Each student will be selected based on the area of interest requested on their employment application and matched to a City Department that best fits the interest. The details of the program are included in Attachment 1.

The estimated cost of the program is $148,750.00 and will be funded by ARPA SLFRF as approved by Council at the March 4, 2022, special Council meeting. The cost of the program was based on the minimum wage of $14/hour ($14,878 annual) which recently changed to $15/hour ($15 ,713 annual).

Since the program was initially presented, minimum wage has increased and to offset this increase, a reduction in hours will be made to keep the program within budget. Students hired for this program will be paid at the new minimum wage rate.

The approval of the TPT Student Interns for the the ARPA Student Worker program will further the City's ability to create a possible future employment list and further organizational effectiveness by providing a list of future potential city staff cand idates from high school and college students who live in the City. The program enhances the partnership and collaboration with the Hemet Unified School District by providing an employment opportunity for the students interested in the career field of publi c service.

For tonight's action, staff is recommending Council approve the Student Worker Program, amend the Budgeted Position List to include 10 temporary part-time Student Intern positions for the duration of the program, and authorize the Finance Department to establish appropriations in the amount of $148,750 in 270-7013-1100 from ARPA SLFRF for the Student Worker Program.

PREVIOUS COUNCIL ACTION:

On March 4, 2022, the City Counc il held a special meeting to discuss ARPA projects and to allocate funding. In a vote of 4 -1, Council approved the ARPA -eligible project allocation which includes the Student Worker Program.

STRATEGIC PLAN INTEGRATION:

GOAL TWO: ECONOMIC OPPORTUNITY

The proposed action aligns with Council adopted objective:

Objective 1: Develop business practices that welcome new development by streamlinin g processes.

TITLE:

Consideration of Authorizing a Letter of Support for a Grant Funding Application for Coachella Valley - San Gorgonio Pass Rail Corridor Service Project

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Review, discuss and give di rection regarding the proposed letter of support for the Coachella Valley - San Gorgonio Pass Rail Corridor Service Project Multimodal Project Discretionary Grant Funding Application.

BACKGROUND:

The Riverside County Transportation Commission, in coordina tion with the Federal Railroad Administration and the California Department of Transportation, is working to bring passenger rail service as an alternate mode of travel across southern California, connecting desert communities and attractions within Los Angeles, Orange County, and the Inland Empire.

The proposed Coachella Valley -San Gorgonio Pass Rail Corridor extends approximately 144 miles between Los Angeles and the Coachella Valley with stops in Los Angeles, Orange, San Bernardino, and Riverside Counties.

RCTC and Caltrans are seeking federal funding for the next phase of work on this regionally transformative project.

ANALYSIS:

As part of its mission to provide a safe, efficient, cost -effective transportation system, the Federal Railroad Administration (FRA), California Department of Transportation (Caltrans) Division of Rail and Mass Transportation, and Riverside County Transpor tation Commission (RCTC) have been studying

Page 1 of 4 ends

16.B

Page 473 of 480 ends

ways to serve commuter and intercity travel needs and enhance travel opportunities within Los Angeles, Orange, Riverside, and San Bernardino Counties.

Statewide and regional transportation planning efforts und ertaken from 1991 to 2016 have recommended implementing passenger rail service to add travel capacity to what highways already provide. For this reason, FRA, Caltrans, and RCTC are studying passenger rail service options between Los Angeles Union Station ( LAUS) in Los Angeles, California, and the City of Coachella to provide more travel choices in the 144-mile-long Coachella Valley-San Gorgonio Pass Rail Corridor (Program Corridor). The Program Corridor, which connects the Los Angeles metropolitan area with the Coachella Valley through the San Gorgonio Pass, currently has no daily intercity passenger rail service. The proposed implementation of intercity passenger rail service in the Program Corridor, including the planning and construction of rail infrastru cture improvements required to establish the service, are collectively known as the Coachella Valley-San Gorgonio Pass Rail Corridor Service Program.

DISCUSSION:

The service will introduce a new option for people to travel between Los Angeles and the Co achella Valley. Stations are currently planned in Los Angeles, Fullerton, Riverside, and Palm Springs with options to connect to other transit services, such as Metro, Metrolink, Amtrak, OCTA, RTA, SunLine, and others. Proponents of the project anticipate benefits being clean air, relief of traffic congestion and expanded business and recreational opportunities.

Staff is seeking Council direction on whether the City would like to assert a position of support for the project.

STRATEGIC PLAN INTEGRATION:

GOAL FOUR: PARTNERSHIP & COLLABORATION
To pursue partnerships that will increase the opportunities available to the community, including our businesses, unemployed, and youth populations.

Objective 3: Develop programs to offer support to the community's businesses

GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS
To identify the work needed inside the City organization to effectively provide services to the community and ensure financial stability.

Objective 2: Evaluate existing practices to ensure continuity with industry best practices.

FISCAL IMPACT:

There is no fiscal impact.

Subject: Support for the Coachella Valley-San Gorgonio Pass Rail Corridor Service Project Multimodal Project Discretionary Grant Funding Application

Dear Secretary Buttigieg:

On behalf of the City of Hemet, we are pleased to support the Riverside County Transportation Commission’s (RCTC) application for the Multimodal Project Discretionary Grant funding for the Coachella Valley-San Gorgonio Pass Rail Corridor Service Tier II Project Approval and Environmental Documentation Project (Project).

If awarded, the funding would advance the Project closer to construction and daily intercity rail service between Los Angeles and the Coachella Valley would be closer to becoming a reality. With the Service Development Plan (SDP) and National Environmental Policy Act (NEPA) and California Environmental Quality Act (CEQA) Tier I environmental clearance for the service expected to be approved in 2022, the NEPA and CEQA Tier II environmental study - estimated at $60,000,000 - is the next step toward fulfilling this transformational vision in partnership with the Federal Railroad Administration.

As a joint project between RCTC and the California Department of Transportation, the Project will provide for the following:
• Preliminary engineering along the 76-mile eastern section of track to the 30% level; and • Project-level environmental clearance for up to six stations, a new third main track, and associated grade crossing and signal improvements on the eastern section of the corridor.

The Coachella Valley-San Gorgonio Pass Rail Corridor Service Project aligns with state and federal goals to reduce vehicle miles traveled, support climate action policies, and will provide vital connections for communities and disadvantaged areas across a growing region. The State of California and RCTC have a vested interest in fostering equitable investments in transportation infrastructure and transit mobility, as well as in sustainable freight and goods movement, and are committed to matching funds for this game-changing economic opportunity with environmental benefits from Los Angeles through Coachella Valley.

Consideration of Authorizing a Letter of Support for Additional Funding Allocation from the State of California for the I-15 Express Lane Extension Project

RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Review, discuss and g ive direction regarding the proposed letter of support for additional funding allocation from the State of California for the I-15 Express Lane Extension Project.

BACKGROUND:

The Riverside County Transportation Commission, in partnership with Caltrans and the Federal Highway Administration, invested $472 million to improve Interstate 15. The 15 Express Lanes Project added two express lanes to I -15 in both directions, from State Route 60 to Cajalco Road, widened 11 bridges, and added six soundwalls. The project was built within the existing median and offers multiple entrances and exit points to the express lanes.

Construction began in April 2018 and opened in April 2021. RCTC used a design -build method to expedite project delivery.

The project was designed to:

• Improve existing and future mobility along the I-15 corridor • Reduce traffic congestion
• Expand the regional express lanes network
• Create a choice for travel-time savings and travel-time reliability

RCTC used a combination of federal and local sources to fund the project. Federal sources include a Transportation Infrastructure Finance and Innovation Act loan and allocations from th e Congestion Management Air Quality program and the Surface Transportation Block Grant program. Local funding

Page 1 of 4 ends

16.C

Page 477 of 480 ends

was provided by Measure A, the voter-approved half-cent sales tax for transportation improvements in Riverside County.

DISCUSSION:

To support additional work that has been identified as necessary following the construction of the I -15 Express Lanes Project, RCTC is requesting that local municipalities submit letters of support with the recommendation of $500 million to be included in this year’s State budget to fund the I -15 Express Lanes Southern Extension Project to resolve a critical traffic choke point that is currently impacting residents, businesses and a dozen Tribes throughout southwest Riverside and San Diego counties.

Subject: Support for I-15 Express Lanes Southern Extension Funding Request

Honorable Members,
On behalf of the City of Hemet, we are respectfully requesting $500 million to be included in this year’s budget to fund the I-15 Express Lanes Southern Extension Project and resolve a critical traffic choke point impacting residents, businesses and a dozen Tribes throughout southwest Riverside and San Diego counties.

The project would extend the I-15 Express Lanes by an additional 14.5 miles, from Cajalco Road in Corona, through Temescal Valley, to State Route 74 in Lake Elsinore. Once built, the project would improve access to the biotech, hospitality and manufacturing businesses of our region and improve the quality of life for our residents from Temecula, Murrieta, Wildomar, Lake Elsinore, Hemet, San Jacinto, Perris, Canyon Lake and Menifee that travel to neighboring counties to help fuel Southern California’s economic engine.

The I-15 is not only a critical artery for commuting and goods movement, but also is an essential route for the nearly $2 billion tourism and hospitality industry in our region that hosts nearly 4 million people a year – that’s comparable to the entire state of Utah or Iowa coming to visit.

The Riverside County Transportation Commission received $29 million in state funding in 2018 for the preliminary engineering and environmental studies, and work began for this phase of work in 2019. The public scoping period was held in fall 2019. Currently, RCTC is conducting environmental and engineering studies, which includes field work within the project study area. For more details on the project, including its status, please visit Interstate 15 Express Lanes Southern Extension - RCTC.

Thank you for your consideration.
