TITLE:
Consideration of a Resolution Supporting the Riverside County Transportation Commission (RCTC) Prioritizing TV2CV (State Route 79 Realignment) Application for Federal and Local Match Funding
RECOMMENDED ACTION:
It is respectfully recommended that the City Council:
Approve Resolution Supporting Riverside County Transportation Commission (RCTC) Prioritizing TV2CV (State Route 79 Realignment) Application for Federal and Local Match Funding.
BACKGROUND:
Today, the only improved Riverside County highway corridors connecting the two sides of Riverside County from Temecula Valley (TV) north through the San Gorgonio Pass and west to Coachella Valley (CV) are Interstate 10 (I-10), Interstate 215 (I-215), and State Route 60 (SR 60). Growth in this region has c ontributed to significant traffic congestion, environmental challenges, and impacts on local communities. The proposed solution to address these challenges is the Temecula Valley to Coachella Valley (TV2CV) Project, which involves the realignment of State Route 79 to relieve major bottlenecks and improve travel efficiency in the region.
Highway Corridor Growth:
With tremendous and continued regional residential and commercial growth over the past several decades (U.S. Census data indicates Riverside Cou nty is adding 30,000 residents annually), there is a great need for the realignment and construction of the TV2CV Project. These corridors are experiencing exponential increases in traffic congestion due to growth, expanded entertainment opportunities (e.g . Temecula Wine Country, Coachella Valley sporting venues, multiple native American Casinos, Palm Springs Airport, etc.), and the arrival of scores of large-scale national logistics warehouses.
Environmental Review:
8.B
The project has a completed environmental impact report (EIR) approved in December 2016.
ANALYSIS:
TV2CV Project as a Solution:
The TV2CV Project has been a planned project for 40 years, beginning in the 1980s, to accommodate future growth. More than $ 100 million of tax dollars have been invested in the Project to date, which has been listed as a funded project through both voter -approved Riverside County Transportation Commission (RCTC) Measure A tax measures in 1988 and 2002 (renewed through 2039). TCTC also approved the 2020 Traffic Relief Plan identifying the action to accelerate TV2CV completion after it received full federal and State environmental and project approval in 2016.
The TV2CV Project will relieve the major bottlenecks of I-10/SR60 and SR60/I-215, which have become choke points for vehicular traffic, leading to delays, accidents, and increased air pollution due to idling vehicles. The completion of the TV2CV Project will improve the interconnectivity of troops, equipment, and logistics between Marine Corp Base Camp Pendleton and Marine Corp Air Ground Combat Center 29 Palms, thereby enhancing national defense capabilities.
Furthermore, the TV2CV Project will improve access to gainful employment opportunities, health care, higher education, and the judicial system for local communities. The project will create employment and economic growth opportunities in the county, including for economically disadvantaged communities such as Hemet and San Jacinto. It will also enhance the region's tou rism industry by providing efficient access to popular destinations such as the Temecula Wine Country, Coachella Valley sporting venues, multiple Native American Casinos (Pechanga, Soboba, Morongo, Agua Caliente) and Palm Springs Airport, boosting the local economy and supporting continued growth in the entertainment and tourism sectors.
DISCUSSION:
The TV2CV Project is a critical infrastructure project that will address the increasing growth on highway corridors in Riverside County, relieve major bottlenecks, improve travel efficiency, create employment opportunities, and support economic growth.
The passage of the federal Bipartisan Infrastructure Investment and Jobs Act, a once -in-a-generation investment of $3 trillion, authorizes five years of funding beginning in 2023 with a priority on National Corridor Infrastructure Improvements such as SR 7 9. The legislation will also invest $110 billion in additional funding to repair roads and bridges, and support transformational projects, to support economic competitiveness.
Securing funding through the Infrastructure Investment and Jobs Act will adva nce the TV2CV Project to construction and avoid further delays, the wasting of already spent taxpayer dollars, and avoid further costly additional and more restrictive environmental challenges and mitigation, inflated future construction and land acquisition costs.
Therefore, it is recommended that the City of Hemet urge the RCTC to swiftly apply for the 50% federal funding required to complete the TV2CV Project. The proposed Resolution encourages this action, and supports utilization of local Measure A sales tax mon ey, federal Transportation Infrastructure Finance and Innovation Act (TIFIA) funds, Transportation Uniform Mitigation Fee (TUMF) resources, and use of
8.B
any other funds necessary to secure the locally required matching funds to advance the project to construction.
STRATEGIC PLAN INTEGRATION:
GOAL ONE: QUALITY OF LIFE:
To ensure that Hemet is safe, clean, attractive and comfortable for all who live, work, and visit.
Objective 1: Enhance the visual appearance of the community to make it attractive and re duce blight.
Objective 2: Explore and implement homelessness solutions for the City of Hemet.
Objective 3: Increase Public Safety visibility and response.
GOAL TWO: ECONOMIC OPPORTUNITY
To ensure that Hemet is a hub, with access to quality jobs, shopping options, and a varied and sustained tax base.
Objective 1: Develop business practices that welcome new development by streamlining processes.
Objective 2: Provide resources for new businesses to enhance the customer service experience.
FISCAL IMPACT:
Described in report.

TITLE:
Consideration of Allocations for 2023-24 Program Year Community Development Block Grant
RECOMMENDED ACTION:
It is respectfully recommended that the City Council:
Review and discuss the City Council Ad Hoc Committee's recommended allocations of $827,276 in Fiscal Year 2023 -24 Community Development Block Grant (CDBG) funding and unallocated funding from Fiscal Year 2019-20 in the amount of $298,844.64.
BACKGROUND:
The City of Hemet is an entitlement city of the Community Development Block Grant (CDBG) program and, as such, receives annual grants on a formula basis from the U.S. Department of Housing and Urban Development (HUD). The purpose of CDBG is to carry out a wide range of community development activities directed toward revitalizing neighborhoods, economic development, and providing improved community facilities and services, with maximum feasible priority given to activities that benefit low and moderate-income persons. The City is responsible for developing its own programs and funding priorities within CDBG and HUD requirements, as well as monitoring sub-recipients of the funds awarded under this grant.
During this year's annual CDBG funding process, the City received 21 applications requesting over $2 million in grant funds by the December 5, 2022 due date. Of these 21 applications, seven are from City operations and 13 are from non-profit agencies, and one for-profit agency. The City Administration and Planning of CDBG activities do not require an application. These applications were reviewed to ensure HUD's established criteria were met.
On January 10, 2023, the City Council Ad Hoc City Council Committee (Ad Hoc) comprised of Mayor Joe Males and Mayor Pro Team Malcolm Lilienthal reviewed applications and provided funding recommendations for full Council consideration. The Ad Hoc and staff reviewed the applications and completed funding recommendations on March 21, 2023.
8.C
The Annual Action Plan (AAP) is a short -range (one-year) planning document used to address the City’s annual needs, goals, and objectives by allocating funds to eligible activities. CDBG allocation funding for the 2023 -24 Program Year will be incorporated into the AAP draft. The AAP draft will be available for 30 days for public review and comment prior to a City Council Public Hearing, tentatively scheduled for June 13, 2023, before final approval and submission to HUD. The final AAP must be submitted to HUD no later than August 15, 2023.
ANALYSIS:
At the March 2, 2023 weekly HUD stakeholder briefing, Principal Deputy Assistant Secretary Marion McFadden stated there is $3.3 billion made available to 1,239 jurisdictions receiving funding this year.
This is $150 million less than last year with five new jurisdictions added who will receive funding in FY 2023-24. The City of Hemet's CDBG allocation for FY 2023 -24 is $827,276, a reduction of $45,681 from last year.
DISCUSSION:
The City's CDBG Ad Hoc Committee met on March 21, 2023, to discuss the FY 2023-24 CDBG funding allocations. Due to limited CDBG funding, the Ad Hoc recommended each application receive a small allocation. There is an amount of $298,844.64 from FY 2019 -20 unallocated that will be real located during Program Year 2023, and the following HUD requirements can only be allocated to Housing/Public Facilities projects.
Ad Hoc funding recommendations were made to various City department projects. One project is the Public Works Department's request for Accessible Sidewalk and Americans with Disabilities Act (ADA) Ramp project. The Public Works Department FY 2023-24 Accessible Sidewalk and ADA Ramp project proposes to install 2,538 linear feet (LF) of new sidewalk, 210 LF of new curb and gutter, and 38 new ADA-compliant ramps.
In alignment with the Strategic Plan item of 'Continue Implementing Maintenance Grid for Sidewalks', staff submitted this project to improve the City's sidewalk repair and replacement program. At least 40% of the project ($200,000) is funded with Measure A funds (Fund 222) available to cover the remaining costs of the ADA project.
Another project that received a lower allocation than requested was the Code Compliance program.
Historically, CDBG funding has contributed to the equivalent of two full-time Code Compliance officers.
The Ad Hoc Committee is recommending the allocation of CDBG funding at the same level as FY 2022- 23 in the amount of $158,711. This allocation funds 1.5 full-time Code Compliance officers.
Additionally, the CDBG -funded activity in the Housing Program is the Senior Disabled Home Repair Program offered to seniors and disabled households within the community that meet low -income criteria. A portion of this allocation provides 20% to cover admin istrative costs for personnel. The primary function of this program is to assist senior/disabled households with health and safety repairs within their home. Currently, this program has 162 homeowners on a waiting list.
The funding recommendations presented in Attachment 1 are a result of furthering the City's Strategic Plan goals using the City of Hemet's 2023 -24 Program Year CDBG Allocation of $827,276 and unallocated FY 2019-20 funding in the amount of $298,844.64.
The FY 2023-24 allocation of $827,276 is the HUD-published CDBG allocation. No further revisions will be made to the CDBG allocation.
8.C
The Council is being asked to consider the Ad Hoc Committee's funding recommendation and approve the r or recommendations funding CDBG revised a Committee provide Ad the equest Hoc recommendation based on Council feedback.
PREVIOUS COUNCIL ACTION:
On January 10, 2023, the City Council activated the Ad Hoc City Council Committee of Mayor Joe Males and Mayor Pro Tem Malcolm Lilienthal to review eligible applications and provide funding recommendations for full council consideration.
On December 13, 2022, a public hearing was held to receive comments from the public on funding priorities. No public comments were received.
STRATEGIC PLAN INTEGRATION:
GOAL ONE: QUALITY OF LIFE:
To ensure that Hemet is safe, clean, attractive and comfortable for all who live, work, and visit.
The proposed action aligns with Council Adopted Objective under Quality of Life.
Objective 1: Enhance the visual appearance of the community to make it attractive and reduce blight.
Objective 2: Explore and implement homelessness solutions for the City of Hemet.
GOAL THREE: COMMUNITY ENGAGEMENT
To connect and participate in a constant dialogue between members of the community, City staff, and elected officials to promote togetherness and positivity.
The proposed action aligns with Council Adopted Objective under Community Engagement.
Objective 3: Increase the community's pride within the City.
GOAL FOUR: PARTNERSHIP & COLLABORATION
To pursue partnerships that will increase the opportunities available to the community, including our businesses, unemployed, and youth populations.
The proposed action aligns with Council Adopted Objective under Partnership and Collaboration.
Objective 1: Develop concepts and programs to increase opportunities for youth recreation.
Objective 2: Develop concepts and programs to enhance the quality of life services.
Objective 3: Develop programs to offer support to the community's businesses

TITLE:
A Resolution of the City Council of the City of Hemet, California, Authorizing the Interim Finance Director to Correct a Previous Appropriation from the Measure 'A' Fund for the Hemet Valley Bikeway Project (CIP 5696) by Reducing the Measure 'A' Appropriat ion by $2,288,000 Such That Only the $150,000 Matching Portion of the Grant is Appropriated from the Measure 'A' Fund and Establish Appropriations in a New Fund for the Active Transportation Program (ATP) Grant in the Amount of $1,990,000
RECOMMENDED ACTION:
It is respectfully recommended that the City Council:
Adopt a Resolution of the City Council of the City of Hemet, California, Authorizing the Interim Finance Director to Correct a Previous Appropriation from the Measure 'A' Fund for the Hemet Vall ey Bikeway Project (CIP 5696) by Reducing the Measure 'A' Appropriation by $2,288,000 Such That Only the $150,000 Matching Portion of the Grant is Appropriated from the Measure 'A' Fund and Establish Appropriations in a New Fund for the Active Transportati on Program (ATP) Grant in the Amount of $1,990,000.
BACKGROUND:
The State established the Active Transportation Program (ATP) in 2013 which consolidated several existing federal and state grant programs. The purpose of the ATP is to encourage increased use of active modes of transportation, such as bicycling and walking.
In March 2018 the City was awarded federal Active Transportation Program funds through the Cycle 3 augmentation process. The project includes the installation of Class II or Class II I bicycle facilities, bicycle detection, bike repair and comfort stations, infill curb, gutter and sidewalk, ADA access ramps with curb extensions, pavement rehabilitation, and a transportation mobility station with bike lockers and staging area, all within the following streets and limits:
Chambers Street – State to Gilbert
Gilbert Street – Chambers to Whittier
8.D
Johnston Avenue – Gilbert to Palm
Whittier Avenue – Gilbert to Palm
Palm Avenue – Johnston to Esplanade
On August 15, 2022, Caltrans authorized $1,990,000 of federal ATP funding for the construction of the project.
On October 3, 2022, a request for proposals was issued for construction management and inspection services. The RFP was uploaded to PlanetBids, the City’s solicitation service provider, where interested firms could obtain the complete RFP package.
On November 2, 2022, the City Engineer approved the final construction plans and specifications. On November 3, 2022, the City solicited bids through Planet Bids, the City’s bid solicitation service provider, where interested bidders could obtain the complete bid document package.
On February 14, 2023, the City Council awarded a Construction agreement to Granite Construction and a Construction Management agreement to Willdan.
ANALYSIS:
City staff identified the lack of bicycle facilities and sidewalks as a major barrier to mobility on several City streets and submitted a grant application to CalTrans for the ATP. The City of Hemet was awarded $2,288,000 with $150,000 in local match for the Hemet Valley Bikeway Project.
The initial total award of $2,288,000 consisted of $200,000 allocated to the design, $98,000 to the required non-infrastructure (outreach) portion of the project, and $1,990,000 to co nstruction. The City was unsuccessful in finding and awarding a firm for the outreach portion of the work and will be continuing efforts for this work. The Design is complete and the remaining amount is $1,990,000 for construction.
DISCUSSION:
The original Staff Report sent to Council on December 11, 2018 recommended that Council authorize the Finance Department to record a supplemental appropriation in the Measure 'A' Fund in the amount of $2,438,000. Unfortunately, only the matching portion of the grant, $150,000, should have been appropriated to the Measure 'A' fund. Approval of the recommended resolution will correct that error, reducing the Measure 'A' appropriation by $2,288,000 and establishing appropriations in a new fund for the ATP gran t in the amount of $1,990,000, the correct amount of the ATP grant award for construction.
PREVIOUS COUNCIL ACTION:
On December 11 2018, the City Council adopted a resolution for the acceptance of $2,288,000 in federal Active Transportation Program funding for the Hemet Valley Bikeway Connect (CIP 5696) and authorized the Finance Department to record a supplemental appropriation in the Measure A Fund in the amount of $2,438,000.
On February 14, 2023, the City Council adopted a resolution awarding Granite Construction Company a Construction Agreement in the amount of $3,032,303, awarding Willdan Engineering a Construction
8.D
Management and Inspection Agreement in the amount of $211,113.60, and authorizing the Finance Director to re-appropriate $1,581,646.60 of American Rescue Plan Act (ARPA) funds from CIP 5743 to fund the total project costs.
STRATEGIC PLAN INTEGRATION:
GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS
To identify the work needed inside the City organization to effectively provide services to the community and ensure financial stability.
Objective 1: Operate in a financially sustainable manner.
FISCAL IMPACT:
The proposal will correct an appropriation from Measure A and establish a new fund for the ATP grant.
There are no new fiscal impacts.
ALTERNATIVE(S):
1. Do not authorize the interim Finance Director to reduce the Measure A fund appropriation to the Hemet Valley Bikeway project by $2,288,000 and to establish appropriations in a new fund for the ATP grant in the amount of $1,990,000.
2. Provide alternate direction to City staff.

City Council Meeting
STAFF REPORT
Meeting: City Council Meeting - Apr 25 2023
Department: City Attorney
Submitted by: Mark Prestwich, City Manager
Steven Graham, City Attorney;
☐ Receive and File ☒ Consent Calendar ☐ Business Item ☐ Public Hearing
TITLE:
An Ordinance of the City Council of the City of Hemet, California, Amending Section 2 -164 Related to Alternate Members When Necessary for a Quorum
RECOMMENDED ACTION:
It is respectfully recommended that the City Council:
Waive full reading and introd uce by title only an Ordinance of the City Council of the City of Hemet, California, Amending Section 2-164 Related to Alternate Members When Necessary for a Quorum.
BACKGROUND:
Certain boards and commissions, such as the Mobile Home Rent Review Commiss ion, have strict attendance requirements for a quorum to exist. However, the current Hemet Municipal Code does not provide a process for the appointment of alternate members to boards and commissions. In situations where absences or disqualifications lead to a lack of quorum, these groups cannot meet or take action.
ANALYSIS:
The lack of a process for appointing alternate members to boards and commissions can hinder their ability to function efficiently and effectively. In cases where a quorum is not met due to absences or disqualifications, boards and commissions are unable to meet or take actions that may be critical for the city's operations.
DISCUSSION:
The proposed ordinance seeks to amend Section 2 -164 of the Hemet Municipal Code to address the issue of establishing a quorum. The amendment empowers the City Council to appoint alternate member(s) who can vote on any question in the event of an absence or disqualification of a regular member, should such absence or disqualification result in a lack of quorum. This amendment aims to
8.E
enhance the functioning of boards, commissions, and committees, enabling them to meet and take action when necessary.
The adoption of the amended ordinance is expected to yield positive outcomes for the City of Hemet:
• Improved Efficiency and Effectiveness : By establishing a clear process for appointing alternate members to boards and commissions, the ordinance should help ensure these groups can meet and take action even when a quorum is not met due to absences or disqualifications. • Enhanced Consistency : The amended ordinance promotes consistency in the process of appointing alternate members across all boards, commissions, and committees, simplifying the City Council's management and oversight of these groups. • Legal Clarity: The revised ordinance provides clear guidelines for determining the presence of a quorum and delineates the circumstances under which alternate members may be appointed and vote on questions.
• Priority for Mobile Home Rent Review Commission : This amendment is particularly significant for the Mobile Home Rent Review Commission, which requires both tenant and owner representatives to be present for a quorum. As these representatives may be disqualified on applications involving parks they live in, own, or work for, and given the City's history of lack of quorums for this particular commission, the City Council may want to prioritize appointing alternate members to this commission.
STRATEGIC PLAN INTEGRATION:
N/A
ALTERNATIVE(S):
The City Council could take no action. When an absence or disqualification results in a lack of a quorum, the affected board or commission would be unable to meet.
