RESOLUTION NO. 22-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES APPROVING MINOR SUBDIVISION #478-21 FOR THE SITE COMMONLY REFERRED TO AS THE “SAFEWAY SHOPPING CENTER,” LOCATED AT 4080 SAN PABLO AVENUE, AT THE CORNER OF THE INTERSECTION OF SAN PABLO AVENUE AND SYCAMORE AVENUE (EXISTING APN 404-040-0040-2), SUBDIVIDING THE 6.7-ACRE SITE INTO THREE PARCELS AND DEDICATING 0.29 ACRES OF PUBLIC RIGHT OF WAY TO THE CITY.
WHEREAS, the Project Site currently consists of one parcel of approximately 6.7 acres bearing Assessor Parcel Number (APN) 404-040-040-2; and WHEREAS, the Property Owner, McNellis Partners, has submitted an application for Minor Subdivision (MS) #478-21 to subdivide the property into three parcels; and WHEREAS, Parcel A is 4.63 acres and includes Safeway, Parcel B is 0.69 acres and includes building with current tenants Peet’s Coffee and Chase Bank, and Parcel C is 1.09 acres and is for the fueling center and kiosk/convenience store; and WHEREAS, MS #478-21 incorporates by reference the “Declaration of Easements with Covenants and Restrictions Affecting Land,” recorded July 19, 2018, as Document No. 2018-0115162-00, which governs the use of common areas including access, parking, utility and service easements, and shared maintenance; and WHEREAS, 0.29 acres is dedicated to the City to re-establish the property line so that the newly constructed sidewalk along the project street frontage falls within the public right of way (i.e., City ownership); and WHEREAS, MS #478-21 for the Safeway Shopping Center has been determined to be a Class 15 Categorical Exemption under the California Environmental Quality Act (CEQA), Section 15315, “Minor Land Divisions;” and WHEREAS, MS #478-21 has been reviewed by the Community Development Director, City Engineer, and Acting City Land Surveyor and has been determined to conform to all applicable municipal code provisions and the Subdivision Map Act.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules that the City Council hereby approves Parcel Map M.S (Minor Subdivision) #478-21 subdividing the 6.7-acre Safeway Shopping Center site into three parcels and dedicating 0.29 acres to the City for public right-of-way.
The foregoing Resolution was duly and regularly adopted at a regular meeting of the City Council of the City of Hercules held on the 11th day of January 2022 by the following vote of the Council:
