SUBMITTED BY: Michael Roberts, Public Works Director/City Engineer SUBJECT: Minor Subdivision (MS #478-21) for the Safeway Shopping Center to subdivide the 6.7-acre site into three parcels and dedicate 0.29 acres to the City for public right-of-way RECOMMENDED ACTION:
Open the public hearing and receive public comments, close the public hearing and consider adoption of a resolution approving Parcel Map M.S (Minor Subdivision) #478-21 subdividing the 6.7-acre Safeway Shopping Center site into three parcels and dedicating 0.29 acres to the City for public right-of-way.
COMMISSION ACTION AND RECOMMENDATION:
The Planning Commission unanimously recommended approval of Parcel Map M.S. 478-21 at their November 15, 2021 meeting.
FISCAL IMPACT OF RECOMMENDATION:
There is no fiscal impact to the City associated with the proposed parcel map.
DISCUSSION:
In July 2021 McNellis Partners submitted an application to subdivide the 6.7-acre site at 4080 San Pablo Avenue into 3 parcels. The site is located at the northeast corner of the intersection of San Pablo Avenue and Sycamore Avenue (Assessor’s Parcel Number 404-040-040-2) and is commonly known as the Safeway Shopping Center.
As shown on the subdivision map, MS #478-21 (Att #2), Parcel A is 4.63 acres and includes Safeway, Parcel B is 0.69 acres and includes the building home to current tenants Peet’s Coffee and Chase Bank, and Parcel C is 1.09 acres and is for the fueling center and kiosk/convenience store.
MS #478-21 incorporates by reference the “Declaration of Easements with Covenants and Restrictions Affecting Land,” recorded July 19, 2018 as Document No. 2018-0115162-00 (Att #3), which governs use of common areas including access, parking, utility and service easements, and shared maintenance.
The 0.29 acres proposed to be dedicated to the City is to re-establish the property line so that the newly constructed sidewalk along the project street frontage falls within the public right-of-way (i.e., City ownership)(Att #4).
McNellis Properties has indicated they are proceeding with the minor subdivision so that tax bills can be received separately and directly.
MS #478-21 has been reviewed by the Community Development Director, City Engineer, and Acting City Land Surveyor and has been determined to conform to all applicable the municipal code provisions, the City’s General Plan, the project site’s zoning designation of General Commercial, and the Subdivision Map Act. Given the Declaration of Easements with Covenants and Restrictions Affecting Land, no separate conditions of approval are recommended.
Minor Subdivision #478-21 for the Safeway Shopping Center has been determined to be a Class 15 Categorical Exemption under the California Environmental Quality Act (CEQA), Section 15315, “Minor Land Divisions.” Staff recommends that the City Council adopt a resolution (Att #1) approving Minor Subdivision #478-21.
