I. SPECIAL MEETING – 7:00 P.M. CALL TO ORDER - ROLL CALL Mayor Bailey called the meeting to order at 7:01 p.m.

The Pledge of Allegiance was led by Council Member Grimsley.
III. INTRODUCTIONS/PRESENTATIONS/COMMISSION REPORTS
City Manager Hall explained the reason for the special meeting with the Hilltown Developer on the continued discussion of the proposed Mello-Roos Community Facility District.

VI. DISCUSSION AND/OR ACTION ITEMS
1. 22-024 Continued Discussion Regarding Santa Clara Valley Housing Group's (SCVHG) Request to Form a Mello-Roos Community
Facilities District for the Hilltown Development
Recommendation: City Council to take the next step towards forming a Mello-Roos Community Facilities District to provide the financing needed for the Hilltown Development by directing staff to begin preparing the

necessary documents for Council's future consideration; alternatively City Council inform the Developer, Santa Clara Valley Housing Group, that the City is electing not to proceed with the Mello-Roos Community Facilities District.
City Manager Hall introduced the item and Public Works Director Roberts provided a staff report. Cory Kusich from Santa Clara Valley Housing gave a presentation on the Hilltown project.
Public Works Director Roberts provided an outline of options that City Council could take under consideration. City consultant Wing-See Fox of Urban Futures, Inc. provided a general overview of the financing of a Mello-Roos Community Facility District and Attorney Ben Fay of Jarvis Fay provided an overview of the City's process of forming a Community Facility District.
Members of the City Council asked questions and provided comments.
Mayor Bailey requested that the City Clerk conduct a poll of City Council to the question of whether the City Council would like to proceed with the outline provided by Attorney Ben Fay and proceed with the preparation of forming a Community Facilities District. Provided below is the result of the poll:
Council Member Grimsley: Nay
Council Member Kelley: Aye
Council Member Romero : Aye
Vice Mayor Walker-Griffin: Nay
Mayor Bailey: Nay
The poll vote failed 3-2.
Council Member Romero requested that the City Council consider bringing this item back for a future discussion to allow the developer to provide additional options on how they may be able to proceed with the project.
Mayor Bailey asked the City Council to show a thumbs up or thumbs down regarding allowing staff to add this discussion to a future agenda. The poll resulted in a 4-1 vote as follows:

Council Member Romero: thumbs up
Vice Mayor Walker-Griffin: thumbs down
Mayor Bailey: thumbs up
