RESOLUTION NO. 22-
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES AUTHORIZING THE CITY MANAGER TO ENTER INTO A REVISED LIBRARY LEASE AND SERVICES AGREEMENT WITH CONTRA COSTA COUNTY WHEREAS, the Contra Costa County Library system supports the operation of 26 libraries countywide; and WHEREAS, the City of Hercules owns its library building and obtains Library Services from Contra Costa County, which operates the Hercules facility as a Branch Library, within the County Library System; and WHEREAS, the Library operates as a partnership between the City of Hercules and the Contra Costa County Library System, and the relationship is governed by an existing agreement dating back to 2007; and WHEREAS, County-wide there have been discrepancies in the lease terms with various cities since they had been negotiated over time, and in 2010 a Master Library Lease and Service Agreement was approved by the County Board of Supervisors; and WHEREAS, while many cities within the County have revised their library lease agreements with the County to conform with the Master Library Lease and Service Agreement, Hercules has to date not executed the updated form of the Lease Agreement; and WHEREAS, the Proposed Agreement would replace the existing 2007 Agreement and would modify some of the past practices, more clearly specify the responsibilities of the parties, and clarify cost sharing requirements; and WHEREAS, the new format is consistent with efforts by the County Library System to standardize cost sharing throughout the system; and WHEREAS, on or about November 8, 2021, the Community and Library Services Commission received a staff report regarding the proposed revised Library Services Agreement and upon consideration of the report and presentation by City and County staff, passed a resolution recommending that the City Council adopt the proposed Revised Lease Agreement.
NOW THEREFORE BE IT RESOLVED:
That after review of the relevant documents and discussion at an agendized regular City Council meeting, the Hercules City Council hereby authorizes the City Manager to execute a revised Library Lease and Service Agreement with Contra Costa County in substantially the same form as presented to Council at its regular meeting occurring on the herein referenced date.
The foregoing Resolution was duly adopted at a regular meeting of the City Council of the City of Hercules held on the 25th day of January, 2022, by the following vote:
