RESOLUTION NO. 22-
Resolution of the City Council of the City of Hercules authorizing the City Manager to execute an AMENDMENT TO AND EXISTING agreement with FIRST CARBON SOLUTIONS to prepare THE environmental review for the skelly development project for an amount not to exceed $146,900.

WHEREAS, D.R. Horton has indicated its intention to submit an application to develop the approximately 7.3-acre former horse ranch at 215 Skelly (Assessor’s Parcel Number 404-020-012-5) by removing the existing structures, trees, and vegetation and constructing 40 single-family homes; and WHEREAS, on November 9, 2021, D.R. Horton paid the City an initial deposit fee of $88,000 and requested that the City initiate the environmental review of the project as required under the California Environmental Quality Act (CEQA); and WHEREAS, First Carbon Solutions (FCS), a pre-qualified consulting firm for the City of Hercules, and its subcontractors have the qualifications and experience necessary to prepare the required environmental review documents for the project; and WHEREAS, on November 30, 2021, the City—under the City Manager’s spending approval authority—entered into an agreement with FCS, to initiate the Skelly project’s environmental review for an amount not to exceed $50,000; and WHEREAS, the full cost of FCS’s services to complete the environmental review is estimated to be $146,900, an amount that requires City Council approval, and WHEREAS, Per the City’s Master Fee Schedule, applicants are responsible for reimbursing the City for all expenditures, plus 20%, incurred in processing a development review application, so that D.R. Horton as the applicant bears the full cost of the environmental review, and there is no impact to the City’s budget or finances.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules that the City Council hereby authorizes the City Manager to execute an amendment to the existing agreement with FCS to prepare the environmental review documents for the Skelly Development Project for a total amount not to exceed $146,900.
