The parties to this Contract Amendment do mutually agree and promise as follows:
2. Purpose. This Amendment No. 1 is being entered into to a mend an existing contract between the City and Contractor which was approved by the City Council of the City of Hercules on January 28, 2020 by Resolution No 20-005. Said contract shall hereinafter be referred to as the "Original Contract" and is incorporated herein by reference.
3. Original Contract Provisions. The parties hereto agree to continue to abide by those terms and conditions of the Original Contract, and any amendments ther eto, which are unaffected by this Contract Amendment Agreement.
4. Amendment. This Amendment No. 1 is intended to amend the Original Contract and previously approved amendments (collectively, the "Amended Contract") thereto to provide for additional co mpensation in an amount not to exceed $ 34,828.00, total contract amount $109,028.00.
5. Amendment Approval: This Amendment No. 1 is hereby approved by the City Council of the City of Hercules on this _______ day of ___________, 2022 by Resolution No. ________.

Subject: Additional Services Request for the Palm/Willow Sidewalk Project
Dear Mike:
We are respectfully submitting this additional services request for the City’s consideration. As we previously discussed, once final design was underway and the project was examined in-depth, new project challenges and design elements were identified. Also, the year and a half hold placed on the project due to the pandemic and associated funding uncertainties caused additional, unanticipated work, especially with regards to 3rd party permits and services.
The following are the key additional items of work that we are requesting for the completion of the project:
• Additional resources and effort required to secure the Railroad Company permit and PG&E electrical service due to COVID, project placed on hold and personnel changes. When the project was on hold the railroad company and PG&E terminated the permit and application process due to the inactivity on the project. • Addition of slurry seal to the project.
• Addition of flashing beacons on both sides of the railroad crossing on Palm Avenue . • Design modification for the sidewalk to account for the poor soils identified in the geotechnical report . • Need to pothole an EBMUD waterline in Willow Avenue adjacent to the proposed retaining wall south of Palm Avenue in order to verify its location and avoid conflict during construction. • Additional work required for the preparation, meeting and response to the added CCTA Peer Review.
Bellecci & Associates, Inc proposes to conduct the additional work for the project as outlined in this proposal for an estimated fee of $ 34,828.00 including reasonable reimbursable expenses. A budget breakdown, Exhibit A is attached for your review. As we have been throughout the project we will invoice against this amount on a time and material basis per the hourly rate schedule the City has on file for this contract.
