RESOLUTION NO. 22-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES APPROVING A LANDSCAPE MAINTENANCE AGREEMENT FOR THE PROPERTY OWNER OF THE GRAND (APN 404-730-013) TO MAINTAIN THE LANDSCAPING IN BAYFRONT LOOP ALONG THEIR PROPERTY FRONTAGE WHEREAS, the Landscape Maintenance Agreement provides for the Property Owner of The Grand at 2200 John Muir Parkway (APN 404-730-013) to maintain the 5.5 ft wide landscaping planter strip in Loop Road along their property frontage; and WHEREAS, this Agreement is similar to maintenance arrangements in place in recent commercial developments such as Aventine and Safeway; and WHEREAS, the Landscape Maintenance Agreement allows this commercial business to maintain their frontage landscaping at a more responsive level, as needed for their marketing plan; and WHEREAS, if the landscaping were to be maintained by the City instead, the level of service provided would be limited by the current assessment rate and any increases would have to be approved by all the properties in the Landscaping and Lighting District/Zone through a balloting process.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules that the City Council hereby approves the Landscape Maintenance Agreement for the property owner of The Grand to maintain the landscaping in Bayfront Loop along their property frontage.
The foregoing Resolution was duly and regularly adopted at a regular meeting of the City Council of the City of Hercules held on the 13th day of September 2022 by the following vote of the Council:
