LANDSCAPE MAINTENANCE AGREEMENT
This Landscape Maintenance Agreement (this " Agreement ") is entered into by and between Hercules Block Q&R Development Partners LP, a Delaware limited partnership (the “Developer ”) and the City of Hercules, California (the “ City ”) to be effective as of ____________, 2022 (the "Effective Date "):
Background
The Developer has constructed a multi-family housi ng project on the tract of land in the City described on Exhibit “A” to this Agreement (th e “ Developer Tract ”). A tract of land described on Exhibit “B” to this Agreement adjacent to the Developer Tract (the “ Landscape Tract ”) has been improved with landscaping and an irrigation system by the Developer. The City wishes to assure that the landscaping and irrigatio n system situated on the Landscape Tract are maintained in the future by the current and subsequ ent owners of the Developer Tract as more specifically set forth in this Agreement.
