RESOLUTION OF THE CITY COUNCIL OF THE CITYOF HERCULES APPROVING AN AMENDMENT TO CITY MANAGER DANTE HALL’S EMPLOYMENT
AGREEMENT TO INCREASE HIS COST OF LIVING ADJUSTMENT (“COLA”) FROM 3% TO 4.5% FOR FISCAL YEARS 2022-23 AND 2023-24
WHEREAS, on July 27, 2021, the City Council approved a five-year Agreement with Dante Hall for City Manager/Executive Director Services (hereinafter “Agreement”) to employ Dante Hall as the City Manager of the City of Hercules; and WHEREAS, the Agreement provides for, among other matters, an annual performance review, an annual cost of living adjustment (“COLA”) of 3%, and benefits on the same terms and conditions as received by the Senior Management Employees; and WHEREAS, the City Council conducted the annual performance review of the City Manager pursuant to the requirements of the Agreement over the course of several meetings in September and October 2022; and WHEREAS, at the conclusion of the City Manager’s annual review, the Council directed the City Attorney to prepare a resolution for Council consideration to increase the City Manager’s COLA to 4.5% for fiscal years 2022-23 and 2023-24, consistent with the COLA previously approved by the Council for the Senior Management Group; and WHEREAS, at a duly noticed Regular City Council meeting convened on October 25, 2022, the Council discussed and considered the proposal to increase the City Manager’s COLA to 4.5% for FY 2022-23 and 2023-24.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules that the Agreement with Dante Hall for City Manager/Executive Director Services is hereby amended to provide for an increase in the City Manager’s COLA for fiscal years 2022-23 and 2023-24 to 4.5%, consistent with the amount approved for the Senior Management Group pursuant to prior Council action.
BE IT FURTHER RESOLVED that the Amended Agreement with Dante Hall for City Manager/Executive Director Services, shall be on file in the City Clerk’s Office, and the Mayor is authorized to execute said amendment to the Original Employment Agreement on behalf of the City of Hercules.
The foregoing Resolution was duly and regularly adopted at the regular meeting of the City Council of the City of Hercules held on the 25th day of October 2022, by the following vote of the Council:
