REPORT TO THE CITY COUNCIL
DATE: Regular Meeting of October 25, 2022
TO: Mayor Bailey and Members of the City Council
SUBMITTED BY: J. Patrick Tang, City Attorney
SUBJECT: Proposed Resolution to Amend City Manager Hall’s Employment Agreement to Increase his Cost of Living Adjustment (“COLA”) from 3% to 4.5% for Fiscal Years 2022-23 and 2023-24 RECOMMENDATION:

Discuss and consider adoption of a resolution to increase City Manager Dante Hall’s cost of living adjustment (“COLA”) for FY 2022-23 and FY 2023-24 in line with adjustments previously approved by Council for Senior Management Employees.

BACKGROUND:

On July 27, 2021, the City Council approved a five-year Agreement with Dante Hall for City Manager/Executive Director Services (hereinafter “Original Agreement”) to employ Dante Hall as the City Manager of the City of Hercules. The Original Agreement provides for, among other matters, an annual performance review, an annual cost of living adjustment (“COLA”) of 3%, and benefits on the same terms and conditions as other Senior Management Employees.

DISCUSSION:

Over the course of several council meetings in September and October, the City Council conducted the annual performance review of the City Manager pursuant to the requirements of the Original Agreement. In concluding the City Manager’s review, the Council directed the City Attorney to prepare a resolution for Council consideration to amend the Original Agreement to increase the City Manager’s COLA to 4.5% for fiscal years 2022-23 and 2023-24, consistent with the COLA previously approved by the Council for the Senior Management Group.

A draft resolution to amend the Original Agreement pursuant to Council’s direction is provided as Attachment 1 to this report.

ACTION:

Discuss and consider adoption of a resolution increasing the City Manager’s COLA for FY 2022-23 and 2023-24 to 4.5%, in line with the increase for the senior management group previously approved by Council.
