RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES APPROVING A MAINTENANCE AND REIMBURSEMENT AGREEMENT WITH SAN FRANCISCO BAY AREA RAPID TRANSIT (BART) AND WESTERN CONTRA COSTA TRANSIT AUTHORITY (WESTCAT) FOR THE HERCULES TRANSIT CENTER AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY COUNCIL WHEREAS, BART owns the Hercules Transit Center, a satellite park-and-ride facility in the City of Hercules at the corner of Willow Avenue and the I-80 Off-Ramp/SR-4 On-Ramp; and WHEREAS, since 2009, the City of Hercules has partnered with BART and WestCAT to operate and maintain the facility; and WHEREAS, under the current three party-agreement, Hercules operates the parking program using a 3rd party vendor, maintains the facility, and reimburses these maintenance activities through the parking revenue generated; and WHEREAS, the parties wish to update the terms of the agreement including switching parking payments to the BART Official App, allowing BART to more cost-effectively collect parking revenues and for a better customer experience, and establishing a revolving fund which would allow the City to pay for maintenance activities without incurring out of pocket costs.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules that the City Council hereby approves a Maintenance and Reimbursement Agreement with San Francisco Bay Area Rapid Transit (BART) and Western Contra Costa Transit Authority (WestCat) for the Hercules Transit Center and authorizing the City Manager to execute the agreement on behalf of the City Council.
The foregoing Resolution was duly and regularly adopted at a regular meeting of the City Council of the City of Hercules held on the 14th day of March 2023 by the following vote of the Council:
