RESOLUTION NO. 23-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES APPROVING A PARKING OPERATIONS AGREEMENT WITH HERCULES LAND PARTNERS, LP FOR THE BAYFRONT PROJECT WHEREAS, in 2012 the City approved and adopted the Implementing Development Agreement for the Bayfront Project (the “IDA”) to govern development of the approximately 103-acre Bayfront Project (the “Project”). The IDA describes the City’s and the developer’s rights and obligations concerning development of the Project, including construction of the City’s planned intermodal transit center, now known as the Hercules Hub; and WHEREAS, the IDA envisions that a type of public parking program or district will be established in order to maximize public parking in the initial Hub development phases and to coordinate with the developer’s private parking; and WHEREAS, in an effort to coordinate the shared parking contemplated by the IDA and to allow blocks to begin development prior to establishment of a parking program, on March 2, 2020 the City and developer entered into a Memorandum of Understanding to express the parties’ intentions and address parking requirements in the IDA and the Waterfront District Master Plan; and WHEREAS, City staff and the developer have negotiated a final Parking Operations Agreement (the “Agreement”) consistent with the Memorandum of Understanding and the IDA; and WHEREAS, by removing uncertainty associated with the shared parking obligations for existing and future phases of the Bayfront, execution of the Agreement would support the City’s goal of facilitating continued development of the Bayfront Project in accordance with the approved entitlements; and WHEREAS, the Agreement has been determined to be consistent with the Hercules Bayfront Project approvals and determinations under the California Environmental Quality Act (“CEQA”) because in October 2011, the City of Hercules certified the Hercules Bayfront Project Final EIR (State Clearinghouse No. 2009112058) (the “2011 Certified EIR”) pursuant to CEQA, The Agreement is within the scope of the Project that was evaluated in the 2011 certified EIR and will not have any environmental effects that were not evaluated and addressed in the 2011 certified EIR.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hercules hereby approves the Bayfront Project Parking Operations Agreement and authorizes the City Manager to take actions necessary to execute the Agreement on behalf of the City, including but not limited to approving non-substantive changes to the Agreement.
The foregoing Resolution was duly adopted at a regular meeting of the City Council of the City of Hercules held on the twenty-seventh day of June, 2023, by the following vote of the Council:
