RESOLUTION NO. 23-
RESOLUTION APPROVING PURCHASE AND SALE AGREEMENTS WITH THE COVENTRY OF HERCULES HOMEOWNERS ASSOCIATION (HOA) AND THE MCCLURES AT 136 CAMDEN LANE TO ACQUIRE 2 EASEMENTS FOR THE SYCAMORE AVENUE SEWER TRUNK REPLACEMENT PROJECT AND AUTHORIZING THE CITY MANAGER TO SIGN BOTH AGREEMENTS AND ASSOCIATED DEEDS ON BEHALF OF THE CITY COUNCIL WHEREAS, the sewer trunk main is being realigned as part of the Sycamore Avenue Sewer Trunk Replacement Project to relocate the sewer trunk main out of front yards and away from homes into the sewer easement on Camden Avenue; and WHEREAS, two easements are needed to facillitate the realignment to occur; and WHEREAS, the first easement is located at the top of Camden Lane, which is a private street, on Coventry of Hercules Homeowners Association property, and is 416 square feet; and WHEREAS, the second easement is located at the corner of the McClure property at 136 Camden Lane (Assessors Parcel Number 404-460-041), and is 65 square feet; and WHEREAS, the easements would be secured through Purchase and Sale Agreements and associated deeds.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules that the City Council hereby approve purchase and sale agreements with the Coventry of Hercules Homeowners Association (HOA) and the McClures at 136 Camden Lane to acquire 2 easements for the Sycamore Avenue Sewer Trunk Replacement Project and authorize the City Manager to sign both agreements and associated deeds on behalf of the City Council.
The foregoing Resolution was duly and regularly adopted at a special meeting of the City Council of the City of Hercules held on the 10th day of October 2023 by the following vote of the Council:
