DATE: Regular Meeting of October 10, 2023
TO: Mayor and Members of the City Council
VIA: Dante Hall, City Manager
SUBMITTED BY: Patrick Tang, City Attorney
Mike Roberts, Public Works Director
Joe Vasquez, Police Chief
SUBJECT: Ordinance of The City Council Of The City Of Hercules Amending The Hercules Municipal Code Title 3, Chapter 4, Article 12 To Specify Parking Restrictions In Designated Green Zones, And Clarifying Parking Time Limits In Designated Yellow Zones RECOMMENDATION ACTION:
Receive presentation, convene public hearing and take public comment, discuss, waive first reading and approve introduction of the proposed ordinance.
BACKGROUND:
At the request of an adjacent business, two parking spaces on John Muir Parkway have been converted to 20 minute parking zones by painting the curbs green. It was subsequently discovered that use of green curbs for the purpose of allowing limited, short term parking is not expressly authorized pursuant to the Hercules Municipal Code.
In reviewing the current on-street parking code provisions it has also been determined that there is ambiguity in several provisions that should be clarified.
ANALYSIS:
Amending the Hercules Municipal Code to expressly provide for the establishment and enforcement of parking restrictions by use of green curbs will allow enforcement of the designated time limits pursuant to California Vehicle Code Section 21458. Minor clarifying changes to the provisions for yellow and white curbs will also aid in parking enforcement.
FISCAL IMPACT:
There is no fiscal impact associated with this action.
