TERMINATION OF DISPOSITION AND DEVELOPMENT AND AGREEMENT This TERMINATION is made November 14, 2023, by The City of Hercules, a municipal corporation of the State of California (“City”) and The City of Hercules, as Successor Agency to the Hercules Redevelopment Agency, (“Agency”) and Hercules Hotel Development Group, LLC, a California limited liability company, (“Owner”), as successor in interest to Developer, as to the real property hereafter defined, with reference to that certain Disposition and Development Agreement disclosed by Memorandum thereof dated April 11, 2006, and recorded June 26, 2009, in the Official Records of Contra Costa County, California, as Instrument No. 2009-0151069.
The Disposition and Development Agreement was made by City, Agency and Hercules New Town Center, LLC, a California limited liability company, (“Developer”) with respect to certain real property situated in the City of Hercules, County of Contra Costa, in the State of California, that portion thereof belonging to Owner being particularly described as:
That certain real property shown on Parcel Map No. 1007, filed August 2, 1977, in the Official Records for Contra Costa County, in Book 56 of Parcel Maps at pages 42 and 43.
EXCEPTING THEREFROM:
That portion of said land as described in the Grant Deed to the State of California, recorded June 11, 1993, in Book 18645 Official Records, Page 685, as Series No. 93-155095.

Notice is hereby given that said Disposition and Development Agreement is no longer of any further force and effect as to the above-described real property, and the parties mutually release each other from all terms, covenants, obligations and provisions contained therein.
