STAFF REPORT TO THE CITY COUNCIL
DATE: Special Meeting of November 14, 2023
TO: Members of the City Council
VIA: Dante Hall, City Manager
SUBMITTED BY: Michael Roberts, Public Works Director/City Engineer SUBJECT: Approval of the Final Map and Subdivision Improvement Agreement for Tract No. 9606 “Owl Ranch” RECOMMENDED ACTION:

City Council adopt a resolution approving the Final Map and Subdivision Improvement Agreement for Tract No. 9606 “Owl Ranch” located at 215 Skelly and authorizing the City Manager to execute the Subdivision Improvement Agreement on behalf of the City Council.

BACKGROUND:

The Owl Ranch residential subdivision, which was formerly known as 215 Skelly, was fully entitled at the September 27, 2022, Council meeting, which included approval of Vesting Tentative Map #22-01. The project subdivides the 7.44-acre parcel located at the terminus of Skelly, just south of the intersection with Pearce, into 40 single-family residential lots along with parcels for a stormwater treatment area, emergency vehicle access, an open space buffer, and an existing cell tower.

The developer, D.R. Horton, is proceeding forward including on-site grading activities and building plan check. They recently submitted Final Subdivision Map 9606 “Owl Ranch” for the project (Att #2). D.R. Horton also executed Subdivision Improvement Agreement - Tract No. 9606 “Owl Ranch” (Att #3) prepared by staff using the City’s standard template. They submitted all supplemental documents required by the Agreement, including the final improvement plans, bonds, and inspection and plan check fees.

ANALYSIS:

Final Subdivision Map 9606 “Owl Ranch” has been reviewed by staff and the City’s consulting land surveyor for compliance with Section 10-2 of the Hercules Municipal Code, including conformity with the Subdivision Map Act and substantial compliance with the approved Vesting Tentative Map #22-01.

Subdivision Improvement Agreement Tract No. 9606 “Owl Ranch” and the required supplemental documents have been reviewed by the City Attorney and City Engineer for compliance with Section 10-2 of the Hercules Municipal Code, including conformity with the Subdivision Map Act.

Both the Parcel Map and Subdivision Improvement Agreement are now being brought before the City Council in accordance with Section 10-2 of the Hercules Municipal Code and are recommended by staff for approval.

Approval of these documents will allow the developer to obtain the financing needed to advance the project.

FISCAL IMPACT:

There is no net fiscal impact associated with this agenda item. Processing of the final map and subdivision improvement agreement is funded through developer fees.
