Hercules City Council
Draft Post-Collection RFP &
Draft Post-Collection Agreement
Peter Holtzclaw
Executive Director
RecycleMore/WCCIWMA
9/10/2024
Background
Current PCA ends 6/30/2025
Ad Hoc Spring 2023; Ad Hoc Report & Recommendation 11/23 Board vote in 2/2024 for a Post Collection RFP
Nothing Wasted brought on as a PCA consultant 3/2024
Draft RFP and Draft Term Sheet provided to regional staff 6/1/2024 Draft PCA provided to regional staff 7/1/2024
Draft RFP, Term Sheet and PCA modelled on the 2012 RFQ and current PCA 2012 RFQ and current PCA are both examples of strong processes & outcomes Numerous Meetings with regional staff
Ample time for input from cities prior to the Board meeting
Important Issues
County & El Cerrito Involvement
Very positive development
More volume & more ratepayers = better rates
Term/Instituting New Rates
10-year term with two 5-year extensions
This is not set in stone, Board can sync with collection franchise terms
Important Issues
Scope of Services
Align with current PCA
Innovative processes (e.g. Raven) can be included as optional services Pricing/Rates
Based on the current blended rate structure
RFP will require proposers to list the material specific per ton rate and initial HHW per ton rate RFP will ask for component pricing to be shown, but these prices aren’t binding; only material specific and HHW are binding
Important Issues (cont.)
Commodity Revenue Rebate
Index changing from MP to OCC; ratepayers should see a credit of $500k-$1M more per year Will also include language to capture a revenue rebate from hydrogen fuel if that process is included Outreach
Much of the current PCA outreach section has been rewritten
Important Issues (cont.)
Performance Metrics
Don’t want to overburden the PCA with a lot of “backseat driver” performance indicators Based on CalRecycle’s Pounds-per-Person-per-Day (“PPD”) measurement that relates to the 50% ab939 mandate Data Tracker Software Application
Authority staff will have limited access to contractor’s sb1383 date tracking software application based on software permissions
Important Issues (cont.)
Liquidated Damages
Like Performance Metrics, don’t want to burden the PCA with a lot of LD’s Looking at basics like damages from landfilling organics and recyclables Contract Extension
A possible short-term extension has been voiced, but this is a bad idea There’s plenty of time to finish this process and have an agreement by 7/2025
