RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION CONTRACT WITH FRONTLINE GENERAL ENGINEERING CONSTRUCTION, INC. IN THE AMOUNT OF $895,814.00 FOR THE REFUGIO AND FOXBORO PARK IMPROVEMENT PROJECT AND AUTHORIZING AN ADDITIONAL EXPENDITURE OF UP TO $89,581.40 FOR A 10 PERCENT CONTINGENCY ON SAID CONSTRUCTION CONTRACT, FOR A TOTAL NOT TO EXCEED CONTRACT AMOUNT OF $985,395.40.
WHEREAS, the Refugio and Foxboro Park Improvement Project was advertised for bids in the West County Times on November 17th and 24th, 2025 and in 5 regional plan rooms; and WHEREAS, a total of 6 bids were received at the bid opening deadline of 2 pm on Tuesday, December 16 and upon opening and reviewing the 6 bids received, Frontline General Engineering Construction, Inc. submitted the low bid, inclusive of the alternate bid item, in the amount of $895,814.00; and WHEREAS, no protests were received within the required timeframe; and WHEREAS, Frontline General Engineering Construction, Inc. has been determined to be a responsible bidder and their bid has been determined to be responsive; and WHEREAS, a contract for construction management will be brought to Council for approval in early 2026; and WHEREAS, there is sufficient funding in the Adopted FY 2025-26 Budget to fully fund the construction and the construction management.
WHEREAS, the Refugio and Foxboro Park Improvement Project involves maintenance and repair work for existing park facilities and does not authorize new construction and is therefore exempt from review under the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guideline section 15301 (existing facilities).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules as follows:
The foregoing recitals are true and correct and are incorporated herein as findings.
That the City Council hereby authorizes the City Manager to execute a construction contract with Frontline General Engineering Construction, Inc. in the amount of $895,814.00 for the Refugio and Foxboro Park Improvement Project and authorizing an additional expenditure of up to $89,581.40 for a 10% contingency on said construction contract, for a total not to exceed contract amount of $985,395.40.
The foregoing Resolution was duly and regularly adopted at a regular meeting of the City Council of the City of Hercules held on the 13th day of January 2026 by the following vote of the Council:
