A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT NO. 2 TO THE CITY’S NOVEMBER 6, 2023 PROFESSIONAL SERVICES AGREEMENT WITH GATES & ASSOCIATES, INC. TO PROVIDE DESIGN SERVICES FOR THE BEECHNUT PARK IMPROVEMENT PROJECT, INCREASING THE COST BY $84,534 TO A TOTAL COST OF $136,329.
WHEREAS, On November 6, 2023, the city entered into an agreement in the amount of $43,890 for professional services with Gates & Associates, Inc. (Gates) to hold a community meeting and prepare the 30 percent design of the Beechnut Park Improvement Project; and WHEREAS, On August 21, 2024, the city entered into Amendment No. 1 to the November 6, 2023 agreement in the amount of $7,905 to provide additional coordination and community meetings for the Beechnut Park Improvement Project; and WHEREAS, On August 6, 2025, the city entered into an Encroachment Agreement with Pacific Gas and Electric allowing the construction of a playground within the Easement and Right of Way for the electric transmission facilities that cross the site.
WHEREAS, The City anticipates continued need for Gate’s services to complete the project design and support management of the construction for this project; and WHEREAS, funding for the design work is available in the Fiscal Year 2025-26 Adopted Budget.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules as follows:
The City Council hereby authorizes the City Manager to execute an Amendment No. 2 to the November 6, 2023 Professional Services Agreement with Gates & Associates, Inc. to provide design services for the Beechnut Park Improvement Project, increasing the cost by $84,534 to a total cost of $136,329.
The foregoing Resolution was duly and regularly adopted at a regular meeting of the City Council of the City of Hercules held on the 24th day of February, 2026 by the following vote of the Council:
