SUBJECT: Ratification of Resolution Approving Contra Costa County Regional Alternative Compliance (RAC) Participation and City’s Joint Powers Authority Representative RECOMMENDED ACTION:
Council is asked to ratify the attached resolution approving the Contra Costa County Regional Alternative Compliance (RAC) Joint Powers Authority Agreement and designating Jose Pacheco, Associate Engineer, as the City’s representative and Kennedy & Associates as the City’s alternate.
DISCUSSION:
The City Council approved Resolution No. 26-029 at its regular meeting on May 26, 2026 approving and authorizing execution of the Joint Powers Agreement for the City’s participation in the RAC Joint Powers Authority in order to comply with the City’s Municipal Regional Stormwater Permit obligations. Due to an inadvertent error, staff did not confirm its recommended Authority representative, Jose Pacheco, in section 3 of the adopted Resolution. Staff recommends that the City Council ratify its prior approval by confirming that Resolution No.26-029 now includes the following section 3 language:
SECTION 3. The City Council appoints Jose Pacheco, Associate Engineer, as the representative on the JPA’s Board and Frank Kennedy or his designee from Kennedy & Associates as the alternative representative on the JPA’s Board.
