RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERCULES AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION CONTRACT WITH RAPID GRADING SERVICES IN THE AMOUNT OF $804,133 FOR THE FOXBORO PAVEMENT REHABILITATION PROJECT – PHASE 1, AND AUTHORIZING AN ADDITIONAL EXPENDITURE OF UP TO $80,413 FOR A 10 PERCENT CONTINGENCY ON SAID CONSTRUCTION CONTRACT, FOR A TOTAL NOT TO EXCEED CONTRACT AMOUNT OF $884,546.
WHEREAS, the Foxboro Pavement Rehabilitation Project - Phase 1 was advertised for bids in the West County Times on July 20th and 27th, 2026 and in 5 regional plan rooms; and WHEREAS, a total of 7 bids were received at the bid opening deadline of 2 pm on Tuesday, August 11th 2026; and WHEREAS, upon opening the bids, Radius Earthwork was the apparent low bidder; however, upon further review it was discovered their bid omitted required information and the bid was deemed non-response; and WHEREAS, the next lowest bid was submitted by Rapid Grading Services in the amount of $804,132.49; and WHEREAS, Rapid Grading Services has been determined to be a responsible bidder and their bid has been determined to be responsive; and WHEREAS, there is sufficient funding in the Adopted FY 2026-27 Budget to fully fund the construction contract; and WHEREAS, this Project involves repair work for an existing roadway and does not authorize new construction and is therefore exempt from review under the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guideline section 15301 (existing facilities) and pursuant to CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that such replacement will not have a direct or indirect impact on the environment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hercules as follows:
That the City Council hereby authorizes the City Manager to execute a construction contract with Rapid Grading Services in the amount of $804,133 for the Foxboro Pavement Rehabilitation Project – Phase 1, and authorizes an additional expenditure of up to $80,413 for a 10% contingency on said construction contract, for a total not to exceed contract amount of $884,546.
The foregoing Resolution was duly and regularly adopted at a regular meeting of the City Council of the City of Hercules held on the 8th day of September 2026 by the following vote of the Council:
