STAFF REPORT TO THE CITY COUNCIL
DATE: Regular Meeting of September 22, 2026
TO: Mayor and Members of the City Council
VIA: Patrick Tang, Interim City Manager
SUBMITTED BY: Christie Crowl, City Attorney
SUBJECT: Amend City Council Rules of Procedure Pertaining to Personnel Evaluations RECOMMENDED ACTION:
By minute order, approve amendments to the City Council Rules of Procedure to allow a member to call a closed session to evaluate the performance of the City Manager or City Attorney.
BACKGROUND:
At the regular City Council meeting on September 8, 2026, Councilmember Bailey requested a future agenda item to discuss amending the City Council Rules of Procedure to adjust the process through which personnel evaluations may be requested for the two staff positions hired by the City Council (the City Manager and the City Attorney). Currently, the Rules of Procedure require a council member to make a request for a future agenda item at a City Council meeting.
DISCUSSION:
The proposed amendments to the Council Rules of Procedure would allow any member of the Council to make a written request of the Mayor to hold a closed session to evaluate the performance of the City Manager or City Attorney. With the concurrence of the Mayor, the City Clerk will place the closed session item on an agenda. If it is the Mayor who desires to make a request to hold a closed session to evaluate the performance of the City Manager or City Attorney, he or she may do so by bringing the written concurrence of one other Council Member to the City Clerk.
FISCAL IMPACT:
This item has no fiscal impact.
