Executive Summary:

The 2022 semi-annual review of the fire and ambulance transport services provided by Los Angeles County Fire Department and McCormick Ambulance, respectively, provides an overview of service level provided from January through June 2022. Staff continues to monitor the service trends to ensure the highest level of services for our community.

Background:

On December 31, 2017, the City of Hermosa Beach transitioned fire and emergency transport services to Los Angeles County Fire Department and McCormick Ambulance.

At its February 11, 2020 meeting, City Council modified the frequency of reporting from quarterly to semi-annually, with the inclusion of the call transfer data in the monthly reports. Additionally, City Council requested monthly reports be placed onto the City Council agenda under consent calendar.

On the July 14, 2020 City Council agenda, the monthly reports began to appear. The enclosed semiannual report reflects the services from January through June 2022.

Analysis
Los Angeles County Fire Department (LACoFD) Calls for Service The South Bay Regional Public Communications Authority, known as RCC, is the initial public-safety answering point (PSAP) for police and fire services within the City of Hermosa Beach. When RCC receives a call for service, the dispatcher collects critical data including name, phone number, address, and nature of the emergency. For police related incidents, RCC continues to gather additional information from the caller and dispatches police personnel as necessary. For fire related incidents, the critical data is collected, and the caller is transferred to the Los Angeles County Fire Department (LACoFD) dispatch center. Once received, a LACoFD dispatcher gathers all information needed to dispatch fire and EMS personnel. The critical data is collected by RCC, as a safeguard, prior to transferring the call to LACoFD. Should the call be dropped during the transfer and/or there is a change in the status of the patient calling for assistance, RCC can try to reconnect with the caller and relay the information to LACoFD, who can dispatch resources based on the information gathered. Total call time begins when the call is initiated with RCC to the arrival of units on scene.

From January through June 2021, RCC transferred 355 calls for service to LACoFD dispatch with an average transfer time of 43.74 seconds. For the same time period in 2022, RCC transferred 423 calls for service to LACoFD dispatch with an average transfer time of 44 seconds. Based on the data, there was an increase of 68 calls for service year-over-year during this time period. Attachment 1 provides the RCC call transfer time data for January through June 2022. Attachment 2 provides the average call answer time once the dispatch is transferred to LACoFD for call processing for the same time period.

Table 1 below shows that from January through June 2022, Los Angeles County Fire Department responded to 956 calls for service with an average response time of 4 minutes and 35 seconds. Los Angeles County Fire Department defines average response time as the time that the first-arriving units, which excludes the Lifeguard units, are enroute and arrive at each incident and includes emergency and non-emergency calls. The time necessary to dispatch and the time necessary for the crews to leave the station are not included in the average response time data.

From January through June 2021, Los Angeles County Fire Department responded to 815 calls for service with an average response time of 4 minutes and 46 seconds. Attachments 3 and 4 provide average response times by incident type from January through June 2022.

Automatic Aid
Automatic aid is a critical partnership between Los Angeles County Fire Department and the Area G jurisdictions of El Segundo, Manhattan Beach, Redondo Beach, and Torrance. From January through June 2021, Los Angeles County Fire Department responded 64 times into surrounding jurisdictions to provide automatic aid, while LACoFD received aid 29 times. During the same period in 2022, LACoFD responded 12 times to provide aid and received aid 19 times. Attachment 5 illustrates auto aid responses provided by both the fire district (Los Angeles County Fire Department) and Area G cities (El Segundo, Manhattan Beach, Redondo Beach, and Torrance Fire Departments) from January through June 2022.

Special Events
Station 100 provided station tours for Supervisor Mitchell’s Office and Hermosa Beach Leadership.

The crews also participated in community event activities of the St. Patrick’s Day parade, Fiesta Hermosa, and March for Our Lives. Los Angeles County Fire Department also assisted with the EBike safety video conducted by Hermosa Beach City School District.

Fire Prevention
Los Angeles County Fire Department personnel assigned to Station 100 are responsible for the annual business fire inspection program. Station personnel conduct fire and life safety inspections at the businesses both large and small to ensure compliance with the Fire Code. In 2022, Station 100 conducted 149 business inspections. From January through June 2022, the Community Resources Department and Los Angeles County Fire Department coordinated and approved 12 film permits. Attachment 6 provides detail regarding the film permits issued. Table 3 below provides a breakdown of the permits by month with location information.

McCormick Ambulance
From January through June 2022, McCormick Ambulance completed 375 emergency transports and received 270 calls that were subsequently cancelled. During the same period in 2021, McCormick completed 355 emergency transports and received 218 calls that were subsequently cancelled. Yearover-year, there were 20 more transports completed during the first half of 2022 than 2021.

In addition to providing basic transport data, recent monthly reports have discussed call arrival delays. As discussed in the monthly reports, delay causes include: distance from the dispatched location; multiple calls received at the same time; or extended wait times at the local hospital emergency departments. McCormick Ambulance is working with stakeholders from the hospitals and Los Angeles County Emergency Medical Services Agency (EMS) to develop solutions to decrease patient transfer of care times and ensure ambulance personnel have returned to the field to respond to the next call for service.

While arrival delays for patient transport are a customer service issue that needs to be mitigated, from a critical patient care standpoint, Los Angeles County Fire Department is providing care to patients and ensuring life saving measures are provided in a quick and efficient manner while McCormick is enroute to the patient’s location.

New Staff Member
I’d like to start by sharing that we recently welcomed a new staff member, Gisell Saenz, who is serving as an Interim Building and Safety Technician in the Community Development Department. We’re happy to have Gisell as part of our team.

Water Pipe Survey
This month, employees from Consulting Engineering will be in our neighborhoods to conduct a survey of the more than 200 miles of pipe in the Hermosa and Redondo water systems.

The engineering employees will be wearing bright yellow shirts with the Consulting Engineering logo, and will be carrying documents confirming that they have permission to survey Cal Water’s system. Consulting Engineering employees may open meter boxes or use listening devices on hydrants or valves to conduct this survey. They will not need further access to customers’ property.

Tree Trimming
Along with the engineering specialists, you may soon see some of our public works crews trimming trees, clearing storm drains, and maintaining our sewer system. They are beginning that work shortly, and our City Staff is preparing maps of the areas that will be affected by these activities so that residents and businesses will know when to expect work crews in their areas. You will be able to see those maps on the City’s website, and we will post on our social media to let you know when those maps are available.

Mobi Mats
Continuing our maintenance activities, our public works crews will also be temporarily removing the Mobi Mats on the beach this week so that they can install concrete pads to improve public access to the accessible beach paths. Once the concrete pads are installed, the Mobi Mats will be returned to the beach.

Important Dates
We have some important dates that we want to share with you. The first one is this Saturday, October 29th – That is the start of Early Voting, and we will have an Early Voting Center that will open that day at the Hermosa Kiwanis Club, at 2515 Valley Drive. Director Nichols, Parks and Rec. Commissioners, City Councilmembers and City Manager, Unfortunately I have a conflict and will not be able to speak at this week’s Parks and Rec.

Commission meeting but I wanted to make my feelings known about the lack of summer concerts.

At the last Parks and Recreation Commission meeting I asked what was being done to plan for bringing back the summer concerts. Director Nichols stated that the city is not planning on bringing back the traditional Hermosa Beach Summer Concert Series and that that the concerts that the Chamber of Commerce produces as part of Fiesta Hermosa now fulfill that need for the community.

I am extremely disappointed to hear that the city is not planning on even trying to revive the beach concerts and is relying on the Chamber of Commerce to do this. The beach concerts have been a beloved community activity for years. Everyone that I have spoken to about this has repeated the same thing - Please bring back the summer concerts on Sundays in August with movies on the beach on the Saturdays before.

The Fiesta concerts are great, but they are not the same. There is so much going on during a Fiesta weekend that the community just doesn’t attend in the numbers that they did for the August concerts.

Every candidate for City Council has stated that bringing back the Summer Concert Series should be a priority for the city.

I realize that COVID made the concerts impossible and bringing them back is not an easy task, but it was something that the city was able to do for many years and it is something that the community clearly wants.

Please work with City Council to bring back one of Hermosa Beach’s most cherished summer traditions.

Subj: City Ignored Cannabis Advisory Committee Recommendations In the 10/11 City Council meeting Councilman Massey made a couple of statements in his response to public-comments on Measure M and I believe the public is entitled to an explanation and perhaps an apology.

Councilman Massey clearly implied the City Council had followed the recommendations of the Cannabis Advisory Committee “to a T”.

That seems wrong on 2 fronts:

1. The Cannabis Advisory Committee voted 6-3 FOR the city to offer a second competing Initiative to Measure M; the industry sponsored measure, and yet no competing initiative was offered.

2. The Cannabis Advisory Committee also voted 9-0 AGAINST offering an ordinance for the DELIVERY of cannabis BEFORE the November election; but the city went ahead and passed a delivery ordinance anyway.

I don’t think Councilman Massey’s statements were intentional lies but they certainly seem factually inaccurate.

Clearly the vote record above shows the City Council didn’t follow the Cannabis Advisory Recommendations to a T.

And it was equally sloppy for the other council members to allow these statements to stand without comment, clarification or correction.

Am I to believe the other three Councilmen, the Mayor and the City Manager didn’t know better? Here is the rub:

I believe our City Council thought the residents of Hermosa Beach were too stupid say “NO” to a poorly crafted industry sponsored Cannabis Pot Shop and also have an up/down vote on a more carefully crafted Pot Shop Measure incorporating the safeguards that the Cannabis Advisory Committee provided with their recommendations It seems equally clear that the council was afraid that a carefully crafted Pot Shop initiative might pass;so rather than have that, they used the excuse that a second competing initiative would just confuse the voters.

Then to add insult to injury Councilman Massey went on to say in a classic “Pot-to-the-Kettle-Moment; the miss-information provided by the public during the Measure M public-comment period was “ALMOST COMICAL”.

Given the other Councilmember’s were silent on Councilman Massey’s misstatements; I believe this points to one irrefutable fact; our city needs new blood on the City Council, starting with the November 8 election, where we have the opportunity to elect 3 new Council-members.

There are no free lunches. Someone else, someplace else, has already polluted the planet with massive behindthe-scenes mining and fabrication of raw materials used in windmills and solar panels. Enormous damage is hidden from the public by the time “clean energy” resources show up in a field or on a roof.

CPA uses solar and wind to create its 100% Green Power illusion. These resources are heavily reliant on gasfired power and system power <https://s3-us-west-1.amazonaws.com/themarinpost/doc/2451/CA-systempower_examples.pdf> (“Unspecified Power”) in order to maintain voltage and frequency across the grid. If these back-up sources, known as “resource adequacy” and "spinning reserve" stopped backing up California’s wind and 58 solar the state would experience regular black outs and brown outs. Claims that wind and solar resources are zero greenhouse gas are false to the extent that (i) they heavily depend upon fossil-fired power described above, (ii) large amounts of GHG are emitted in their raw materials fabrication (steel, concrete, resin, mining of metals, etc), and (iii) windmill blades <https://www.bloomberg.com/news/features/2020-02-05/wind-turbine-blades-can-tbe-recycled-so-they-re-piling-up-in-landfills> and solar panels <https://www.sciencedirect.com/science/article/pii/S2211467X19301245> are buried in the ground at end of life, and (solar) toxic to water supplies after burial.

Dear Honorable Mayor Detoy, City Council and Staff,
Re: Keeping the 100% renewable rate.

On the agenda tonight is an item to reconsider the 100% renewable energy. That is the default amount specified when the CCA was approved 5-0 for all the good reasons you articulated in that city council meeting. It would be much easier to go backward and start with 50% renewables and kick the can down the road to another council to change it back later.

But this decision is not academic for Hermosa. We have dirty fossil fuel power plants just north and south of our borders that are spewing pollutants and toxins on us on a regular basis. By choosing 100% renewable, we accelerate the decommissioning of those dirty power plants by making their fossil fuel power less in demand. By choosing 100% we also significantly accelerate our progress to the city’s community-wide carbon goals.

There may be a 3% increase in rates for 100% renewable energy, but what is our children’s health worth? Given that renewable energy far less expensive than generating power with fossil fuels, I suspect that price premium will disappear shortly. Anyone who truly needs financial assistance will get it with the CPA’s generous discounted rate for the economically disadvantaged. Anyone else who is concerned about their bill increase should be informed with their no cost opt-out information that they have several good options. They can:
• buy solar panels to reduce their bill (and get a good ROI) and maybe add a battery for energy arbitrage and backup.
• reduce their consumption (especially between 4p – 9p) with more energy efficient appliances and lighting. • at no cost switch to a lower tier of renewable energy or opt out to SCE.

Most people I know in this community would like to help our neighbors to the north and south reduce the pollution load on their families and would be willing to pay a bit more to do so.

And it is Halloween, the season to have a good scare. Boo! Unfortunately, some members of our community like to scare others with misinformation. They are saying that the CPA will raise your electric bill 25 – 50% as it did in Redondo. First off, that never happened. The change in rates to Time Of Use (TOU)rates just happened to coincide with deployment of their CCA. This was correlated but not causal. We know the difference. A few people with very high power usage from 4 – 9 pm had to adapt to a different plan or change their consumption patterns. The sky is not falling.

Nonetheless, don’t let them scare you into making a bad decision. Hermosa’s health is not for sale. Send that clear message to the dirty fossil fuel power plants by sticking with 100%renewable as the default. Anyone who is concerned can easily opt out for free.

Yes, even Measure-M they technically placed on the ballot. ---- Good grief, it’s a no-brainer that the default should of course be to automatically be opted-out until one chooses intelligently to opt-in. The previous action by the city council defaulted all residents to the 100% green power rate which would have forced every resident a 3% increase in their electric bill. I am pleased that this is back on the agenda for reconsideration.

I suggested strongly at that time that the city default us to a lower base rate that would not increase across the board rates to every resident. Then each resident could opt in to the 100% green rate if they so chose.

I have noted this as a strong point at the city council candidate forums showing my knowledge and breath of this and many other subject areas
far exceeding other candidates.

At the last council meeting, Several people spoke about this issue, but when the city council passed the rates they did not even discuss or consider what people had stated when they spoke addressing their electric rates.

Now that this is back on the agenda I strongly suggest you revise the defaulted rate to a lower tier so that residents are not forced unknowingly to a higher electric bill.

This is the best way to gain consensus and public support for continuing to build on sound renewable energy for 62 our future.

I just wanted to highlight the difference between the Community-wide carbon reduction goal and the City Municipality goal, the latter being more ambitious, along with the flexibility of various opt-in/opt-out possibilities.

This means that even if Council chooses to set the default clean energy level at something less than 100%, it can still direct Staff to have the City Municipal accounts opted-in to the full 100% level to support achievement of that more ambitious goal. Quite a scam your city bought into.

When you look at CPA’s power content label for 100% renewable, no way consumers are getting 70% solar (nor do consumers get 100% solar from SCE’s 100% Green Rate).

CPA is over-procuring inexpensive solar and then selling off the associated energy while retaining the solar RECs.

Then CPA purchases "unspecified power” (system power, which is a mix of gas-fired, coal, nuclear, etc) and delivers that to its 100% Green Power customers like Hermosa.

Notice there is 0% for Unspecified Power under the “100% Green Power” label. This happens throughout the day… we tried to stop it in energy legislation but were unsuccessful.

So the smoke & mirrors is legal.

Quite a scam your city bought into.

I would like to congratulate the city staff, and environmental programs manager Mr Krause. They have done a tremendous job regarding this issue.

I attended the previous council meeting regarding this contract and Many of the issues that were addressed at the last meeting have been addressed.

It does come to question however why it takes a renewal of a contract to get these issues taken care of. And does question why we are not considering going out with a new RFP.

Some of the issues that were addressed at the previous council meeting have not been addressed in the staff report are open dumpsters,
overflowing dumpsters, dumpsters blocking fire lanes and roadways, loud and noisy double haulers, and a switch to electric vehicles. Also, going forward what type of complaint system is in place where there is accountability.

This, and other issues that may come up in the future have not been adequately put together in some form of complaint system so going forward the community knows how to voice its problems when it comes to street sweeping and trash hauling issues. the contractor must be held accountable for it.

1. City staff must overwhelming demonstrate to the council that the benefits of NOT bidding out this large contract outweigh the benefits of bidding. The default should be to bid.

2. This is a real big contract. If the city is not going to bid it out it would be best to respect the upcoming election and defer a decision until the new Councilmembers can weigh in.

A new set of eyes can’t hurt.

This is a no brainer. Another railroad-job of a major, major contract two weeks before the council election. How outrageous once again this incredibly-dishonorable City Council / Suja Lowenthal operation is. This massive 10 to 20 year city-wide trash collection and street sweeping contract needs to go out for bid via Request For Proposals 64 (RFPs). ____NP____
With all due respect, the very idea that a Hawthorne resident, the "environmental programs manager" operating right under the nose of City Manager Suja Lowenthal’s ever-more-bloated city-manager office-bureaucracy, is to be negotiating with Athens, a private company, and I assume their main, guy Mr. Gary Clifford probably one of the sharpest negotiators in he country, is beyond crazy ludicrous. ____NP____ 10 years ago I remember well when Mr. Clifford stated in Council that Athens was “going to knock our socks off” with performance. Now we have three sets of incredibly noisy trucks tearing up the street pavement slamming down their plastic wheel noisy trash carts every trash, all day long. Why can’t there crappy carts have rubber wheels?
Anyway it's like an ant negotiating with elephant, the “environmental programs manager” negotiating with Mr.

Clifford, who does this year-in and year-out with cities all over. We’ve already seen how the residents and businesses got snookered with the organics racket by this City Council’s laziness. ____NP____ If it's such a great deal that Mr. Gary Clifford and Athens is to be offering, and with virtually no input from the residents and businesses who will be paying the bills for the next 10 to 20 years, Mr. Clifford and Athens can submit their great, great offer when three to five other major trash operators get to bid on this incredibly lucrative plum of a contract for a trash company, that is Hermosa Beach. ____NP____ The comparisons of all the other cities presented in the staff report is ludicrous. That’s comparing apples and oranges. This city is only 1.3 square miles, all packed in for efficient trash pickup. It’s a an incredible lucrative plum and if it isn’t put out to bid you will have to wonder who’s been corrupted in city to not want to put it out for bid as every sane city would do. And note the cost for a good RFP process will be borne by the winning bidder. ____NP____
In my view a city council, and city manager that claims we are getting the best bid by not bidding is smoking something, or are just too lazy to go through the proper bid process or there’s some flat out corruption taking place. ____NP____

I believe in participatory democracy and agree all resident opinions are important for consideration. However, I also believe that we elect leaders to lead, and they should be in a better position to understand the nuances of city management. They are not a "lame duck" council or part of a nefarious conspiracy. I suspect there may be a reason to seek decision now due to private personnel issues - vs. a "corrupt agenda" to rush something before an election.

The salary increase (which looks to be about 25K for past year and also for next year if I'm reading correctly, or about a 10% increase) does not appear unreasonable compared to other city managers receive in the area with my brief search. It is more difficult to find the contract durations - but I assume the city has that data when proposing this. I noticed 1 year (some with auto renewal terms), up to a 5 year term. My impression of Suja at council meetings and at in person meetings I've attended, is that she is extremely competent and cares about the city and doing a good job. I do appreciate the concerns of many regarding changing the standard to fire her from simple majority to 4/5 vote. However, one would think if there was an objective just cause to do so, it would not be difficult to achieve that vote. I have my own assumptions why our manager may feel she needs that level of security, but look forward to hearing the discussion of our representatives as to why that may be appropriate - if in fact they do agree it is.

To summarize - I am 95% in SUPPORT, but I do want to hear staff and council discussion re: reasons for the extended term and change in termination criteria. Maintaining good management and the stability of our city administration is what is most important to me.

It is outrageous what the three outgoing councilmembers (Ray, Stacey and Mary) are doing by usurping the decision-making power of the three new councilmembers that will be elected in about 2 weeks before they even get elected. Dear Mayor, Council Members, and Staff – I have noticed a substantial amount of community interest (53 written comments) unlike the other items regarding the City Manager Contract Agreement that is currently listed as the last item under Municipal Matters. I would like for you to consider moving this item to earlier in the evening so more community members could participate in this very important agenda item.

After reviewing the Staff Report, I have questions regarding the rationale for changing the voting requirements for the removal of our City Manager to 4/5 Supermajority. According to our Municipal Code 2.12.110 under City Manager, the “Removal – Vote Required – Notice of Intention to Remove” shall be only upon a three-member vote of the whole council. With this agreement change, are you revising our Municipal Code to reflect this amendment? If our Municipal Code is not being modified, what are examples to demonstrate the difference in voting procedures? Without understanding the rationale behind this change I cannot support this provision in the agreement.

In order to adhere to PLAN Hermosa's Governance Element providing a high degree of transparency and integrity in the decision-making process we need to understand how this change will provide a long-term community benefit while representing our entire residential community.

The City Council is once again forgetting or willfully ignoring that the residents of Hermosa Beach rightfully occupy the top of the City’s organizational chart.

Our residents elect the City Council to represent the interests of the electorate, the chief of those interests being that the City is well-managed. If the City ceases to be well-managed, the residents must have an assurance that their elected officials can make a change.

Q: For city manager positions, what is the benchmark (median for similar cities) for:

Q: If there is a difference, which can be OK, what is the rationale? Q: For materially new, non-recurring contracts with Total Contract Value (TCV) over $1 million (CapEx or OpEx), wouldn’t a better practice be to give the constituents a few weeks to digest the components, understand, and buyin? What is the rush here? Note, I am marking “oppose” because I oppose with my current understanding. I would be glad to change to support with reasonable answers to the above.

There are two conditions of the proposed City Manager contract that undermine the leverage of City Council to assure and incentivize City Manager performance and responsiveness to the entire Council and the people of Hermosa they represent. They must be changed as follows. 1) The length of the contract should be appreciably less than the proposed 5 years, to expire roughly mid-way through the next Council term, which is about 2 years from now. 2) A simple 3-2 Council majority should be retained, instead of the proposed 4-1 supermajority, as the hurdle for Council to terminate the City Manager without cause.

Regarding contract length, the incoming City Council must be afforded an opportunity within their term to reevaluate City Manager with the option to retain or dismiss without the prospect of severe contract penalties and constraints looming. Lack of such opportunity would be inconsistent with the principle that the City Manager works for, and reports directly to, City Council (and by extension is also accountable to the people).

The proposed 4-1 supermajority to terminate without cause violates the democratic principle of majority rule since only two City Council votes to retain the City Manager would be needed to avoid termination. Furthermore, a mere 40% “customer satisfaction” rating (2 of 5) is a very low standard for anyone to keep their job. The goal should be 100% here, with perhaps 80% more realistic in some cases. But even 60% is quite low, let alone 40%. (Note also that a supermajority scenario whereby 3 out of 5 votes lose is effectively equivalent to a simple majority scenario where 3 votes out of 7 lose. It is as if there was a 4-3 majority to retain, where the City Manager has the additional 2 votes (in addition to 2 Council votes to retain), twice as many as any one Council member.)
The two proposed conditions could significantly upset the balance of power between the City Manager and Council, and even within the Council. For example, if two Council members were to align with each other (and the City Mgr) and assure the City Manager no threat of termination without cause, this minority could wield undue influence within our City government (despite the need for three votes to approve formal Council motions).

It is the City Manager, not City Council, who has direct control over the entire City Staff, runs day to day operations, and approves the Council meeting agenda Staff reports whose input and recommendations significantly drive the resulting actions and approved motions of Council. For these reasons and others, a proper balance must be maintained.

I appreciate the continuity of service provided by the current City Manager to date, and the desire to maintain such continuity and stability, given our recent history with City Manager retention. But this does not outweigh my concerns otherwise. We must adhere to our principles.

So please heed my two recommendations above.

As a city council candidate, I am absolutely opposed to this proposal for the city managers contract renewal.

It is the wrong thing to do and the wrong time to do it.

First, to clarify, my opposition has nothing to do with our current City Manager, but rather about the long term management and oversight of the position itself. I cannot speak to competitiveness of the employment contract value itself (salary, benefits, 5-year guaranteed term) - it seems a bit rich to me, but I do not know enough about the "going rate" for a job position like this so I'll leave that part to others. The furor over the City Manager’s new contract is completely ill conceived and illogical (some are mean spirited!).

From a total compensation perspective, the new contract in Hermosa averages about $360K. By comparison, following are City Manager total compensation averages from 2020 or 2021: Manhattan Beach $385K, Redondo Beach $363K, El Segundo $416K. Note that these will likely increase, perhaps substantially, over the next five years.

As far as waiting for the new members of the City Council to be in place to approve the new contract, it makes sense to have current Council members who have worked with Suja over the last number of years to vote, rather than those who know nothing about her value or skills.

Suja has been, at best, controversial since she was hired. She has shown hostility to any resident or business owner that challenges her on even the most simple of topics. Please vote no on the imposition of a 5 year contract for the City Manager. There are more appropriate ways to reward City employees for a job well-done (if that is in-fact the case).

Also, an action like this does nothing to reduce the potential for voluntary termination on the part of the City Manager.

Please also vote no on the proposed change to require more than a simple majority vote for City Manager termination.

There is no justification from the citizen's viewpoint to provide either of these proposed protections to the City Manager.

I am dismayed to read that a City Manager contract decision is being made right before new council members arrive.
82 This has nothing to do with Ms. Lowenthal personally, just that long term staff decisions should not be made when (potentially) over half the council could change. The council people voted in in Nov should decide as that’s who the community feels they want to make decisions for the city.

I also disagree strongly that a City Manager contract is longer than the majority of the council members will be on it—thus actually affecting two cycles of council people.

Please do not vote for a 5 year contract.

I strongly oppose the changes to the city manager’s contract. This reeks of corruption in this council’s final few weeks in power. Changing from a simple majority to a 4/5 vote to remove the city manager undermines future councils and has no true basis to be changed other than for the current council to cement the contact in their final days of 5/0 votes. If Suja is doing such a great job, why such extreme measures to make it so hard to remove her if she fails to meet the needs of our city?

In her 4 years she has made some incredible department head hires with police Chief Paul LeBaron, Deputy City Manager Angela Crespi, Public Works Director Joe SanClemente, Community Development Director Jeannie Naughton and made a terrific promotion of Lisa Nichols to Community Resources Manager. She led the city through the pandemic with the downtown configurations for dining decks, pivoted to online city services, and did all this while freezing 12 open positions.

Her contract was up in August, it seems reasonable to have a 5 year contract to continue the city’s path of stability and growth. There’s a new council every 2 years. It makes no sense to only do employment contracts every other year to avoid an election year. The current council knows her performance the best.

After 4 years of stellar performance in Hermosa Beach, Suja can work anywhere. We need to retain talent. We don’t want to become the city who can’t retain a city manager for more than 4 years. Then we’ll have a very real 83 hiring problem for the next city manager.

If I got it correct the previous two city manager contracts with Ms. Lowenthal only required a majority of council members to terminate the city manager contract. That would be a 3-2 vote.

It’s outrageous that someone is manipulating the process to to require 4 out of 5 council members and not a simple majority (3-2) to terminate the contract.

It is really a fundamental attack on the representative democratic process. What public interest is served by this change and how did it come to be?
I suspect that since this action at the very end of the agenda it won’t come up until very late in the night and that’s no accident either. It minimizes public participation and scrutiny.

Someone should also ask for the total compensation not just the city manager salary.

It’s probably buried somewhere in the supporting documentation but total compensation should be a headline item not a buried byline.

And once again all this goes to a pattern of minimal transparency from our city leaders that has been discussed 84 so often but not addressed
That’s why we need new blood on the city council.

What a slap in the face of Hermosa residents! I cannot believe that the City has come this far to counter the upcoming City Council election and suppress the voice of our voters.

Why is it necessary to extend the City Manager’s contract from year-to-year to 5 years!? It is somehow conveniently timed right before election and with a contract duration that exceeds the newly elected Councilmembers’ terms (of 4 years). Why is it necessary to change the City Council’s ability to terminate such contract from simple majority (3/5) to super majority (4/5)? To my knowledge, super-majority has only applied to tax and fee related matters.

Tenured City Councilmembers and newly elected City Councilmembers are expected to collaborate together to find common-ground on city policy, municipal problems/projects and how to best govern our small-beach city. This proposal can be considered corrupt, unethical and acting in bad faith to our community. I would not be surprised if passed, the City would receive a black eye in its reputation, media scrutiny and litigation. I strongly urge the City Council to reject this proposal.

It smacks of impropriety for the Council, now, on the eve of an election, to hand a friend near-invulnerable status through the next three elections.

Beyond the bad optics, this proposed action ignores the reality that the management of the City, and accordingly, the performance of its City Manager, is rightly a matter up for debate and voters' judgment at every election. A contract that restricts the powers of future councils to carry out their mandate from voters, makes that debate moot. As such, it is contrary to notions of representative democracy and good government.

I urge that the Council not approve the proposed contract amendment for the City Manager.

Never, in my nearly 30 years of living in Hermosa Beach, have I ever witnessed such a corruption of our local government. Hermosa Beach is rapidly emulating the City of Bell, whose corruption extended from the City Councilmembers to the City Manager and the City Attorney. In that instance, they were all in cahoots – doling out pay raises and sweetheart contracts to each other, without a care in the world. How else did the City Council of the City of Bell behave? Dismissive and disinterested in the views of their residents. Sound familiar? As per 85 Justin Massey: “if we had to wait for a vote of the people, we would never get anything done”. Justin Massey regularly disparages and dismisses residents who speak up at council meetings and dare to push back on his agenda. Why would he care now what we think? The idea that you as our Councilmembers plan to lock in the City Manager to a 5 year contract at a total cost of $1.3M, hamstring a future City Council who would be unable to terminate her without cause without a 4/5 vote of a City Council is the height of corruption. You all behave with reckless disregard for our interests. Also, you put this last on the city agenda, forcing all of us to sit in chambers until what time – 1am? Again, this has been done purposefully and smacks of corruption. My prediction is that Justin, Stacey and Mary will vote yes. They will give Ray a pass to feign indignation, knowing that a 4th vote is unnecessary. The three are not concerned about Mike Detoy’s vote because it is not needed. I advise every resident now: Do not vote for Ray or Rita when you cast your vote! Rita has been endorsed by every councilmember and will perpetuate our current circumstances. Ray has been complicit in all of the above.

FINDINGS TO HOLD REMOTE TELECONFERENCE/MEETINGS,
PURSUANT TO ASSEMBLY BILL 361

Recommended Action:

Staff recommends City Council authorize remote teleconference/virtual meetings of all City of Hermosa Beach legislative bodies in accordance with Assembly Bill 361 (“AB 361”), by finding that:
(1) a statewide state of emergency is currently in place; and (2) state and local officials have imposed or recommended measures to promote social distancing in connection with COVID-19; and meeting in person would present imminent risks to the health or safety of attendees.

Background:

All meetings of the City’s legislative bodies are subject to the Ralph M. Brown Act (Gov. Code §§ 54950 et seq.) and must be open and public so that any member of the public may attend and participate in the meetings. Commencing in March of 2020, Governor Newsom issued a series of executive orders aimed at preventing the spread of a respiratory disease that came to be known as the novel coronavirus, “COVID-19.” Among these were Executive Orders (“EO”) N-25-20, N-29-20, and N-35-20 (collectively, the “Brown Act Orders”) that waived the teleconferencing requirements of the Brown Act to allow legislative bodies to meet virtually.

On June 11, 2021, the Governor issued EO N-08-21 to begin winding down some of the prior measures that were adopted to respond to COVID-19. Notably, EO N-08-21 rescinded the Brown Act Orders, effective September 30, 2021. On September 16, 2021, Governor Newsom signed AB 361, which became effective October 1, 2021, and amended the Brown Act to allow legislative bodies to meet virtually, without following the Brown Act’s standard teleconferencing rules, provided that the legislative body makes specific findings, which include the following:

1. A statewide state of emergency is currently in place;

2. State or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19; and/or

3. Meeting in person would present imminent risks to the health or safety of attendees.

Continued compliance with AB 361 would require City Council to approve the action making the required findings at least every 30 days.

Discussion:

All three findings under AB 361 can be made given the current circumstances. The Governor has proclaimed a state of emergency in response to the ongoing COVID-19 pandemic. The state of emergency currently remains in effect.

Further, State officials, including the California Department of Public Health, have recommended measures to promote social distancing in connection with COVID-19, which are currently in place. Similarly, local officials, including the County Public Health Officer, have also recommended measures to promote social distancing in connection with COVID -19. In a recommendation dated September 28, 2021, the County Public Health Officer stated that “utilizing teleconferencing options for public meetings is an effective and recommended social distancing measure to facilitate participation in public affairs and encourage participants to protect themselves and others from the COVID-19 disease.” Finally, the City has determined that meeting in person would present imminent risks to the health or safety of attendees. Accordingly, all of the above-referenced AB 361 findings currently exist.

If City Council thus desires to allow virtual meetings in order to both ensure the health and safety of the public, the legislative bodies of the City, and City staff, as well as continuity of government in allowing regularly-scheduled meetings to continue to occur without interruption, staff recommends City Council authorize virtual/teleconference meetings by making the findings set forth above.

Alternative:

If City Council does not make the findings pursuant to AB 361, the City would have to conduct its public meetings for City Council and other public boards and commissions in person and not have the option of conducting its meetings via teleconferencing.

Fiscal Impact:

There is no fiscal impact associated with the recommended action.
