9. PUBLIC COMMENT
Public Comments

Dear Mayor Francois
Dear Councilman Saeman
Is it true that all it would take to reinstate zoom remote general participation AND restore the 3 minute speaker time is a motion, a second and majority approval; albiet it might have to be done on a meeting by meeting basis until a permanent resolution could be agendized? Seniors and your immunocompromised constituents who legitimately fear covid, RSV and the flu are being denied their opportunity to be heard publicly and this is simply wrong and serves no legitimate public interest. see details below:

https://pub-hermosabeach.escribemeetings.com/FileStream.ashx?DocumentId=2807 anthony higgins
This is the time for members of the public to address the City Council on any items within the Council's jurisdiction and on items where public comment will not be taken (City Manager Reports, City Councilmember Comments, Consent Calendar items not pulled for separate consideration, and Future Agenda Items).

The public is invited to attend and provide public comment. Public comments are limited to two minutes per speaker and shall only be taken from those present in City Council Chambers. No remote public comment will be taken during this time unless required by the Brown Act. A total of thirty minutes will be allocated to this initial public participation item. This time allotment may be modified due to time constraints at the discretion of the Mayor or City Council. Another period is also reserved for general comment later in the meeting for those who could not be heard at this time.

No action will be taken on matters raised during public comment, except that the Council may take action to schedule issues raised during public comment for a future agenda. Speakers with comments regarding City management or departmental operations are encouraged to submit those comments directly to the City Manager. Members of the audience will have a future opportunity to speak on items pulled from the Consent Calendar for separate discussion, Public Hearings, and Municipal Matters when those items are heard.

Laura Pena
Dear City Council Members and Staff,
I would like to thank our city staff for placing this important item on the agenda tonight so we can discuss potential solutions in response to the recent wildfires in Los Angeles County. As of today, approximately 88,000 residents remain under evacuation orders, with an additional 84,800 warned of possible evacuations. Furthermore, due to high wind warnings, power companies have implemented outages affecting 90,000 households.

In light of this crisis, we have a unique opportunity to play a significant role in supporting those affected by adopting an urgency ordinance to temporarily allow and regulate short-term rentals (STRs). This initiative, in partnership with FEMA, Airbnb, and 211.org, would provide critical temporary housing for wildfire evacuees.

For those who may question why we should allow short-term rentals when long-term housing is also needed, I would say we need both. As someone who has personally experienced a devastating wildfire and had to evacuate my home, I know firsthand how vital it is to have options. It is critical that we come together as a city to provide assistance where we can. Many second homes in our city are currently empty or underutilized. Adopting an urgency ordinance can provide an immediate solution by enabling property owners to offer STRs to those displaced by the wildfires.

To ensure responsible management and community support, the proposed ordinance could include:
- Permit requirements for STR operators.
- Incentives for hosts offering reduced or no-cost stays for wildfire victims. - Safety and occupancy standards to protect both property owners and renters. - A sunset clause to limit the ordinance’s duration (e.g., six months) with an option for extension based on need. - Anti-price gouging provisions to prevent excessive rates during the emergency. The ordinance could cap rental prices at fair market rates to ensure affordability for displaced families and penalize any property owners found engaging in price gouging.

For additional support, FEMA provides funding for temporary housing through programs such as Transitional Sheltering Assistance (TSA) and Individual Assistance (IA). By partnering with FEMA, our city could provide assistance for approved STR stays. Additionally, Airbnb’s Open Homes Program connects hosts offering free or discounted stays with people displaced by disasters. Promoting this program locally could increase participation among property owners.

Another valuable resource is 211.org, which is a vital service for connecting residents with housing and other emergency resources. By integrating 211 services into our city’s emergency response system, we can collaborate on case management services for displaced families seeking temporary housing and ensure real-time updates on available STRs and other resources.

To encourage participation from property owners, we could:
- Waive permit fees for STRs providing temporary housing to wildfire victims. - Expedite the permit approval process to ensure swift deployment of housing.

If the city needs volunteers throughout this effort, I would be glad to step up and help in any way I can. I believe we can do more, and this initiative would not only address the immediate housing crisis but also position Hermosa Beach as a leader in regional disaster relief efforts.

Thank you for your attention to this critical matter. As always, I appreciate your thoughtful consideration.

Based on my read of pages 7-8 of attachment 1, it sounds like for the 2025 Residential Parking Permit program, the new system from Turbo Data will replace the Duncan system for residents to request their permits. Given the projected go-live of the Turbo Data system - April 1 - this will definitely be very close. Hopefully some buffer is already built into the Turbo Data timeline? Either way, I'd recommend the city be prepared for residents to apply in-person for parking permits...people will get anxious as they are used applying in February.

Laura Pena
Dear City Council Members and Staff,
I am writing to express my concerns regarding the proposed parking management system and to seek clarification on several important issues before the City moves forward with this initiative. While modernizing our parking infrastructure can provide significant benefits, I believe it is essential to address potential privacy risks, compliance with the California Consumer Privacy Act (CCPA), and operational details to ensure the system is both effective and equitable for all residents, businesses, and visitors.

One of the primary concerns involves the use of Automated License Plate Reader (ALPR) technology. The collection and real-time transmission of license plate data to the Real Time Crime Center (RTCC) raise significant privacy issues. Under the CCPA, residents have a right to know how their personal information is being collected, stored, and shared. If you could please address the following concerns:

1. How will the City ensure compliance with the CCPA regarding the use of ALPR technology?

2. What data retention policies will be in place to protect residents' privacy?

3. How will the City handle requests from residents to access or delete their personal data collected by the system? Additionally, I would appreciate answers to the following operational questions:

1. Training for Non-Tech Users: I understand that single-space meters will receive small stickers with a QR code, text-to-pay option, and support information. What options will be available for users without smartphones?

2. Customer Service Hours: What are the standard operating hours of the ParkMobile vendor in case customers want to speak with a representative? In attachment 2, Exhibit A mentions "free online and telephone customer service support for users and City staff," but it does not specify hours for live customer service.

3. Employee Permits: I do not see employee permits referenced in the Parking Permit Management System. How will employees of downtown businesses be able to use this system?

4. Pre-Purchase of Parking: How does the feature allowing users to "purchase and pre-purchase parking session time" affect the 5-minute grace period in the 24-minute green spots in our city?

5. Discount Codes or Coupons: How can the City and businesses utilize discount codes or coupons for users?

6. Reservation Parking Services: Can you explain how the optional reservation parking service works and what operational steps would be required to implement it at a later date?

7. ALPR Costs and Implementation: How does the cost of implementing an ALPR system compare to replacing all single-space meter infrastructure?

8. ALPR Privacy Concerns: How will you communicate to our residents and businesses regarding the concerns some may have associated with CSOs driving around Hermosa Beach collecting license plate data and sending it to the RTCC for use in police operations?

9. Maintenance Costs: What are the estimated maintenance costs for an ALPR system with real-time integration into a crime center, considering hardware, software, and personnel requirements?

10. Handling Errors: How will errors in license plate recognition systems be addressed, particularly when they result in incorrect citations or unwarranted police actions? Given the potential implications for privacy, user experience, and cost, I urge the City Council to carefully consider these questions and ensure that adequate safeguards are in place. Transparency, robust privacy protections, and clear communication with residents and businesses are critical to the success of any new parking management system.

As always, I appreciate your thoughtful consideration.

No one doubts that most staff has the best interests of HB residents when it comes to setting CIP project priorities.

But the city council meeting schedule last year did not provide the council an adequate opportunity to set project priorities in the 2024 CIP Study Session and that needs to change in 2025.

See above PDF.
