Dear City Council
I am having trouble finding any reference to a legitimate first reading of ORDINANCE (24-1483) or its accompanying RESOLUTION (24-7463) despite tonights staff report saying this occurred in the November 12, 2024 City Council meeting The 1/28/2025 Consent Calendar Agenda item (15L) staff report says:

Executive Summary:

At its November 12, 2024 meeting, City Council introduced on first reading an ordinance repealing Section 3.08.020 of the Hermosa Beach Municipal Code, and adopted via resolution a litigation management policy which, among other things, increased the City Manager's settlement authority for claims against the City. This is the second reading to formally adopt the ordinance repealing section 3.08.020. https://pub-hermosabeach.escribemeetings.com/filestream.ashx?DocumentId=7563 But the Nov 12, 2024 CCM meeting minutes DO NOT record a vote on this ORDINANCE or the accompanying RESOLUTION, indicating the council was never polled and a vote never occurred.

I sent staff 3 emails on this but neither staff nor the city attorney responded.

The fundamental question is do ORDINANCES and RESOLUTIONS require a specific council vote for approval? CA Government Code 36936 says RESOLUTIONS, orders for the payment of money, and all ORDINANCES require a recorded majority vote of the total membership of the city council and there is no record of this vote or even a public hearing in the November 12, 2024 CCM Minutes.

Government Code 36936:
https://leginfo.legislature.ca.gov/faces/codes_displayText.xhtml?lawCode=GOV&division=3.&title=4.&part=2.&chapter=2.&article=2.#:~:text=Resolutions%2C%20orders%20for%20the%20payment,membership%20of%20the%20city%20council.

Does Hermosa operate under different city ORDINANCE & RESOLUTION approval rules? If not, then i guess the council need to go back and vote on this before approving this ordinance and the accompanying resolution.

The Nov 12, 2024 agenda item (15i )staff report goes on to say:

To introduce by title only and waive first reading of Ordinance ORD-24-1483 of the City of Hermosa Beach, California, repealing Section 3.08.020 of the Hermosa Beach Municipal Code; and adopt Resolution RES-24-7463 to increase the settlement authority of the City Manager for General Liability and Workers’ Compensation Claims to meet statutory limits set forth in Government Code §935.4 and to adopt a litigation/claims management policy.

The problem here is that RES 24-7463 bolded above was not included in either the Nov 12 2024 (15i) or the January 28, 2025 (15L) agenda item attachments; so exactly what was being approved? Where is RES 24-7463 and why is it not includes with Agenda item 15I? Was it the second attachment it agenda item 15i identified as RES 24-xxxx actually RES 24-7463? And if this was the approved resolution then why is the actual council vote tally on it not included in the November 12, 2024 CCM minutes below? https://pub-hermosabeach.escribemeetings.com/Meeting.aspx?Id=40ee3a36-dbd9-41ee-92fa-51152432dc76&Agenda=PostMinutes&lang=English Finally this whole thing got off on the wrong foot.

The public notice on the ordinance said it would retract the city managers settlement signing authority.

It said nothing about increasing it!
It was only when you read the actual ordinance you found out the goal was actually to increase the city managers settlement authority.

Thank You,
tony higgins

Giving access and priority to community-based recreational leagues is critical to counter the prevailing youth sports trend towards ever more exclusive, profit-driven organizations. It's admirable to see 3 years of commitment between HBLL & the City for use of Clark Field.

CEQA:

Approval of the proposed agreement would be exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15304. The agreement permits an annual youth baseball program with a minor, temporary use of land. This program will have negligible or no permanent effect on the environment. Scott Hayes
Here is your comment: While I have been a very vocal opponent to STVRs in all areas outside the commercial zones, allowing them for those directly affected by the recent fires makes some sense. I believe that this should be for a period of no more than 60 days as the need for short term accommodations should be over by then. Additionally, I do not think that any administrative permits for should be issued to any property that has had a previous citation for having an illegal STVR. Those that have ignored the City’s STVR ordinance should not be able to now profit from the City’s relaxing of the regulations in response to this tragedy. On a related note, I did a quick search on AirBNB this morning and I was able to find over 100 properties that were offering stays in Hermosa Beach of less than 30 days. While some of these are in the commercial zone and are properly permitted, the vast majority are not. With minimal time and effort, I was able to identify the addresses of many of these properties. If I can identify them, the City’s compliance company should also be able to identify them. I am not sure if the inability to prevent illegal STVRs is a failure by the company that the City has hired to check compliance, a failure to enforce once properties have been identified, or if the property owners are actually getting cited and they just don’t care? I would like to see the City take a more active role in eliminating the illegal STVRs from our City.

Todd Tullis
It is the right thing to do to remove barriers to housing those displaced by the fires; this may have a side benefit of filling otherwise vacant properties (how many do we think we have in the City?). I am uncertain that those affected will actually take up short term rentals or the vehicle exemptions included in the urgency ordinance (versus looking for longer-term arrangements)...but at least we can provide the option.

3. 17 B. Residential Parking Program Update- January 28 2025 Council Meeting.pdf Todd Tullis
The changes made to the RPP for the 2024-25 year were appropriate in service of the goal of minimizing "abuse" of residential permits by those who really do not need them. The numbers published for the year bear this out (reduction in permit quantities vs 2022-23). Assuming costs of administration are not materially different than past years, I am in favor of letting this program play out as is for at least 1-2 more years.

Regardless of changes, we MUST hit the April milestone for permit sales - we don't want to lose out on a few hundred thousand dollars of revenue as in 2023-24.

As a member of the Civic Facilities Community Advisory Group, I find it short-sighted that options that have been on the table for the past decade (through 3 city managers and 5 city councils) would be disregarded before funding and financing discussions. Removing an option from consideration would not expedite the process. If development on community center property proves to be a poor option after thorough vetting, then that option should be dropped at that time, but to drop it now would be imprudent. We are at a pivotal point in our city’s history to make the best possible decision that will impact the delivery of government services to our community for the next 50-80 years. Lets do it wisely.

Todd Tullis
This problem has so many interdependencies, eliminating such a large land area deeded for civic uses will remove some flexibility that may be needed to craft a recommended solution.

Although initially I thought eliminating any options east of Valley would simplify (generally a good thing!); my position changed after last week's stakeholder meeting which helped me understand the various facilities being considered to be in scope and the many many potential constraints at play (operational/logistical, regulatory, revenue).
