SUBJECT:
Discussion on Supporting Legislation that Limits Gubernatorial Emergency Orders Authority to a Designated Timeframe Unless Extended by an Act of the Legislature
RECOMMENDED ACTION
It is recommended that the City Council discuss supporting legislation that limits gubernatorial emergency orders authority to a designated timeframe unless that timeframe is extended by an act of the legislature.
BACKGROUND
At the October 5, 2021, City Council Meeting, Mayor Pro Tem Holland requested a discussion item be agendized regarding supporting legislation that limits Gubernatorial authority to issue Emergency Orders.
ISSUES/ANALYSIS
In response to the COVID-19 pandemic, Governor Newsom issued a stay-at-home order and designated certain businesses and faith-based organizations as non-essential, prohibiting them from normal operations. Those businesses deemed essential by the State of California were allowed to operate with modifications that provide for social distancing and increased disinfection procedures, as appropriate. Additionally, emergency orders were issued mandating facial masks be worn and stipulations issued on capacity limits for all organizations and events in California. Numerous modifications to these emergency orders have been made since March 2020.
In California, there is currently no legislation in place to terminate Gubernatorial Emergency Orders or otherwise restrict a Governor’s authority to regulate County/City public health decisions. As a result, these orders can be extended and modified indefinitely.
