SUBJECT: Contract with Badger Meter Inc.
RECOMMENDED ACTION
It is re commended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter into a one (1) year agreement with Badger Meter Inc. in a total not-to-exceed amount of $275,000, for the purchase of water meters and related water meter parts.
BACKGROUND
The Hesperia Water District has standardized various services and repair products in order to minimize the need to stock multiple products and to simplify installation processes. Badger water meters are one of the products the District has standardized and is the direct distributor in Southern California for Badger water meters.
ISSUES/ANALYSIS
Badger water meters interface with the cellular endpoints used for automated meter reading, and with Badger's Beacon automated metering analytics software. This contract to purchase Badger water meters will allow the Customer Service /Meter program to continue with the meter rotation program. An estimated 1,200 meters will be replaced in Fiscal Year (FY) 2022-23 continuing with the ongoing implementation of the advanced automated meter reading system. This will also allow for the purchase of Badger water meters and miscellaneous replacement meter parts for the purpose of new service installs and the maintenance of existing services.
FISCAL IMPACT
Sufficient funding will be included in the FY 2022-23 Proposed Operating Budget.

SUBJECT: GP Electric Motor Contract Amendment
RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Water District (District) authorize the City Manager to approve an amendment of $30,000 to the existing contract with GP Electric Motor, for a total revised not-to-exceed amount of $ 130,000, and approve a one -year contract extension for well motor maintenance.
BACKGROUND
Electric motors that operate the water and waste water pumps require proactive or reactive (emergency) repairs throughout the year . Having reliable electric motors will ensure that the District maintains adequate system pressure within its distribution system and wastewater lift station. The proactive and reactive repairs will also greatly reduce the possibility of a water service outage throughout the City. In April 2019, the District conducted a request for bid for well motor maintenance and GP Electric Motor was deemed the lowest responsible/responsive bidder.
ISSUES/ANALYSIS
The current contract with GP Electric Motor expires June 30, 2022, and a contract extension is needed to continue to provide well motor maintenance. City staff has been satisfied with the vendor’s work under the current contract and GP Electric Motor has agreed to maintain pricing for an additional year.

SUBJECT: D&H Water Systems, Inc. - New Contract
RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Water District authorize the City Manager to enter into a one (1) year agreement with D&H Water Systems, Inc. in a not-to-exceed contract amount of $51,000, for the purchase of Constant Chlor Plus Briquettes.
BACKGROUND
The Hesperia Water District disinfects the water that is pumped from the ground to control microbial contaminates and comply with State and Federal water quality regulations, which are set by the State Water Resources Control Board (SWRCB) and the Environmental Protection Agency (EPA). Chlorine is used to disinfect the ground water and is treated at eac h well site .
The required chlorine residual is 0.2 to 4.0 parts per million (ppm) and the District has continued to meet these standards with an average of 0.25 ppm as stated in the District’s 2020 Consumer Confidence Report.
ISSUES/ANALYSIS
The chlorinators at each well site are designed to use a specific chlorine tablet, which are the Constant Chlor Plus Briquettes. These are supplied by D&H Water Systems, Inc., who is the sole distributor of this product.

RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Water District (District) authorize the City Manager to approve an amendment of $20,000 to the existing contract with Duthie Power Services, Inc. for a total revised not-to-exceed amount of $ 70,000 and approve a one -year contract extension for generator maintenance.
BACKGROUND
The backup generators that supply power during planned or emergency electrical outages require proactive or reactive (emergency) maintenance and repairs throughout the year. Currently, the District oversees the maintenance of six (6) generators located throughout the City, which include well sites, sewer lift station, City facilities , and the Police Department. The maintenance and repairs are needed to ensure District customers are provided positive water pressure to their residences or businesses and for City facilities to continue operations during a power outage. In April 2019, the District conducted a request for bid for generator maintenance and Duthie Power Services, Inc. was deemed the lowest responsible/responsive bidder.
ISSUES/ANALYSIS
The current contract with Duthie Power Services, Inc. expires on June 30, 2022, and a contract extension is needed to continue to provide generator maintenance. RECOMMENDED ACTION
It is recommended that the City Council authorize the City Manager to approve an amendment of $62,000 to the existing contract with Lawnscape Systems, Inc. for a total revised not-to-exceed contract amount of $ 234,376, and approve a one -year contract extension for weed control and abatement services.
BACKGROUND
The Public Works Traffic program is responsible for maintaining the growth of weeds along City roadways, which include dirt shoulders, center medians, and curb areas. This is to minimize any obstructions on the roadways caused by overgrown weeds. In April 2019, the City conducted a request for bid for weed control and abatement services and Lawnscape Systems, Inc. was deemed the lowest responsible/responsive bidder.
ISSUES/ANALYSIS
The current contract with Lawnscape Systems, Inc. will expire on June 30, 2022, and a contract extension is needed to continue to provide weed control and abatement services. City staff recommends extending the contract for an additional year. Additionally, the vendor has agreed to hold the current contact pricing for one more year through June 30, 2023.

RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Water District authorize the City Manager to enter into a one (1) year agreement with Ferguson Waterworks in an amount not-to- exceed $125,000, for the purchase of DFW meter boxes and lids.
BACKGROUND
The Hesperia Water District has standardized various services and repair products in order to minimize the need to stock multiple products and to simplify installation processes . Ferguson Waterworks is the direct distributor of DFW water meter boxes, which is one of the products the District has standardized.
ISSUES/ANALYSIS
DFW manufactures polymer underground enclosures designed for advanced meter reading (AMR) technology. These are designed to replace concrete boxes of similar dimensions while offering additional working room inside the box for repair and maintenance of the meter. The lids are heavy duty polymer and can also fit existing concrete meter boxes. The polymer is blended to accommodate extreme weather conditions and to withstand inadvertent vehicular traffic. These lightweight boxes provide an easier installation process and will reduce physical effort on maintenance crews, while meeting the District’s standards.

It is recommended that the City Council authorize the City Manager to approve an amendment to the existing contract with Pacific Products & Services, LLC for an additional $80,000 for a total revised not-to-exceed contract amount of $130,000, and approve a one-year contract extension for the purchase of traffic signs and sign materials.
BACKGROUND
The Public Works Traffic program is responsible for the installation and maintenance of traffic signs and roadway pavement markers throughout the City of Hesperia. Traffic signs are important and necessary to promote safe driving while navigating roadways through out the City. In September 2021, the City conducted a request for proposals for Traffic Signs and Sign Materials, in which Pacific Products & Services, LLC was deemed the lowest responsible/responsive bidder.

SUBJECT: Cooperative Agreement with the City of Victorville for Traffic Signal and Striping/Pavement Marking Maintenance on Bear Valley Road
RECOMMENDED ACTION
It is recommended that the City Council authorize the City Manager to enter into a five (5) year cooperative agreement with the City of Victorville, for the shared maintenance cost of thirteen (13) traffic signals and striping/pavement marking maintenance on Bear Valley Road, in a total not-to- exceed amount of $250,000.
BACKGROUND
Over the past twelve (12) years, the City of Victorville has provided traffic signal maintenance and striping/pavement services to the City of Hesperia for the traffic signals shared by both cities along Bear Valley Road. Also, the City of Victorville provides preventative and corrective maintenance to the thirteen (13) shared traffic signals along Bear Valley Road.
ISSUES/ANALYSIS
The City of Victorville has reliably provided these services to the City of Hesperia and staff recommends to continue this service with the City of Victorville. The pr oactive and reactive maintenance cost is shared 50/50 with the exception of the intersection at Fish Hatchery Road , whereas the City covers one hund red percent (100%), which is based on the cost of time and materials. Based on the historical trend of this service, staff estimates $50,000 per fiscal year will be sufficient for the five (5) year agreement.

RECOMMENDED ACTION
It is recommended that the City Council adopt Resolution No. 2022-29 approving Final Tract Map No. 16750 to create 35 Single-family Residential lots on approximately 10 gross acres zoned R1 located on the southeast corner of Muscatel Street and Mesa Avenue (Applicant: LCTH Investment, L.P. APN: 3046-011-09).
BACKGROUND
On June 10, 2004, the City Council approved Tentative Tract Map No. 16750 to create 35 Single- family Residential lots on approximately 10 gross acres zoned R1 located on the southeast corner of Muscatel Street and Mesa Avenue. Tentative Tract Map No. 16750 was subsequently extended by the City and State of California multiple t imes as shown in Table 1 below making the final expiration date of Tentative Tract Map No. 167 50 December 22, 2021. On December 16, 2021, the applicant applied for an extension of time (TTE21 -00001). Pursuant to the requirements of Measure N, the city is not able to process an extension of time for a tentative tract map. However, the Subdivision Map Act provides a 60-day review period from the date that an application is filed.
Therefore, the applicant was granted 60 days to complete the processing of the final map for TT- 16750. The 60-day review period ended on February 16, 2022, in which during that 60-day time period, the applicant was deemed as timely filed.

Tina Souza, Senior Management Analyst
SUBJECT: Permanent Water Rights Purchase and Lease from Vanhoops Holdings, LP
RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Water District authoriz e the purchase of 360 acre -feet (AF) of permanent Bass Annual Production water rights in the Alto Subarea from Vanhoop s Holdings, LP at $6,060 per AF for $2,181,600, 234 AF of Carryover rights at $500 per AF totaling $117,000, and 198 AF of FPA at $500 per AF totaling $99,000, for a total transaction amount of $2,397,600, for the permanent and temporary assignment of water rights.
BACKGROUND
The Adjudication (City of Barstow et al, v. City of Adelanto et al) is intended to remediate overdraft in the Mojave Basin Area by limiting the amount of water produced in specific subareas. The Free Production Allowance (FPA) is the maximum amount of water a producer may pump in one year without incurring a replacement or make -up obligation. As a result of the judgment, Hesperia Water District (District) incurs replacement water obligations in the Alto Subarea when verified production amounts exceed the FPA for the water year.
The District may meet these replacement water obligations by three mechanisms: 1) assignment of Carryover right or temporary transfer of unused FPA (i.e. lease) from interested water rights owners in the respective subarea at negotiated rates (this is a cost effective short-term option to meeting the production demands); 2) purchase water from the Mojave Basin Area Watermaster (Watermaster) at the current per acre-foot (AF) water rate which is derived from the State Water Project water rates, and/or; 3) p urchase permanent Base Annual Production (BAP) rights from interested parties in the Alto Subarea at negotiated rates (purchase provides a long-term solution, but is costly and difficult to acquire).
With the additional rampdown related to the Adjudication in recent years, the growing demands of the District’s service area, water availability, and the competitive nature of assignment water, the District incurs a significant replacement obligation annually and has had to meet this obligation by purchasing water from the Watermaster.
It was brought to the District’s attention that Vanhoops Holdings, LP was interested in selling 360 AF of permanent BAP rights. Due to the ramp down of 55 percent required by the Adjudication, the BAP equates to 198 AF of FPA that can be used to offse t annual replacement obligations.
Along with this permanent BAP, Vanhoops Holdings, LP held 234 AF of Carryover rights, which equates to 198 AF that may be applied to Water Year 2020-21 replacement obligations and 198
Staff Report to the Chair and Board Members, Hesperia Water District Permanent Water Rights Purchase and Lease from Vanhoops Holdings, LP May 3, 2022
AF of Free Production Allowance (FPA), which equates to 198 AF that may be applied to Water Year 2021-22 replacement obligations (court ordered gradual rampdown of agricultural water in recent years makes agricultural water equitable to municipal and industrial water by Water Year 2021-22, whereas historically, agricultural water had a differential rampdown).
ISSUES/ANALYSIS
During the 2020-21 Water Year (October 2020 to September 2021), the District produced 14,942 AF of water. The District’s FPA is 7,795 AF leaving a replacement obligation of 7,147 AF. The City owns 6,736 AF which equates to 3,705 AF of FPA that can be used to offset annual replacement obligations by leasing to the District; subsequently leaving a replacement obligation balance of 3,442 AF. The purchase of permanent water rights, while costly, provides a long-term solution to the inevitable water production overrun the District faces annually.
The table below represents the City’s and District’s historical purchases of permanent water rights since 2012.

Opportunities to purchase permanent water are scarce and purchasing permanent water rights when feasible is a vital component to planning for future water supply. This transaction represents an acquisition of 3 60 AF of permanent BAP at $6,060 per AF for a total cost of $2,181,600. In addition, to the permanent BAP, the temporary transfer of 234 AF of Carryover rights at $500 per AF totaling $117,000 and 198 AF of FPA at $500 per AF totaling $99,000 were included in the negotiations. The total transaction amount for the permanent and temporary assignment of water rights is $2,397,600.
FISCAL IMPACT
The District currently has $2,293,776 of fund balance retained for water rights purchase. Since the opportunity to purchase permanent water rights was unknown during the creation of the FY 2021-22 Budget, these funds were not included in the expenditure budget. A Final Budget

Amendment (Fourth Quarter) will be presented to the Board requesting additional appropriation authority at the close of the fiscal year. Anticipated budget savings will be netted against the purchase of $2,397,600 during the fiscal year-end reconciliation, thus potentially decreasing the appropriation request for the purchase.

It is recommended that the City Council and the Board of Directors of the Hesperia Water District receive and file this staff report, which provides information about the current status of the City of Hesperia’s proposed operating budget for FY 2022-23.
BACKGROUND
In compliance with the City Council’s policy direction, staff annually develops an expenditure budget. While the budget gives the City the legal authority to secure goods and services, it is also a communication tool that provides information to the citizens about the City’s programs and projects. To ensure that the budget is developed to meet the City Council’s direction, a series of budget workshops have been developed. Th is first workshop will highlight the proposed operating budget. During the first City Council meeting in June, the proposed annual operating budget will be presented.
ISSUES/ANALYSIS
As mentioned, this first budget workshop, will provide a brief overview of the City’s and Water District’s oper ating budget. The operating budget includes planned ongoing revenues and expenditures for the upcoming fiscal year, as well as revisions to the FY 20 21-22 Budget. It should be noted, that the goal for developing the FY 2022-23 Budget was to minimize the use of reserves and enhance cash reserves. This goal will be highlighted during the presentation.
FISCAL IMPACT
There are no financial impacts at this time, as this is a workshop to discuss the proposed FY 2022-23 operating budget.
