NOW THEREFORE, BE IT RESOLVED BY THE CITY OF HESPERIA CITY COUNCIL AS FOLLOWS:

Section 1. The City Council hereby specifically finds that all of the facts set forth in this Resolution are true and correct.

Section 2. Based upon substantial evidence presented to the City Council during the above-referenced May 17, 2022, hearing, including public testimony and written and oral staff reports, this Council specifically finds as follows:

Based on adoption of Resolution 2022-37, the Environmental Findings, Statement of Overriding Considerations, Mitigation Monitoring and Reporting have been adopted and the Final Environmental Impact Report (SCH # 2019110418) has been certified pursuant to the California Environmental Quality Act (CEQA) for this project.

The proposed map is consistent with the City’s General Plan of the City of Hesperia, because the subdivision is consistent with the intent of the adopted land use element.

The design or improvement of the proposed subdivision is consistent with the General Plan of Hesperia, as the project supports the existing land use and circulation pattern in the area.

The site is physically suitable for the type of development because there are no known physical constraints to nonresidential development and the site has adequate area to accommodate the proposed parcels.

The site is physically suitable for the proposed development intensity because the parcels are adequate in size and shape and all Development Code regulations for the permitted and conditional uses can be met, with approval of Conditional Use Permit CUP19-00010.

The design of the subdivision or type of improvements are not likely to cause serious public health problems because all construction will require necessary permits and will conform to the City’s adopted building and fire codes.

That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision.

Section 3. Based on the findings and conclusions set forth in this Resolution, the City Council hereby approves Tentative Parcel Map No. 20257 (TPM22-00002), subject to the Conditions of Approval as set forth in ATTACHMENT “A.” Section 4. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.

ADOPTED AND APPROVED on this 17th day of May 2022.
