RECOMMENDED ACTION
The Planning Commission recommends that the City Council adopt Resolution No. 2022-37, recommending that the City Council make the environmental determination pursuant to the California Environmental Quality Act (CEQA) by certifying the Final Environmental Impact Report (FEIR) and adopting a statement of overriding considerations and adopt Resolution Nos. 2022-38 and 2022-39, approving CUP19-00010 and TPM22-00002 as well as Ordinance 2022-09, approving DA22-00001.

PROJECT SUMMARY
Proposal: Proposal: A Conditional Use Permit (CUP) has been filed to construct a 3,745,429 square foot distribution center and industrial park on 194.8 gross acres. The project, identified as “Hesperia Commerce Center II” will consist of the construction of three industrial/warehouse buildings with associated office spaces, surface parking and loading areas. The northwesternmost building (referred to as Building 1) is proposed to be 1,567,317 square feet; the southernmost building (referred to as Building 2) is proposed to be 2,065,987 square feet and would potentially be divided between two spaces within the same building; and the northeastern most building (referred to as Building 3) would be 112,125 square feet.

A tentative parcel map has also been filed to rearrange the four existing parcels into four new parcels that generally follow the alignment of the future buildings. In addition, a Development Agreement (DA) is proposed that would allow the CUP to be effective for 12 years initially, with a provision allowing an automatic 8-year extension. In return, the City is requiring the Developer to construct certain off-site water and sewer infrastructure within the first 3 years from when the Development Agreement is executed. The applicant is also required to provide a one-time agreed upon community benefit contribution to the City.

Planning Commission Review: On April 14, 2022 the Planning Commission voted 5-0 to forward this item to the City Council with a recommendation for approval.

Conclusion: Because the project is consistent with the City’s General Plan, most of the project’s impacts, whether less than significant, mitigable, or significant and unavoidable were known and acknowledged by the City when the General Plan EIR was adopted in 2010. The Planning Commission recommends that prior to acting on the project, the City Council make the environmental determination, certifying that the Final EIR is complete; that it has been prepared in compliance with CEQA; that it reflects the City’s independent judgment; and that all impacts from carrying out the project have been identified and disclosed to the public. Resolution 2022-37 has been prepared to document this determination as well as the Statement of Overriding Considerations. Once that has occurred, the City Council can consider the conditional use permit, tentative parcel map and Development Agreement. If recommended for approval, the mitigation monitoring and reporting program will be administered with the project approval.
