Household Hazardous Waste Collection Agreement

RECOMMENDED ACTION
It is recommended that the City Council authorize the City Manager to execute a five-year Household Hazardous Waste Collection Agreement (Agreement) with San Bernardino County Fire Protection District (County) for operation of the Household Hazardous Waste (HHW) Facility.

BACKGROUND
The California Public Resources Code (Section 57000 et seq.) requires cities and counties to prepare a Household Hazardous Waste Element (HHWE), which identifies a program for the safe collection, recycling, treatment, and disposal of hazardous wastes which are generated by households, and which should be separated from the solid waste stream. San Bernardino County, and each of the cities in the County, have developed HHWEs which identify a county-wide cooperative program for the management of HHW.

The City’s five-year Household Hazardous Waste Collection Agreement with the County expires on June 30, 2022. The agreement outlines the County’s operation of the HHW facility. The HHW facility not only satisfies HHWE requirements but also protects the health and welfare of Hesperia residents by removing hazardous waste from homes and diverting it from landfills.

In 2021, Hesperia residents disposed of 224,297 lbs. (based on calculated waste averages) of HHW, with 3,415 residents utilizing the Hesperia facility. Two hundred and fifty-eight residents used other County HHW collection facilities. A breakdown of waste types collected in 2021 is included below.

ISSUES/ANALYSIS
The new, revised Agreement with the County will cover a five-year period starting July 1, 2022 through June 30, 2027. The contract expiring June 30, 2022, included a 3% annual rate increase based on the U.S. Bureau of Labor Statistics’ Consumer Price Index (CPI). The County does not wish to increase the new contract according to the current CPI, which as of March 2022 was 8.5 percent. The new Agreement includes a rate increase of 0.25% each year of the 5-year agreement, starting at 3% for FY 2022-23 and increasing gradually to 4% for FY 2026-27.

Over the last five years, the cost of supplies, disposal, and staffing has increased, along with the amount of waste collected by the County. The 0.25% annual increase along with changes in the facility’s hours of operation will allow the County to continue providing necessary services to the City of Hesperia. Current operating hours are Tuesday and Thursday from 9:00 a.m. to 1:00 p.m. and Saturday from 9:00 a.m. to 3:00 p.m. Per the new Agreement, operating hours will be Thursday from 9:00 a.m. to 1:00 p.m. and Saturday from 9:00 a.m. to 2:00 p.m. Residents typically utilize the facility the least on Tuesdays.

FISCAL IMPACT
The City shall pay the district an amount not to exceed $977,738.98 for the five-year term, as outlined below. Per the City’s franchise agreement with Advance Disposal, all costs associated with the County Agreement for HHW Facility services are reimbursed by Advance Disposal. As a result, there is net zero cost to the City for the Agreement.
