Amend the FY 2022-23 Budget to Accept and Appropriate SB 1383 Local Assistance Grant Program Funds

RECOMMENDED ACTION
It is recommended that the City Council adopt Resolution No. 2022-049 amending the FY 2022-23 Adopted Budget, accepting SB 1383 Local Assistance Grant Program funds, and appropriating funds to certain grant related expenditures.

BACKGROUND
In September 2016, Governor Edmund Brown Jr. set methane emissions reduction targets for California in a statewide effort to reduce emissions of short-lived climate pollutants (SLCP). This legislation, Senate Bill (SB) 1383, states that California must reduce organic waste disposal 75% by 2025 and rescue 20 % of currently disposed food to provide to the food insecure.

To achieve these ambitious organic waste reduction goals, the California Department of Resources Recycling and Recovery (CalRecycle) established SB 1383 regulations which must be followed by local jurisdictions to reduce organic waste. These regulations incorporate several components including collection and recycling, procurement requirements, edible food recovery, capacity planning, enforcement, recordkeeping requirements, reporting, and education and outreach.

To assist local jurisdictions with their efforts to comply, CalRecycle is administering a one-time grant program meant to provide aid in the implementation of SB 1383 regulations. This noncompetitive grant program provides $57,000,000 in funding to local jurisdictions with each City receiving a set amount based on population.

ISSUES/ANALYSIS
In March of 2022, City staff prepared and submitted an application to CalRecycle for SB 1383 Local Assistance Grant Program funds to cover the costs of software needed to comply with the implementation record regulations of SB 1383. City staff also applied for funds to cover personnel time, education and outreach, and funding to establish a contract with a food recovery organization to assist in the food recovery component of the regulations.

On April 27, 2022, the City was awarded $136,396 in grant funds which included funding for the following: $36,000 for food recovery services; $12,000 for education and outreach; $9,166 for personnel time; and $79,230 to purchase software that will assist the City in complying with regulations related to recordkeeping and reporting.

During budget preparation, staff dedicated funds to SB 1383 education and outreach and funds for food recovery services as these activities were required whether the City received the grant or not. Therefore, the Adopted FY 2022-23 Budget already includes $3,000 for education and outreach and $12,000 for food recovery services. Upon receiving the grant award, City staff decided to include funding for record keeping and reporting software in the amount of $79,230.

Due to the timing of the grant award and the need to obtain approval on how to appropriate funding, City staff was not able to include this information in the FY 2022-23 adopted budget. Therefore, a budget amendment is needed to accept SB 1383 Local Assistant Grant Program Funding and to appropriate funding for SB 1383 compliance activities.

FISCAL IMPACT
Funding for the SB 1383 Local Assistant Gran Program will require amending the Fiscal Year 2022-23 Adopted Budget by appropriating a total of $94,230 to Fund 262 via Resolution No. 2022-049. In addition, staff is requesting approval via the same resolution to amend the budget by transferring the adopted budget amounts of $3,000 from Fund 256 (for education and outreach) and $12,000 from Fund 100 (for food recovery services) to Fund 262.
