City of Hesperia

STAFF REPORT
DATE: October 18, 2022
TO: Mayor and Council Members
FROM: Nils Bentsen, City Manager
BY: Casey Brooksher, Director of Administrative Services Michael Assumma, Information Systems Manager
SUBJECT: Network Switch Replacement

RECOMMENDED ACTION
It is recommended that the City Council authorize the City Manager to enter into an agreement with Pricon INC to purchase ten (10) network switches and associated licensing & peripherals in an amount not-to-exceed $83,649, to replace the City’s aging network switches with current and supported models.

BACKGROUND
The City’s current network switches were purchased during Fiscal Year (FY) 2014-15 and have reached the end of the manufacturer’s recommended life cycle . Support and maintenance are no longer available to support the City’s current network switches, which has created additional burden when attempting to remediate increasingly frequent reliability issues. Newer network switches will have increased reliability, and technical support from the manufacturer, when necessary.

ISSUES/ANALYSIS
In response to the City’s aging network switching infrastructure, staff conducted an evaluation of network switching needs at each City location. This evaluation took into consideration the required number and speed of ports and the required overall network throughout, both now and over the next 5+ years . Staff then performed research to determine the make and model of switches that would provide the City with the best value to meet the requirements.

A Request for Bids (RFB) was prepared with the City’s re searched requirements. Professional services will not be needed with this purchase , as Information Technology (IT) Department staff can install th is equipment. Specific switch models were requested, as determined by staff research, along with software li censing and peripheral equipment required for the switches per staff’s planned installed configuration.

In order to ensure a competitive bidding process, the Finance Division distributed the RFB by posting to the City of Hesperia and Public Purchase websi tes and to eighteen vendors of IT products via email. During the bidding window, nine sealed bids were received and evaluated by city staff . The selected bid was the lowest /responsive bid that met all of the requested requirements.

Staff Report to the Mayor and City Council
Network Switch Replacement
October 18, 2022
The requested purchase will bring all of the City’s network switches , at all locations , under manufacturer support and up to current industry standards . Additionally, the newer models will provide enhanced, modern features for cybersecurity & network monitoring. After this purchase, all of the City’s network switches will be part of a single manufacturer’s ecosystem, resulting in streamlined management of City network infrastructure, and reduced vendor-relations overhead.

FISCAL IMPACT
Funding for this purchase has been included in the Adopted Fiscal Year (FY) 2022-23 Budget.

RECOMMENDED ACTION
It is recommended that the City Council accept the Hesperia Park and Ride Facility project completed by Vance Corporation (Construction Order No. 6523); authorize staff to record a “Notice of Completion ;” and release all withheld retention after 35 days from the date of recordation.

BACKGROUND
In June of 2020, the City Council approved the Fiscal Year 2020-2021 Capital Improvement Program (CIP), which incl uded programming for the Hesperia Park and Ride Facility Project (Construction Order No. 6523). On May 18, 2021, the City Council awarded the contract to the lowest responsive/responsible bidder, Vance Corporation, in the amount of $953,795.30 with a 10% contingency in the amount of $ 95,379.53 for a total authorized contract amount of $1,049,174.83.

ISSUES/ANALYSIS
Construction was complete May 12, 2022. During construction, two change orders for additional work were requested by the City for a total of $75,258.26 in change orders. A balancing change order was also processed that amounted to a credit of $10,123.80. These change orders included the following: A delay in th e start of work due to SWPP amendments, an increase in the expansion of Joshua Street, additional riprap to the construction of the basin, additional sidewalk construction, survey corrections, replacement of plant types, the addition of stabilizer and decomposed granite to planter areas, and the installation of a traffic loop. The final contract total of $1,018,929.76 is within the Council authorized contract amount of $1,049,174.83. Upon approval, retention funds in the amount of $50,908.00 will be released to Vance Corporation.

Staff approved the contractor’s “Notice of Completion” indicating all work was complete and ready for final inspection on September 14, 2022. Staff recommends Council accept all work constructed under this contract and authorize staff to record a formal “Notice of Completion” with the County of San Bernardino clerk’s office and release all withheld retention funds 35 days after recordation.

STAFF REPORT
DATE: October 18, 2022
TO: Mayor and Council Members
Chair and Commissioners, Community Development Commission FROM: Nils Bentsen, City Manager
BY: Rachel Molina, Assistant City Manager
Victor Knight, Economic Development Manager
SUBJECT: Adopt Resolution Declaring Property Owned by the Hesperia Community Development Commission as “Exempt Surplus Land”

RECOMMENDED ACTION
It is recommended that the City Council and Hesperia Community Development Commission adopt Resolution No. CDC 202 2-02, declaring APN 0405 -373-03 owned by the Hesperia Community Development Commission “Exempt Surplus Land” pursuant to government code 54221. This action is being performed in preparation for sale to the Hesperia Recreation and Park District at a later date.

BACKGROUND
Assembly Bill (AB) 1486 was approved by the legislature and signed by the Governor in 2019.

AB 1486 made various amendments to Government Code Sections 54220 et seq., concerning the process for disposition of surplus land by cities and other local agencies. These laws went into effect on January 1, 2020.

The new law require s the City to annual ly report on surplus lands held by the City to facilitate development of affordable housing around the State. AB 1486 states land “not necessary for the agency’s use” be declared “surplus” or “exempt surplus” as supported by written findings before a loca l agency can take any action to dispose of it consistent with an agenc y’s policies or procedures.

Agency’s use is defined as land being used or is planned to be used pursuant to a written plan adopted by the local agency’s governing board for agency work or operations, including, but not limited to : utility sites, watershed property, conservation purposes , exhibition, or buffer sites.

Agency’s use shall not include commercial or industrial uses or activities, including non - governmental retail, entertainm ent, or office development. Property disposed of for the sole purpose of investment or generation of revenue shall not be considered necessary for the agency’s use.

Any land that is declared “surplus” must be noticed for sixty days to other public agencies and prospective affordable housing developers that have registered with the state before the local agency may take any action to dispose of said property. Any eligible entities have 60 days to notify the City in writing of its intent to purchase or lease the land , after the 60 -day terms both parties have an additional 90 days to complete good faith neg otiations. If terms are not agreed upon within this 90 -day period, the property may be disposed of without further regard to the Surplus Lands Act.

Staff Report to the City Council and Hesperia Community Development Commission Adopt Resolution Declaring Property Owned by the Hesperia Community Development Commission as “Exempt Surplus” October 18, 2022
Exemptions or reasons for declaring land “exempt surplus” include but are not limited to the following:
 Local Agency to Agency Surplus Land Transfer. Local agency surplus land is transferred to another local, state, or federal agency for the transferee agency’s use.

ISSUES/ANALYSIS
A) In compliance with state law, staff recommends that the City Council declare the following Hesperia Community Development Commission parcel as Exempt Surplus Land:

FISCAL IMPACT
There is no fiscal impact related to the declaration of the property as exempt surplus. If the City disposes of land in violation of the S urplus Land Act (SLA) after receiving a Notice of Violation (NOV) and fails to correct the violation within 60 days, an administrative penalty of 30% of the final sale price of the land sold in violation of the SLA, or 50% for each subsequent violation shall be invoiced by the Housing and Community Development to the City.

WHEREAS, under the SLA, Government code Section 54220-54233, surplus property is defined as land owned by any local agency no longer necessary for the agency's use; and WHEREAS, unless the land is exempt, the agency must give written notice of its availability to any local public entity, including schools and park districts, within whose jurisdiction the property is located, as well as housing sponsors that have notified the State Department of Housing and Community Development (HCD) of their interest in surplus property; and WHEREAS, the Community Development Commission (CDC) owns the following property that is exempt surplus land: APN 0405-373-03;

SUBJECT: Eagle Hesperia Housing Project Confirmation of Subordination in connection with $2,000,000 of Additional Bonds issued by Eagle Hesperia 55, L.P.

RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Housing Authority consider approving the Confirmation o f Subordination Agreement in connection with $2,000,000 of additional bonds being funded related to the Eagle Hesperia Affordable Housing Project.

BACKGROUND
In 2016, the Hesperia Housing Authority approved a Loan Agreement and other s upporting documents (Including a regulatory agreement for 55 years , plus an option f or an additional 25 years) for a new construction, affordable senior apartment project located in Hesperia with Eagle Hesperia 55, L.P. The project was completed in 2018. The project is an affordable housing 55+ senior project with 96 units on a portion of 9.41 acres; including 20 one - bedroom/one bath units at 50% Area Median Income (AMI), 44 one -bedroom/one bath units at 80% AMI and 32 two -bedroom/one and a half bath uni ts at 80% AMI. Amenities include full gating and fencing, clubhouse, computer center , fitness center, lap pool and jacuzzi, individual washers and dryers, patio balconies, ceiling fans, refrigerators, security cameras, and elevators.

The project consist s of four two -story buildings containing 24 units each. The project was financed with certain debt, including bonds (approx imately $8.2 Million), developer equity or debt and the $3,831,975 Agency Loan. The project was financed together with another Pro ject by the same developer in Yucaipa.

A few months ago, the Developer approached the Housing Authority to issue additional bonds of approximately $2,000,000 to repay the Developer some of the funds it spent on the project.

The project is located on the north side of Avenal Street and east of Mariposa Road.

ISSUES/ANALYSIS
The Develo per has requested that the Housing Authority , enter into a confirmation of subordination agreement with respect to its loan r elative to the other debt present on the property. The Subordination Agreement was executed in connection with the original bonds and now those documents are being supplemented for the extra $2,000,000 . The Successor Agency’s Loan Agreement does not deal with the situation and so staff is requesting the Housing Authority approve the Confirmation of Subordination Agreement. The Hous ing Authority, as successor housing authority for the Successor Agency, will receive approximately $312,000 from the proceeds of the additional bonds to use for housing projects. This will pay off part of the residual receipts loan.

SUBJECT: Repeal of Commercial Cannabis Program

RECOMMENDED ACTION
It is recommended that the City Council review the report and resolution, then consider adopting Resolution No. 2022-75 prohibiting the renewal of any existing cannabis dispensary delivery permits and directing staff to draft ordinances necessary to repeal the commercial cannabis program.

BACKGROUND
The City currently provides for a commercial cannabis program pursuant to Hesperia Municipal Code Chapter 3.18 (Cannabis Business Tax), 5.50 (Business Licenses and Regulations) and Title 16 (Development Code). The program establishes certain limitations on personal cannabis cultivation and prohibits commercial cannabis activities, with the sole exception of medical cannabis delivery operations under state license classification M-9 (Non-Storefront).

On September 20, 2022 , the City Council directed staff to bring back item s to consider (i) changing the tax rate; and (ii) repealing the commercial cannabis program in its entirety. This report and attached Resolution concern the repeal of the commercial cannabis program.

Section 5.50.040(D) provides that the annual renewal of permits is subject to the same process as new applications. The attached resolution is presented for City Council consideration to prohibit any renewals of existing permits pending the repeal of the commercial cannabis program, and to direct staff to prepare ordinances necessary to repeal the program.

The commercial cannabis program is described in Chapter 3.18 , Chapter 5.50, and Title 16. If the attached resolution is adopted staff will prepare ordinances necessary to repeal the commercial cannabis program. The ordinance changing Title 16 will require review and action by the Planning Commission.

Existing dispensaries with valid permits will be allowed to continue operating under their existing permit until the annual permit expires, at which time the permit will not be renewed.
