SUBJECT:
Amendments to Title 5 and Title 8 of the Hesperia Municipal Code Related to the Voluntary Crime Free Program
RECOMMENDED ACTION
It is recommended that the City Council introduce and place on first reading Ordinance No. 2022-15, amending Title 5 and Title 8 of the Hesperia Municipal Code related to the Voluntary Crime Free Program.
BACKGROUND
In 2015, the City Council adopted Ordinance No. 2015-12 which established a “Crime Free Rental Housing Program” (“Crime Free Program”). The Crime Free Program was designed to address the disproportionate calls for service and crime emanating from rental properties. Among other requirements, the Crime Free Program provided mandatory prospective tenant screenings, mandatory use of a Crime Free Lease Addendum and mandatory evictions of tenants who violate criminal laws and the crime free lease addendum.
In 2017, the City Council adopted Ordinance 2017-13 modifying the Crime Free Program. Modifications included removing the mandatory prospective tenant screenings, mandatory use of a Crime Free Lease Addendum and mandatory evictions of tenants who violate criminal laws and the crime free lease addendum, but kept the mandatory registrations of rental properties in the City.
ISSUES/ANALYSIS
The enforcement of the Crime Free Rental Housing ordinance officially ended on January 19th 2021 with the adoption of Ordinance No. 2020-14. Since the Crime Free Program was receded, staff recommends revising Title 5 and Title 8 of the Hesperia Municipal Code, to remove any references to the Program, as follows:
Recommended changes to Title 5 – Business License and Regulations Under Section 5.72.070(A)(1)(k) – Registration Requirements – remove reference to registration requirements for Hesperia Crime Free.
Remove Section 5.72.100 - Crime Free Program.
Remove Section 5.72.120 – Crime Prevention through Environmental Design (CPTED) Requirements.
Revise section numbering to align with recommended revisions.
Recommended changes to Title 8 – Health and Safety
Remove Chapter 8.20 Crime Free Rental Housing Program in its entirety Recommended changes to Code Comparative Table and Disposition List Remove reference to Crime Free in the listing
