RECOMMENDED ACTION
It is recommended that the City Council adopt Resolution No. 2022-78 memorializing the action the City Council took on August 24, 2022 declaring the appointments filling one (1) open seat each, in City Council Districts two (2), three (3), and four (4), in lieu of participating in the November 8, 2022 General Municipal Election.
BACKGROUND
The nomination period for the November 8, 2022, General Municipal Election was July 18, 2022, through Friday, August 12, 2022. As of the close of the nomination period on Friday, August 12, 2022, for Members of the City Council representing District two (2), District three (3), and District four (4), only one (1) candidate was nominated for each seat in District three (3) and District four (4), and there were no persons nominated in District two (2).
Since qualified candidates for City Council Districts three (3) and four (4) were unopposed, and there being no qualified candidates for City Council District two (2), Elections Code § 10229 provides procedures for appointment if only one or no person is nominated for an elective office, and cancellation of its election. The person(s) appointed, if any, shall qualify and take office and serve exactly as if the person(s) were elected at a municipal election for the office.
On August 24, 2022 the City Council adopted Resolution 2022-66 cancelling the Consolidated Municipal Election scheduled on November 8, 2022 and appointing the following nominees, pursuant to Elections Code Section 10229; .
