RECOMMENDED ACTION
The Planning Commission recommends that the City Council adopt Resolution No. 2023-01, recommending that the City Council make the environmental determination pursuant to the California Environmental Quality Act (CEQA) by certifying the Final Environmental Impact Report (FEIR) and adopting a statement of overriding considerations and introduce and place on first reading Ordinance No. 2023-03 approving SPLA21-00001 and Ordinance No. 2023-04 approving Development Agreement DA22-00002 and adopting Resolution Nos. 2023-02 and 2023-03 approving CUP21-00004, TPM22-00010 and CUP21-00005.
PROJECT SUMMARY
Proposal: Proposal: Two Conditional Use Permits (CUP) have been filed to construct approximately 1,850,000 square feet of industrial warehouse space on approximately 97 acres of vacant land. Conditional Use Permit CUP21-00004 in conjunction with Tentative Parcel Map TPM22-00010 was filed for Building 1 (the eastern building), and CUP21-00005 was filed for Building 2 (the western building). Building 1 includes the construction of an approximately 1,108,000 square foot industrial warehouse on approximately 61 gross acres and Building 2 includes the construction of an approximately 742,000 square foot industrial warehouse on approximately 36 gross acres (Attachment 1). An Environmental Impact Report (EIR) was prepared that analyzed both buildings concurrently as a single “project”. In addition, a development agreement is proposed that also includes both buildings under a single document. Therefore, for the purposes of this staff report both entitlement applications are included together.
In conjunction with only CUP21-00004 a Specific Plan Amendment has also been filed to change approximately 40 acres of the project site from Regional Commercial (RC) to Commercial Industrial Business Park (CIBP). In addition, a tentative parcel map has been filed to rearrange two existing parcels into two new parcels. The parcel map generally follows the alignment of the proposed Building 1. In conjunction with both CUP21-00004 and CUP21-00005, a Development Agreement (DA) is proposed that would allow both entitlements to be effective for 8 years initially, with a provision allowing an automatic 2-year extension. In return, the City is requiring the Developer to construct certain off-site improvements that extend beyond the limits of the project frontage. In addition, the developer will be required to provide a monetary contribution towards the construction of a regional detention basin that will be located at the end of the Oro Grande Wash. Finally, the DA provides that the applicant may contribute a monetary contribution in-lieu of constructing a portion of a required screen wall (described in more detail in the attached Planning Commission staff report).
Planning Commission Review: On December 8, 2022 the Planning Commission voted 3-1 (Commissioner Dunbar voted no; Commissioner Bartz was absent) to forward this item to the City Council with a recommendation for approval.
Conclusion: In summary, because the project is consistent with the City’s General Plan, most of the project’s impacts, whether less than significant, mitigable, or significant and unavoidable were known and acknowledged by the City when the General Plan EIR was adopted in 2010. The Planning Commission recommends that prior to acting on the project, the City Council make the environmental determination, certifying that the Final EIR is complete; that it has been prepared in compliance with CEQA; that it reflects the City’s independent judgment; and that all impacts from carrying out the project have been identified and disclosed to the public. Resolution PC-2023-01 has been prepared to document this determination. Once that has occurred, the Planning Commission can consider both conditional use permits, the tentative parcel map, and the Development Agreement. If approved, the mitigation monitoring and reporting program will be administered with the project approval.
