SUBJECT:

Ratifying of Declaration of Local Emergency

RECOMMENDED ACTION
It is recommended that the City Council adopt Resolution No. 2023-17 ratifying the Director of Emergency Services’ issuance of a local emergency declaration.

BACKGROUND
Code Section 2.20.060 of the Hesperia Municipal Code empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when said City is affected or likely to be affected by a public calamity and the City Council is not in session.

On Friday, February 24, 2023, a multi-day extreme winter storm system impacted Hesperia causing severe damage. This storm event has resulted in damage across the City requiring numerous road closures due to stormwater erosion of the portions of roadway, severity of potholes and other hazards, and related damage.

The Director of Emergency Services, in monitoring the situation in coordination with San Bernardino County Office of Emergency Services, believes the declaration of a local emergency to be appropriate. San Bernardino County has similarly declared a State of Emergency related to this storm damage.

ISSUES/ANALYSIS
Pursuant to Government Code Section 8630 states:

A local emergency may be proclaimed only by the governing body of a city, county, or city and county, or by an official designated by ordinance adopted by that governing body.

Whenever a local emergency is proclaimed by an official designated by ordinance, the local emergency shall not remain in effect for a period in excess of seven days unless it has been ratified by the governing body.

The governing body shall review the need for continuing the local emergency at least once every 60 days until the governing body terminates the local emergency.

The governing body shall proclaim the termination of the local emergency at the earliest possible date that conditions warrant.

FISCAL IMPACT
There is no fiscal impact associated with this declaration, however the declaration may assist the City in receiving disaster funding related to damages and expenses incurred as a result of an extreme winter storm event.

ALTERNATIVE(S)
Provide alternative direction to staff.
