RESOLUTION NO. 2023-020
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HESPERIA, CALIFORNIA, APPROVING THE PROGRAMs and funding levels for inclusion in the COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) 2023-2024 ANNUAL ACTION PLAN AND AUTHORIZING THE CITY MANAGER AND/or their designee TO EXECUTE AND TRANSMIT ALL NECESSARY DOCUMENTS AND AMENDMENTS THERETO TO HUD UPON COMPLETION OF THE PUBLIC REVIEW PERIOD WHEREAS, the City of Hesperia (City), is a municipal corporation duly organized under the laws and Constitution of the State of California; and WHEREAS, the City is an entitlement jurisdiction for federal Community Development Block Grant Funds (CDBG); and WHEREAS, the United States Department of Housing and Urban Development (HUD) requires the City to adopt and implement a Five-Year Consolidated Plan for the expenditure of the City's annual entitlement of CDBG funds in support of projects and activities predominantly benefitting low- and moderate-income residents; and WHEREAS, the City Council adopted the current 2020-2024 Consolidated Plan on April 21, 2020; and
WHEREAS, the Consolidated Plan contains certain goals and accomplishments to be met during the five-year planning period through the expenditure of CDBG funds and other identified funding sources; and WHEREAS, the City accepted applications for CDBG funding for the 2023-2024 program year until February 2, 2023; and WHEREAS, the City’s Economic Development Department (EDD) staff evaluated eligible applications and made funding recommendations to be incorporated into the City's 2023-2024 Annual Action Plan (AAP); and WHEREAS, the City’s EDD 2023-2024 AAP funding recommendations were advanced to the City Council for review, ratification and/or modification at the April 18, 2023 City Council meeting; and WHEREAS, the City’s 2023-2024 CDBG annual allocation is $899,363; and WHEREAS, on April 18, 2023, the City Council, after holding a Public Hearing, evaluated the City’s staff recommendations and approved the program/projects and funding levels to be included in the Final 2023-2024 AAP submitted to HUD; and WHEREAS, the City is in compliance with its Citizen Participation Plan which requires the City to conduct a public hearing and a 30-day public review period to receive public input when an AAP is proposed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HESPERIA AS FOLLOWS:
Section 1. The recitals above are true and correct and are adopted as findings.
Section 2. The City Council approves the program/projects and funding levels for the 2023-2024 AAP to be submitted to HUD and attachments thereto as presented.
Section 3. The City Manager or their designee is hereby authorized to execute all necessary documents and any certifications to implement the 2023-2024 AAP.
Section 4. The City Council further authorizes the City Manager or their designee to approve any modifications and/or amendments to the 2023-2024 AAP if required to ensure approval by HUD including altering the 2023-2024 AAP to make any other changes necessary to facilitate the approval of the 2023-2024 AAP by HUD and its compliance with CDBG Regulations.
Section 5. The 2023-2024 AAP CDBG funds shall be incorporated into the City's Fiscal Year 2023-2024 EDD Budget.
Section 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
