ORDINANCE NO. 2024-01
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HESPERIA AND THE BOARD OF DIRECTORS OF THE HESPERIA WATER DISTRICT, CALIFORNIA, AMENDING TITLE 14, CHAPTER 14.02 AND TITLE 14, CHAPTER 14.08 OF THE HESPERIA MUNICIPAL CODE, RELATED TO THE OWNERSHIP AND MAINTENANCE OF SEWER LATERAL LINES WHEREAS, Title 14 of the Hesperia Municipal Code contains definitions related to water and wastewater terms; and WHEREAS, Title 14 of the Hesperia Municipal Code contains regulations related to the maintenance of sewer laterals; and WHEREAS, staff continues to experience blockages within sewer laterals as a result of negligently discharged liquids; and WHEREAS, continuing to maintain sewer laterals will prohibit staff from performing routine maintenance of sewer main lines.
WHEREAS, transferring sewer lateral ownership to property owners promotes a culture of responsible waste management.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF HESPERIA DOES ORDAIN AS FOLLOWS:
Section 1. All of the facts set forth in this Ordinance are true, correct and are adopted as findings.
Section 2. Title 14, Chapter 14.02 of the Hesperia Municipal Code is hereby amended by replacing 14.02.020 as set forth in Exhibit “A”, attached hereto.
Section 3. Title 14, Chapter 14.08 of the Hesperia Municipal Code is hereby amended by replacing 14.08.030 as set forth in Exhibit “A”, attached hereto.
Section 4. This Ordinance shall take effect thirty (30) days from the date of adoption.
Section 5. The City Clerk shall certify to the adoption of the Ordinance and shall cause the same to be posted in three (3) public places within the City of Hesperia pursuant to the provisions of Resolution No. 2007-101.
