SUBJECT: Printing Service Contract Amendment

RECOMMENDED ACTION

It is recommended that the City Council and Board of Directors of the Hesperia District Water District authorize the City Manager to approve an amendment to the existing contract with Wirz and Company Printing, Inc. (Wirz) for an additional $50,000 for a revised not-to-exceed contract amount of $100,000 and approve a one-year extension for printing services.

BACKGROUND

Departments Citywide need printed items for their various functions and utilize a City -wide agreement. These items include but are not limited to business cards, calendars, envelopes, W2 forms, inspection/violation forms, water quality reports , and newsletters. Ordering through a comprehensive agreement allows staff to operate more efficiently by streamlining printing services that are tailored to the department’s needs.

ISSUES/ANALYSIS

The current contract with Wirz expires June 30, 2024, and a contract extension is needed to continue printing services. In reviewing the overall contract performance, and feedback from the various departments, City staff recommends extending the contract for an additional year.

Additionally, Wirz has agreed to hold the current contract pricing for one more year through June 30, 2025.

CITY GOAL SUPPORTED BY THIS ITEM

Financial Health: Maintain a balanced budget and adequate reserves.

FISCAL IMPACT

Sufficient funding will be included in the various departments in the proposed Fiscal Year 2024 - 25 Budget.

FROM: Rachel Molina, City Manager

SUBJECT: Approval of a Multiple Employer Other Post Employment Benefit (OPEB)/Pension 115 Trust with Shuster Advisory Group, LLC

RECOMMENDED ACTION

It is recommended that the Board of Directors for the Hesperia Water District adopt Resolution No. HWD 2024-11, authorizing the City Manager to execute agreements with Shuster Advisory Group LLC, Charles Schwab Trust Bank, and Alta Trust Company for the establishment and administration of a Multiple Employer OPEB and Pension 115 Trust.

BACKGROUND

A Section 115 Trust is a vehicle authorized by the Internal Revenue Code, which allows an agency to segregate funds from general assets for the purpose of funding an essential government function (e.g. pension and post-employment obligations). Some of the benefits that a Section 115 Trust program can provide to agencies include utilizing the trust as a budget stabilization tool, improving the entity’s overall credit rating, and an opportunity to earn higher investment retu rns.

Trust assets are irrevocably committed to the government function identified in the trust agreement and the Water District will retain control over the investment strategy of the funds. A Section 115 Trust is a fiscally prudent approach to pre-funding actuarially accrued liabilities and is considered a “best practice” by the Government Finance Officers Association (GFOA).

For the reasons identified above, t he City of Hesperia and Hesperia Fire Protection District (HFPD) currently have agreements with Shuster Advisory Group LLC, Charles Schwab Trust Bank, and Alta Trust Company for Multiple Employer OPEB and Pension 115 Trusts, as approved by the City Council and HFPD Board on May 16, 2023.

ISSUES/ANALYSIS

During the May 7, 2024 , FY 2024-25 Budget Workshop, the establishment of the Pension and OPEB Section 115 Trusts for the Water District was discussed, along with utilizing $750,000 in Water District reserves to fund the District’s Pension Trust as reflected in the FY 2023-24 Revised Budget. Further, the FY 2024 -25 Proposed Budget includes an additional contribution of $750,000, allocating $500,000 to the Water District’s Pension Trust and $250,000 to the Water District’s OPEB Trust.

Shuster is an independent investment advi sory firm and fiduciary. They provide governmental and institutional retirement plan consulting services as well as private wealth management.

Shuster is a SEC-Registered Investment Advisor with over $7 billion in assets under management focusing on serving the unique needs of governmental agencies and special districts serving over 90 cities, agencies , and public entities . Shuster serves as fiduciary to plan investments and

provides investment selection, monitoring, and management, with custody services provided by Charles Schwab Trust Bank for the safekeeping of plan assets, and trustee services provided by Alta Trust for Federal and State compliance monitoring.

Shuster is the same firm that took over fiduciary responsibilities of the employee’s 457(b) deferred compensation and 401(a) plans in August 2018. Shuster entered the public retirement plan sector after analyzing the sector and realizing that cities and agencies were being underserved and over- charged for their retirement plans, directly impacting the supplemental retirement savings of the public employees. Hiring Shuster for these services resulted in a reduction in total plan costs for the 457(b) and 401(a) plans, in addition to a significant improvement in the quality of the investments available in the retirement plan. Shuster has proven to be analytical and responsive to the City’s needs.

As such, it is recommended that the Water District Board approve Resolution No. HWD 2024-11 for the establishment and administration of the Water District Multiple Employer OPEB and Pension 115 Trusts with Shuster Advisory Group.

Section 13307 (c) of the Elections Code allows the City to adopt fee regulations to charge candidates for the costs incurred for providing candidate statements in the voter pamphlet.

ISSUES/ANALYSIS

At the time the agenda was printed the San Bernardino County Elections office was unable to provide a cost estimate due to an ongoing cost analysis related to providing consolidated election services being conducted by the County Administrative Office. The County estimates that they will have a cost breakdown available on or about July 12, 2024, just prior to the beginning of the nomination period on July 15, 2024. The deadline for cities to adopt regulations regarding Candidate Statements is July 8, 2024.

The final cost of providing the candidate’s statement will be provided by the county Elections Office several months after the election. Candidates choosing to file a candidate statement will be charged the estimated amount provided by the County when they submit their candidate statement during the nomination period. They will then be refunded or sent an invoice for the difference between the estimate and actual candidate statement costs once the Elections Office provides that final cost.

For reference, during the 2022 election the estimated Candidate Statement cost was $801 for District four (4) and $819 for District three (3). Staff anticipates the cost to be slightly higher during this election cycle as there is generally a rise in registered voters during a Presidential election.

SUBJECT: Lasting Images Landscaping Contract Amendment

RECOMMENDED ACTION

It is re commended that the City Council and Board of Directors of the Hesperia Water District authorize the City Ma nager to approve an amendment with Lasting Images Landscape in the amount of $221,440 for a not -to-exceed amount of $526,558 and approve a two -year contract extension for landscape maintenance and repair services.

BACKGROUND

The City has continued to contract for landscape maintenance and repair services to maintain landscaping throughout various locations in the City to provide a beautiful amenity for our community. This also includes repairs to the irrigation system and plant replacements. Landscape maintenance and repairs are performed regularly across all city facilities, township common area, Park-&-Ride, and Eighth Street Paseo. Without regular scheduled landscape maintenance and repair, the existing landscape would fall into despair.

ISSUES/ANALYSIS

The City prepared a formal bid that was released on June 17, 2021, and closed on June 28, 2021, with three (3) bidders responding , and Lasting Images Landscape was deemed the lowest responding and responsible bidder for a three -year contract ending on June 30, 2024. Staff recommends continuing service with Lasting Images Landscape as they have continued to provide great services. Additionally, Lasting Images Landscape has agreed to hold the current contract pricing for two (2) years through June 30, 2026.

CITY GOAL SUPPORTED BY THIS ITEM

Public Safety: Ensure public safety resources adequately protect our community.

Sufficient funding will be included in the proposed Fiscal Year 2024-25 Operating Budget.

SUBJECT: Guardian Records Management and Storage Contract

RECOMMENDED ACTION

It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to approve a three-year contract with Guardian Records Management and Storage (Guardian ) for a not -to-exceed contract amount of $ 60,000, for the storage, maintenance, and destruction of City records.

BACKGROUND

In 2017, the City entered into a three-year contract with Guardian for the storage, maintenance, and eventual destruction (where applicable) of City records after the sale of the Eagle Plaza facility where records were previously stored. This contract was renewed as a sole source in 2020 for an additional three years.

ISSUES/ANALYSIS

The current contract with Guardian expires at the end of Fiscal Year (FY) 2023-24. Staff have been pleased with the performance and security of the services offered by Guardian during the term of the contract. Staff is seeking a new three-year contract going forward through FY 2026-

27. Guardian has held their pricing through our current contract and the physical transfer of stored records makes changing vendors cost prohibitive.

SUBJECT: Veterinary Services Contract

RECOMMENDED ACTION
It is recommended that the City Council approve Dr. Velasco Veterinary Services Contract for a not-to-exceed contract amount of $1 55,000 for Fiscal Year (FY) 2024 -25, for Spay and Neuter services, Premise Permit, and Telemedicine appointments.

BACKGROUND
The City released a Request for a Formal Bid for Spay and Neuter Services, Premise Permit, and Telemedicine, on May 16, 2024. This Request for a Formal Bid was advertised in the Victorville Daily Press and 20 local vets were emailed. Public Purchase was used to attract a broad range of interested parties. The bid closed on June 3, 2024, with Dr. Jaime Velas co being the only responsive bidder.

ISSUES/ANALYSIS
The City requires the services of a licensed veterinarian to conduct spay and neuter services for shelter animals and those that have been adopted out on deposit, however requiring sterility. The Premise Permit is needed to store and use controlled substances onsite. Telemedicine is utilized to evaluate animals and provide the quickest, efficient, diagnosis and treatment to shelter animals instead of having an on-site veterinarian.

SUBJECT: Professional Services Agreement with NBS for Community Facilities District No.’s 2021-1 and 2022-1 Annexation Services

RECOMMENDED ACTION

It is recommended that the City Council approve a Professional Services Agreement (PSA) with NBS, in an amount not to exceed $150,000, for Community Facilities District (CFD) No.’s 2021-1 and 2022-1 annexation services for a term of three (3) years.

BACKGROUND

Government Code Section 53311, the Mello-Roos Act of 1982, allows local governmental entities, such as Hesperia, to form Community Facilities Districts ( CFDs) to fund maintenance of public facilities, including street lighting, landscaping, drainage, and other basic public infrastructure and services including fire and emergency services.

In May of 2021, staff completed a Fiscal Impact Analysis for Citywide Future Development. Th e analysis identified the potential negative fiscal impacts to the City of new developments throughout the community.

With this in mind, i n February and May of 2022, the City Council adopted separate resolutions establishing the formation of CFD 2021-1 (for new residential development) and CFD 2022-1 (for new non-residential development) with the intention that future development within the City would annex into one of the respective districts and offset any negative fiscal impacts associated with new development.

The services funded via CFD’s 2021-1 and 2022-1 include, but are not limited to, police protection services, maintenance and lighting of parks, parkways, streets, roads, storm drains, and open space. The services funded also include all direct and incidental costs related to providing for the maintenance of public infrastructure.

ISSUES/ANALYSIS

Currently, the City contracts with NBS to provide administration/delinquency services for CFD 2005-1 (Belgate Development), CFD 2021 -1, CFD 2022 -1, and CFD 2023-1 (Silverwood Maintenance and Services).

In addition to the work described above, staff is seeking NBS’ assistance in annexing future residential and non -residential development into CFDs 2021-1 and 2022 -1. Specifically, all residential projects, consisting of four (4) or more units , as a condition of approval, are required to annex into CFD 2021-01 prior to the issuance of a Certificate of Occupancy. Likewise, all non-

Page 47 ends
Page 2 of 2 ends

Staff Report to the Mayor and Council Members

residential (i.e., industrial) projects requiring discretionary approval from the City are required, as a condition of approval, to annex into CFD 2022 -01 prior to the issuance of a Certificate of Occupancy.

The current CFD maximum special tax rates for non-residential projects are as follows:

Industrial Property: $0.15 per building square foot
Industrial Parking Facility Property: $0.15 per improved square foot Mixed-Use Property: $0.15 per building square foot

The current CFD maximum special tax rates for residential projects are as follows:

Single-Family Residential: $840.35 per unit
Multi-Family Residential: $536.20 per unit
Accessory Dwelling Unit: 30% of the maximum rate for the property type of the primary unit.

Lastly, t he cost for NBS to process annexation requests is $5,500 (per application) and it is anticipated that NBS will process approximately 5-10 applications per year for the next three (3) years. Additionally, approval of the PSA with NBS does not mean the entire contract amount will be used but will be available for use when required.

CITY GOAL SUPPORTED BY THIS ITEM

Future Development: Facilitate balanced growth to ensure cohesive community development and pursue economic development.

FISCAL IMPACT

The annexation services will be funded from the applicable CFD funds (Fund 241 for CFD 2021- 1 and Fund 242 for CFD 2022 -1), with the cost for the services recovered through fees paid by the developer. A budget amendment will be requested during the quarterly budget review, as the cost for annexation services was not included in the proposed FY 2024-25 Budget.

SUBJECT: Gibson Land Consulting Contract Amendment

RECOMMENDED ACTION

It is recommended that the City Council authorize the City Manager to approve an amendment of $261,000 to the existing contract with Gibson Land Consulting for a revised not -to-exceed contract amount of $310,500 and approve a two-year contract extension for Planning services for the Silverwood Development Project.

BACKGROUND

Due to the complexity of the Silverwood Development Project, the city entered into an agreement with Gibson Land Consulting to provide high-level planning expertise and guidance. The Silverwood Development Project must implement a multitude of conditions from within the adopted Tapestry Specific Plan and approved Final Environmental Impact Report (EIR) .

Compliance with the Specific Plan and EIR as well as the Silverwood Development Agreement, project conditions of approval, the development code , and the subdivision map act create s a challenging dynamic.

ISSUES/ANALYSIS

In the near future, the Silverwood Development Project will begin the entitlement and environmental process for subsequent phases within th e project. Continuing to partner with Gibson Land Consulting to provide planning services will benefit the city and the development by providing the expertise needed to navigate through the entitlement process. Gibson Land Consulting provides specific expertise in Master Planned Developments and partners with the city to mitigate any potential risk. The Development Agreement under Section 3.18(c) provides the city with the latitude to bring on outside contracting firms to assist with the processing of proje ct approvals at a cost borne by the developer. This contract amendment will provide the city with the services needed to get the project functioning and operating during the early part of the entitlement phase while the in -house planning staff continues to support the builders through normal city processes and procedures.
