SUBJECT: American Rescue Plan Act (ARPA) Grant Equipment Procurement – One Trailer Mounted Vacuum Excavator
RECOMMENDED ACTION
It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter an agreement with RDO Equipment Co. for the purchase of one (1) 2024 Vermeer LP873XDT trailer -mounted vacuum excavator in the not -to-exceed amount of $84,306.
BACKGROUND
Vacuum excavators can remove a significant amount of earth with minimal damage. They excel in applications ranging from cleaning up storm drains, assisting with water main breaks, efficiently excavating small holes, digging around utilities, and replacing more labor -intensive work methods.
The District currently possesses four large vacuum excavators between the Distribution and Pipeline programs with the oldest being fifteen (15) years old. This purchase will allow both programs to access two units, with one used as a spare, which will alleviate downtime if one asset requires repairs.
ISSUES/ANALYSIS
Hesperia Public Works released Request for Bid (RFB) 2024 -25-009 for one (1) trailer-mounted vacuum excavator on August 21, 2024, soliciting bids from four (4) vendors. The bid closed on September 3, 2024, with two (2) responses received. Staff recommends awarding the bid to RDO Equipment. Co., which has been deemed the lowest responsive/respon sible vendor with a total bid amount of $64,306.
CITY GOAL
Public Safety: Ensure public safety resources adequately protect our community.
Financial Health: Maintain a balanced budget and adequate reserves.
FISCAL IMPACT
ARPA Grant funding in the amount of $84,306 has been identified for the proposed purchase of the one (1) trailer mounted vacuum excavator. The City has identified available American Rescue Plan Act (ARPA) Grant funds that are an eligible funding source for the vacuum excavator. If approved, an amendment to the FY 2024 -25 Budget will be presented at the First Quarter Budget review to appropriate the necessary funds.

RECOMMENDED ACTION
It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter an agreement with Fairview Ford for the purchase of one (1) 2024 Ford F-550 flatbed truck in the not-to-exceed amount of $87,286.
BACKGROUND
This vehicle will be dedicated to haul the skid mounted valve exerciser which allows the D istrict to implement a self-performing valve maintenance program. The skid mounted unit will be fastened to the flatbed portion of the truck. A large open surface area as found in a flatbed truck is necessary due to the size of the skid mounted system. Along with exercising valves, the skid mounted system contains a vacuum and pressurized water syste m that assists with the removal of debris that accumulates within the valve pit. Additional storage bins located on the flatbed truck will be used to store materials needed for valve repairs. Due to the size of the skid mounted exerciser, the flatbed truck can only be utilized for the valve maintenance program.
ISSUES/ANALYSIS
Hesperia Public Works released Request for Bid (RFB) 2024 -25-012 for one (1) flatbed truck on August 21, 2024, soliciting bids from six (6) vendors both locally and out of the area to maximize bid response. RECOMMENDED ACTION
It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter into an agreement with Westrux International for the purchase of one (1) 2024 International HV607 10–12-yard dump truck in the not-to-exceed amount of $191,289.
BACKGROUND
There is currently a shortage of 10-12 yard dump trucks available to the District, required for the transportation of bulk materials like asphalt, gravel, sand, and debris between various job sites and the public works yard. Renting dump trucks, as has been done in the past, can prolong response time when residents are without water or when leaks are affecting the community. During natural disasters, they are crucial for aiding in clean-up efforts to protect the vital infrastructure as well. Their hydraulic systems make it easy to unload materials quickly and efficiently, making them a valuable asset.
ISSUES/ANALYSIS
Hesperia Public Works released Request for Bid (RFB) 2024 -25-011 for one (1) 10-12 yard dump truck on August 21, 2024, soliciting bids from three (3) vendors both locally and out of the area to maximize bid response . The bid closed on September 5, 2024 with three (3) responses received.

RECOMMENDED ACTION
It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter an agreement with E.H. Wachs for the purchase of one (1) 2024 Wachs ERV-750 skid mounted valve exerciser in the not-to-exceed amount of $91,583.
BACKGROUND
Water valves are an integral part of a water distribution system that are necessary to isolate sections of water lines. There are over 14,500 valves within the District’s service area that staff maintains.
Valves are subject to consistent wear and tear. Water valve exercising is a process of opening and closing a valve multiple times to keep it operating properly by preventing sticking and corrosion. Valve exercising helps prevent debris buildup, relubricates certain parts, and stimulates the seal.
Valves are currently exercised by using a valve key that is manually operated. Each valve is closed and then reopened. Larger valves require up to 70 revolutions to be completely closed. This asset will not only reduce operator fatigue, but additional benefits include adequate torque output which is needed to exercise a valve and prolong its useful life. Valves less than 12” in diameter are exercised every five years while critical valves are exercised annually.
ISSUES/ANALYSIS
The Public Works Division released Request for Bid (RFB) 2024 -25-008 for one (1) skid mounted valve exerciser on August 21, 2024, soliciting bids from the only two (2) vendors that sell this product.

SUBJECT: Contract with Badger Meter, Inc.
RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Water District authorize the City Manager to enter into a three-year contract with Badger Meter, Inc. in the not-to-exceed amount of $785,000 for the monthly fees associated with cellular service and data hosting for the Advanced Metering Infrastructure (AMI) program.
BACKGROUND
In 2015, the Hesperia Water District began installing the Badger AMI system as the replacement to the Automated Meter Reading (AMR) program which was discontinued. The AMI network consists of a cellular endpoint that is wired to the water meter register. The water meter register communicates with these endpoints, and the endpoints transmit this information to the cloud hosted software.
As of July 1, 2024, the District has completed the installation of 22,725 endpoints, approximately 81% of the meters within the District’s service area. Staff anticipates installing 2,805 additional endpoints in Fiscal Year 2024-25, bringing the project completion to 91%. This process eliminates the need for a Meter Reader to obtain bimonthly readings, allowing s taff to prioritize customer service calls and focus on the meter replacement program.
ISSUES/ANALYSIS
With the previous agreement for the AMI program having ended June 30, 2024, staff solicited a new quote from Badger Meter, Inc. to establish a new three-year contract. Having an established contract secures pricing over the duration of the contract . Badger Meter, Inc. is the sole source provider of this service as it is proprietary with their AMI program and water meter infrastructure.

RECOMMENDED ACTION
It is recommended that the Board of Directors of the Hesperia Water District authorize the City Manager to enter into an agreement with Doug’s Autobody for the repair of vehicle 1185 in the not- to-exceed amount of $17,00 0 and adopt Hesperia Water District (HWD) Resolution No. 2024-16, amending the Fiscal Year (FY) 2024-25 Budget by appropriating $17,000.
BACKGROUND
Vehicle 1185, a 2019 Ford F-150 Super Crew was involved in a traffic accident on April 13, 2023.
Although the engine was not damaged, the vehicle requires repairs to the front-end including the radiator, fenders, hood, and grill. Procuring a new replacement truck would exceed $50,000.
ISSUES/ANALYSIS
Hesperia Public Works requested a quote for repairs to vehicle 1185 on August 22, 2024, soliciting bids from three (3 ) local vendors. The bid closed on August 30, 2024 with three (3) bids received.
Staff recommends awarding the bid to Doug’s Autobody, LLC. who have been deemed the lowest responsive /responsible vendor with a total estimate of $15 ,755. Contingency funds are being requested in the event additional work is required once repairs are started.
CITY GOAL
Public Safety: Ensure public safety resources adequately protect our community.
Financial Health: Maintain a balanced budget and adequate reserves.
FISCAL IMPACT
Funding for this purchase was not included in the FY 24-25 Budget. Therefore, staff is requesting approval from the Board of Directors to increase the Water Operating Fund (700) budget by $17,000 via Resolution No. 2024-16.

TO: Mayor and Council Members
FROM: Rachel Molina, City Manager
BY: Cassandra Sanchez, Director of Public Works / City Engineer Tina Souza, Senior Project Manager
SUBJECT: Sully-Miller Contracting Co. Construction Contract Change Orders and Contract Amendment
RECOMMENDED ACTION
It is recommended that the City Council approve and authorize the City Manager or designee to execute an amendment to the contract with Sully Miller Contracting Co. (SMCC) for $6,232,244, plus a 10% contingency of $623,224 for a revised not-to-exceed contract amount of $48,562,661 for the construction of the Ranchero Road Corridor Widening Project, Phase III.
Additionally, it is recommended that the City Council adopt Resolution 2024 -50 appropriating $6,855,468 ($6,232,244 contract amendment and $623,224 contingency).
BACKGROUND
The Ranchero Corridor Widening Project, Phase III (Project) consisting of improvements to widen the five-mile roadway segment of Ranchero Road from two lanes to five lanes from Seventh Avenue westerly to approximately Royal View Lane , has been the City’s highest priority for roadway capital construction.
On November 4, 2021, the City entered into a contract with Sully-Miller Contracting Company for construction of the Ranchero Road Corridor Widening Project, Phase III (C.O. Nos. 7094, 7131, 7146, 7139, 7154). The Project began construction in April 202 2. Waterline relocations and roadway improvements are complete with the exception of minor incidental items. However, the bridge over the aqueduct has not commenced construction.
ISSUES/ANALYSIS
The Project has faced unanticipated challenges throughout construction such as severe storm events, utility conflicts, material delays, the need for additional environmental services, and other unforeseen factors. However, most notably, there was a significant delay in receiving the final Department of Water Resources (DWR) permit to proceed with construction of the bridge over the aqueduct.
While construction of the waterline relocation and roadway plan phases are complete with the exception of some minor tasks, the start of construction for the bridge over the aqueduct phase is pending; Once the bridge is under construction, the Project will continue into 2025 through the project close-out phase.
Staff Report to the Mayor and Council Members
Sully-Miller Contracting Co. Construction Contract Change Orders and Contract Amendment October 1, 2024
Since the project bid in 2021, with the inflation seen across the nation, construction costs have increased. The lengthy delay in ability to commence bridge work necessitates a cost escalation adjustment amendment to the contract bid items associated with the bridge in the amount of $5,014,335 in addition to the following two Contract Change Orders of $950,161 for a total of $5,964,496 to continue with construction.
The contractor was not able to perform the bridge work concurrent with the rest of the pro ject resulting Contract Change Orders for bridge related items:
Additional trucking and other impacted portions of work for non-concurrent activities. For example, stockpiling materials for use on the bridge and trucking from those stockpiles. Shoring changes.
Additionally, the following are three additional pending Contract Change Orders outside the original scope of work that require authorization and additional increase to the contract with an estimated total of $267,748:
Monthly storage of sleeve material a s well as girder storage until these items can be shipped for installation immediately upon arrival.
Traffic control at the bridge until the detour is implemented for demolition and additional message boards for the hard closure at the bridge.
The cost adjustments in addition to the pending change orders bring the additional construction cost to $6,232,244, plus a 10% contingency of $623,224 for a total of $6,855,468.
Continuing construction with the Project and the Ranchero Road Aqueduct Crossing portion of the corridor is dependent on an amendment to the contract and a budget appropriation.
Staff is requesting that City Council approve a contract amendment to increase the contract to include the cost adjustments and Contract Change Orde rs. The original contract authority is $41,707,193 for the Project. The total increase to the contract is $6,855,468, bringing the total not to exceed contract amount to $ 48,562,661. As the project nears completion in Fiscal Year (FY) 2025-26, staff will provide a detailed reconciliation of the total costs and necessary contingency amount to the City Council.
CITY GOAL SUPPORTED BY THIS ITEM
Capital Improvement - Continually evaluate capital improvement priorities.
FISCAL IMPACT
The FY 2024 -25 Capital Improvement Program (CIP) Budget includes $11,666,020 for the Ranchero Road Corridor project, of which $10,384,262 was allocated to the aqueduct crossing.
As mentioned in this staff report, an additional $6,855,468 will be needed to complete the project.
The following table details the funding sources:
Staff Report to the Mayor and Council Members
Sully-Miller Contracting Co. Construction Contract Change Orders and Contract Amendment October 1, 2024
Should the City Council approve the contract change order and Resolution No. 2024-25, the City will use three different funds for the appropriation request of $8,093,019. As the bridge will serve to convey stormwater, the City will use a portion of its ARPA funds as the bridge becomes a component of the City’s stormwater conveyance system. Additionally, included in Fund 504 (reimbursement fund) is $750,000 of the County ARPA funds. Finally, the City pla ns to use Measure I to pay the remaining funds. Funding is subject to change depending on funding sources and available amounts as the project progresses.

More specifically, f or the last several years , the City has contracted with LDM to assist in the implementation of CDBG -funded programs and to ensure compliance with Federal regulations and guidelines.

The current Professional Services Agreement (PSA) for professional CDBG administration and housing services is about to expire. The Economic Development division is responsible for the preparation of the City’s five-year 2025-2029 Consolidated Plan, yearly Action Plan, and an update Analy sis of Impediments to Fair Housing. The City has historically used professional services in administering its CDBG -funded programs to ensure compliance with federal regulations and timeliness. The award of the PSA is necessary to continue professional CDBG administration/implementation, housing, and labor compliance monitoring.
With this in mind, staff is requesting that the City Council authorize the City Manager, or designee, to execute a PSA with LDM because: 1) they have a long-term relationship with HUD which has and will continue to benefit the City’s stance with HUD to maintain its annual CDBG allocation; 2) LDM has successfully performed the above tasks and at this point in time, contracting with a new

SUBJECT: Amendment to Contract with Data Ticket, Inc.
RECOMMENDED ACTION
It is recommended that the City Council authorize the City Manager to approve an amendment of $150,000 to the existing contract with Data Ticket, Inc., for a revised not -to-exceed amount of $452,250, for the management and collection of citations, cost recovery, appeals, and additional hearing officer services for animal control.
BACKGROUND
In 2012, the City contracted with Data Ticket, Inc. (Data Ticket) to provide for the management and collection of citations, cost recovery, appeals and hearing officer services. In 2015, the City also re-instituted the use of the special assessment program offered by the County of San Bernardino for collection of outstanding fines. These two programs are used in conjunction to collect fines and fees due from enforcement procedures.
On May 17, 2022, the City Council authorized the current three-year contract with Data Ticket in the amount of $302,250, with an option to extend for two additional year s. The current contract expiration date is June 30, 2025 with an additional two-year extension available.
ISSUES/ANALYSIS
From July 1, 2022, to July 1, 2024, collections from Data Ticket have resulted in a total revenue of $623,236 from administrative citations, parking citations, DUI fees, and the Police Multiple Response Program.
The City’s current contract with Data Ticket, Inc. expires on Ju ne 30 , 2025. With the curr ent Council Authority of $302,250, and the total contracted expenses to date at $273,019 with an additional 12 months remaining, the contract amendment of $1 50,000 will be sufficient to cover the costs of the remaining contract expenses.
The Data Ticket contract is unique in that the City and Data Ticket have a joint escrow account through which revenue and payments are passed through. Data Ticket collects fines on behalf of the City and each month reconciles the amount due to the City after payment of their fees. As such, there are budgeted funds each year to pay the Data Ticket invoices.
Staff Report to the Mayor and City Council
Amendment to Contract with Data Ticket, Inc.
October 01, 2024
Staff intends to continue using Data Ticket, Inc. to provide hearing officer services, parking citation processing and processing of citations for the Police Multiple Response Program, Truck Route Program, Off-Highway Vehicle citations, DUI fee collection, Building and Safety Administrative Fines, and special cases in Animal Control and Code Enforcement where collection through means besides the special assessment program is the most appropriate means of collection of fines
Parking citation processing must be adjudicated and serviced by an agency that is able to make inquiries with the Department of Motor Vehicles; Data Ticket has that authority. Further, unpaid parking citations are recovered through the DMV registration process, which typically occurs on an annual basis.

SUBJECT: League of California Cities Membership
RECOMMENDED ACTION
It is recommended that the City Council receive and file this staff report, which provides information regarding membership and annual conference registration fees paid to the League of California Cities.
BACKGROUND
At the September 3, 2024, City Council meeting, Council Member Gregg requested that an item be agendized regarding the League of California Cities (League) membership and expenses associated with attendance at the annual conference. The City is a member of the League, which is an organization representing local government interests on a statewide basis. The League was founded in 1898 and provides a number of services to local governments such as lobbying, networking, training seminars and information sharing.
In 2001, the League formed a grassroots network to enhance coordination of City officials’ efforts locally to influence legislators, their staff, community groups, and news media. The League network consists of 16 regional divisions each staffed by a League Regional Public Affairs Manager that works with City officials and the regional divisions of the League to promote key League legislativ e priorities with legislators, district staff, social media, and other supporting community groups.
Currently, 476 of 483 cities in California are members of the League of California Cities.
ISSUES/ANALYSIS
The League’s membership dues for 2024 were $30,959 and the annual fee for the Desert Mountain Division Dues is $600 . Membership dues are determined based on the population of the municipality. Attended by both electeds and staff, registration fees for the League’s annual conference is approximately $650 per person; this fee does not include travel expenses, if any.
Generally speaking, attendance by electeds at other League of California Cities Conferences is limited to the two City Council delegates, who are appointed annually by the City Council.
Exceptions to this occur with the attendance of newly elected City Council Members at the League’s New Mayor and Council Member conference, which takes place every two years.
